PAGE 2 Mr. Strathman granted a variance on the nonconforming doors with the following condirions: 1) when the doors need to be replaced, they will be replaced with conforming fire rated doors, and 2) the building must otherwise be in compliance. 53 Hiiltop Lane Ted Anderson, 7r., properiy owner, appeared He stated he received a variance a number of years ago on one of the down spouts when the city separated the storm and sanitary sewers. He received the variance because he has a severely disabled daughter who lives in a group home but returns home to her family on weekends. He said a rainleader crossing the sidewalk would be a hazzard to her safety. Pat Cahanes, Department of Public Works, reported that the situation with this issue has not changed since 1995 which was the last tnne the matter was before a Legislative Hearing. At that time, the property owner was given a 5-year time extension. Mr. Cahanes said the manner in which Public Works views elderly ar handicapped tnne e�rtensions is that the person must reside at the home. When that is not fulfilled, they feel it is more a maintenance issue and the dovm spout would have to be moved from the sidewalk if it caused a problem. Mr. Strathman reminded Mr. Anderson that the City has an ordinance which indicates rainleaders must be disconnected and it makes no provision for granting variances. The ordinance was enacted pursuant to an agreement with the Federal Government. The only latitude the ordinance includes is time eatensions in order to allow people to come into compliance. Mr. Strathman noted that most of the rainleaders in St. Paul have been disconnected but there are a few, due to unusual circumstances, that have not been disconnected. Mr. Strathman told Mr. Anderson he would grant an extension of time to July i, 2001, and he wiil talk with the City Attorney's Office, the City Council, and possibly the Federal Government as to whether the ordinance can be amended to provide for variances in certain speciai circumstances so the matter can be permanently resolved. The meeting was adjourned at 1:43 p.m. mce 1775 Grand Avenue Note: Kathryn Berryman, tenant, is appealing the decision to have the third lock removed from her door. The reason for her appeal is as foliows: While technically there are three locks on her door, one of the locks does not require any action to disengage it. Ms. Berryman feels this will result in the removal of the sliding chain on her door, which she would like to keep for security reasons. He received the variance because he has a severely disabled daughter who lives in a group home but returns home to her family on weekends. He said a rainleader crossing the sidewalk would be a hazzard to her safety. Pat Cahanes, Department of Public Works, reported that the situation with this issue has not changed since 1995 which was the last tnne the matter was before a Legislative Hearing. At that time, the property owner was given a 5-year time extension. Mr. Cahanes said the manner in which Public Works views elderly ar handicapped tnne e�rtensions is that the person must reside at the home. When that is not fulfilled, they feel it is more a maintenance issue and the dovm spout would have to be moved from the sidewalk if it caused a problem. Mr. Strathman reminded Mr. Anderson that the City has an ordinance which indicates rainleaders must be disconnected and it makes no provision for granting variances. The ordinance was enacted pursuant to an agreement with the Federal Government. The only latitude the ordinance includes is time eatensions in order to allow people to come into compliance. Mr. Strathman noted that most of the rainleaders in St. Paul have been disconnected but there are a few, due to unusual circumstances, that have not been disconnected. Mr. Strathman told Mr. Anderson he would grant an extension of time to July i, 2001, and he wiil talk with the City Attorney's Office, the City Council, and possibly the Federal Government as to whether the ordinance can be amended to provide for variances in certain speciai circumstances so the matter can be permanently resolved. The meeting was adjourned at 1:43 p.m. mce 1775 Grand Avenue Note: Kathryn Berryman, tenant, is appealing the decision to have the third lock removed from her door. The reason for her appeal is as foliows: While technically there are three locks on her door, one of the locks does not require any action to disengage it. This lock is located in the doorknob and is the equivalent of a lock on an interior door which turns with the knob. 00 -��y PROPERTY CODE ENFORCEMENT MEETING, 9-19-2000 PAGE 3 The removal of this lock causes no fewer actions or savings in time to unlock her door and e�t her apartment in case of fire or other emergency. As a tenant, she has no control over the fixtures in this apartment; therefore, the building owner will probably opt for the easiest solution for passing the code. Ms. Berryman feels this will result in the removal of the sliding chain on her door, which she would like to keep for security reasons.
