RESOLVED, That the Council of the City of Saint Paul,
recognizing its responsibility to protect the health and
sanitation standards of the citizenry, expressing its concern
over the inflationary economic situation and recognizing
national and local priorities toward energy conservation, does
hereby request that the Office of Mayor study and review the
establishment� of an organized mandatory solid �aaste collection
program which i� deemed to be economically feasible would in-
clude involvement by both public and �rivately owned collection
facilities and haulers; which program would be proposed by
ordinances which could be acted upon by the City Council by
September l, 1980; and, be it
FURTHER RESOLVED, That the Citv Council intends to transfer
sufficient funds to the Department of Public Works so as to
provide moneys sufficient to remove the accrued deficits in the
present solid waste collection program; and, be it
FURTHER RESOLVED, That the City Council does hereby acknowledge
the action taken b.y the Administration to terminate the present
solid waste collection program to all private city customers (13,200)
on May 9, 1980; and, be it
FURTHER RESOLVED, That the City Cauncil directs the Admini-
stration to retain 11 city refuse collecti.on vehicles (equivalent
to the 11 existing routes) beyond May 9th and until such time
as the city' s future role in solid waste col�.ection is determined,
and that no fewer than 3 refuse collection vehicles with a Truck
Driver and a Laborer assigned to each vehicle be used each work
day for Summary Abatement clean-ups charged against the property
owners and for refuse collection services to the following city

FURTHER RESOLVED, That the City Council requests the Admini-
stration to transfer the other affected sanitation employees to
comparable work assignments by May 9th with no work interruption
and no reduction in their pay and to examine the sta.ffing needs
in the Department of Public Works and other city departments
during the budget process to make every effort possible, wherever
it ma.kes economic sense, to provide year-around work for these
employees, giving part�cular emphasis to those having more than
fifteen years' city seniority; the Council would agree to fund
said positions in the 1981 budget; and, be it
FURTHER RESOLVED, That the City Council directs the Admini-
stration to closely consider any monopolistic trends that might
develop in the solid waste collection industry and to address this
issue in the plan to be presented by September lst.

RESOLVED, That the uncil of the City of Saint Paul, recognizing

to operate its present solid aste collection program; and, be

FURTHER RESOLVED, that the ity Council does hereby request

axnount of $234, 800, upon the recoznmendation o� t e Mayor and
pursuant to Section 1U. 07.4 of the City Charter s as to provide
sufficient funds to the City's municipal sol'id was e collection
program to allow it to be operated in a self-suffi 'ent manner
until September l, 1980; and, be it

follows : .
Be it resolved, that : `
1) action of the administrative branch discontinuing city
service is rescinded,
2) that the administration prepare an ordinance establishing
mandatory pick up, utilizing both city and private haulers ,
3) provide no rate increase for customers subscribing to the
- city service,
4) provide for the transfer of necessary funds from General
Revenue to subsidize the city service,
5) provide notice to city customers of city action incorporated
in this resolution in order to persuade them to remain
customers of the city.

WHEREAS, under the harter of the City of Saint Paul the
City Council is vested wi h all legislative power; and

WHEREAS, pursuant to th Charter of the City of Saint Paul
the City Council has exercise its legislative power in the area
of municipal solid waste collec ion and disposal , including, but
not limited to, 'Section 5.03 of e Administrative Code which
requires that the Director of the partment of Public Works
"shall . . . provide for a municipal lid waste collection and
disposal system and establish billing rocedures therefor"; and
WHEREAS, the existence and availab� ity of municipal solid
waste collection is an important service and concern of the
citizens of the City of Saint Paul ; and "�
I�iNEr�EAS, any action to eliminate or subs ntially c�rtail
municipal solid waste collection and disposal quires Council
participation and legislative action; and
WHEREAS, the executive decision to eliminate substantially
curtail municipal solid waste collection and disposa and taken
without Council action; and
LJHEREAS, any decision to eliminate or substantiall curtail
municipal solid waste collection and disposal seriously a fects
employees of the City of Saint Paul who are represented by labor
organizations that are signatory to collective bargaining a reements

RESOLVED, that the executive decision to eliminate or
substantially curtail municipal solid waste collection and
disposal be rescinded; that the Public Works Committee of the
City Council undertake to review and study the question and
advisability of continued municipal solid waste collection and
disposal ; that the Public Works Committee of the City Council
prepare recommendations with respect to the subject of continued
municipal solid waste collection and disposal ; and that the City
Council , if it deems advisable, draft an appropriate law or
ordinance for review and action by the Mayor; and be it
FURTHER RESOLVED, that any decision to eliminate or
substantially curtail municipal solid waste collection and
disposal be taken only after labor organizations representing
City employees affected by such decision are given notice and
opportunity to bargain and, further, only if such decision does
not violate the terms and conditions of any collective bargaining
agreement between the City of Saint Paul and the affected labor
organizations.
