Christine Rozek reported this is an application by Frieda Corporation, doang business as A& M Auto Sales & Service for an auto repair gazage. This is already a licensed establishment. The license currently there is a Second Hand Dealer-Motor Vehicle License. There are some current conditions on this license. LIEP's recommendation is for approval with some additional conditions. Larry Zangs reported five condifions are recommended for this license as follows: 1) Vehicles associated with the business may not be stored in or project into the public sidewalk or in the street; 2) There shall be no exterior storage of vehicle parts; 3) Auto repair shall be an accessory use to the dealership; the only vehicles that can be fixed are the ones being sold; 4) The repair of any vehicle outdoors is prohibited; and 5) Storage and handling of hazardous waste shall be in accordance with the Ramsey County Hazardous Waste regulations. Richazd Preston, ll 5 Winona Street East, appeared and stated he lives adjacent to the business. He would like one more condition added to the license: the business will lower their 12 foot door when using loud power tools, especially the kind that resonate sound, He especially notices the noise after 4:00 pm. There is a body shop on the north that leaves their doors open a1so; that owner is unwilling to drop the doors down. Barb Munoz appeared and stated she concurs with Mr. Preston. A high pitched noise can be heard early in the morning and in the afternoon. In the middle of suimner, she likes to have the windows open. Ali Zahedi, owner, and Miguel Azar, attorney, appeared. Gerry Strathman asked far their thoughts on the conditions recommended by LIEP and the condifion proposed by the neighbors. Mr. Azar responded A& M has moved away from repairing automobiles as a source of income. They are strictly selling cars and doing the warranty work. Mr. Azar has no problems with Condition #3 as long as it is understood that it includes warranty work. Mr. Zangs responded he shuggled with the language on that one. He 00 s A& M AUTO SALES AND SERVICE - 845 ROBERT STREET SOUTH Page 2 was comfortable with the word "dealership" because it meant any work in prepazation of selling the vehicles and any work required as wananty work. Mr. Aar stated he talked to Richard Preston and Barb Munoz. Mr. Preston and Mr. Zahedi has talked in the past. Mr. Zahedi has agreed to keep the doors ciosed, which is generally his practice. Complaints about 730 a.m. noise does not apply to Mr. Zahedi because A& M is not open at that time. Mr. Strathman asked are they okay with the additional condition about the doors. Mr. Azar responded that is not a problem. Gerry Strathman stated he received a letter from Richazd Preston dated December 28, 1999. He also received a letter dated January 14, 2000, from Steve Faust of the West Side Citizens Organization (WSCO). Mr. Faust wrote that WSCO held a hearing, A& M has been a good neighbor, Mr. Zahedi has been easy to work with in addressing concerns, and WSCO recommends approval of the license application. Gerry Strathman recommended approval of the license with conditions based on the applicant accepting the conditions that have been proposed and the favorable recommendaUon from the neighbors. The conditions are as follows: 1) Vehicles associated with the business may not be stored in or project into the public sidewalk or into the street; 2) There shall be no exterior storage of vehicle parts; 3) Auto repair sha11 be an accessory use to the dealership; 4) The repair of any vehicle outdoors is prohibited; 5) Storage and handling of hazazdous waste shall be in accordance with the Ramsey County Hazardous Waste regularions; 6) Licensee sha11 monitor noise of equipment required for servicing vehicles.
