WHEREAS, the Division of Housing and Building Code Enforcement has
requested the City Council to hold a public hearing to consider the
advisability and n�cessity of the correction or wrecking and removal
of the following described building and removal of the subterranean
tanks on the property, said structure and tanks having bean reported
to constitute a public hazard;
400 W. 7th St. The part southeasterly of Old boarded
Widened 7th Street of Lots gasolin� station
13 and 14, Block 4, Samuel and subterranean
� Leech's Addition tanks
WHEREAS, it appears that the last record owners and other parties
of interest of said buildings and tanks as of March 14, 1980 are
�. & M. Quality Oil Inc. , 1643 Briardale Road, Fridley, MN 55432,
Fee Owner; Triangle Refineries, Inc. , P.O. Box �#3367, Houston, Texas
55001, c% Sahr, Ktznnert & Tambornino, Attorneys at Law, 800 Farmers
and Mechanics Bank Bldg . , Minneapolis, MN 55402 has an unrecorded
interest; the Board of Water Commissioners, City of Saint Paul, has
liens in the amount of $37. 50 dated November 29, 1979 and $31.25 dated
July 17, 1979; the State Bank of St. Anthony Village, 2955 NE Pentagon
Drive, St. Anthony Village, MN has a mortgage in the amount of $38,000
dated December 7, 1977.

WHEREAS, the Division of Housing and Building Code Fr�forcement;
on behalf of the City Council did notify by mail the above noted parties
of interest at their last known addresses; �
WHEREAS, a public hearing was held by and before the Council of

the City of Saint Paul in the Council Chamber of the Court House in
said city at 10:00 a.m. on Thursday, April 10, 1980 to consider the
advisability and necessity of ordering the correction or wrecking
and removal of said structures and subterranean tanks on the above
described property inasmuch as said structures and tanks are reported
to constitute a hazard to public health, safety and welfare;
WHEREAS, upon the facts presented at the said hearing consisting
of photographs, inspection reports and the re oommendation of the
Building Departm�nt, it is further determined that the above building
and subterranean tanks constitute a hazardous building and tanks
within the definition of Minnesota Statutes 463.15 for the following
reasons:
1. The building is an old boarded gasoline station;
2. The subject property has. b�een-�oarded up by the owners since
January 20, � 1978; -
3. This building is boarded and hazardous;
4. Neighborhood complaints have been lodged against this
building;
5. The subterranean tanks have not been removed;
6. The conditions outlined above constitute a public hazard;
7. The owner has made no attempt to satisfactorily r�pair the
damage;

8. The continued vacant and boarded up condition contributes a
blighting influence on the neighborhood;
now, therefore be it,
RESOLVED, That in accordance with Minnesota Statutes Section 463.15
through 463.25, and based upon the foregoing findings of the City
Council, the Council of the City of Saint Paul does h�reby make the
following Order :
OR DER
1. The owners of the above described building and subterranean
tanks shall make the same safe and not detrimental to the public peace,
health, safety and welfare by having the said building razed and the
materials therefrom removed and the subterranean tanks removed from
the premises within thirty (30) days from the date of the service of
this Order;

2. Unless such corrective/is taken to comply with this Order or
an Answer served upon the City of Saint Paul and filed in th� office
of the Clerk of the District Court of Ramsey County, Minn�sota within
twenty (20) days from the date of the service of this Order, a Motion
for Summary Enforcement of this Order to raze 'and remove the said
buildings and to remove the subterranean tanks will be made to the
Ramsey County District Court;
3. In the event that the buildings ar� to be razed and the tanks
are to be removed by the City of Saint Paul pursuant to judgment of the

unreasonably interfere with the razing and removal of these buildings
and tanks shall be removed within ten (10) days from the entry of
judgment; and if not so removed, th� City of Saint Paul shall remove
and dispose of such �crsonr�gl property and fixtures as provided by law;

action herein, all necessary costs expended by the City will be assessed
against the above describ�d real estate and collected as other taxes;

The Division of Housin.g and Building Code Enforcement is hereby submitting its report
on the condition of the structure at the location referred to above.
The own�rs of record are; 1. Fee Owners: J � M Quality Oil, Inc. , 1643 Briardale
Road, Fridley, luflV 55432; 2. Unlisted owners: Triangle Refineries, Inc. ,
P. 0. Box #3367, Houston, Texas 55001; 3. Sahr, Kimert � Tamborinino, 800 F � M
Bank Building, Minneapolis, N1�1 55402, attorney for Triangle Refineries, Inc.
The legal description of the property is: Sam'1 Leeches Addition, SEly of Widened
7th Str. of Lots 13 and 14, Block 4, Parcel code: 05-44600-140-04.
The building is an old boarded gasoline station.
The subject property has been boarded up by the owners since January 20, 1978.
This buildir�g is boarded and hazardous. Neighborhood cor�laints have been lodged
against this buil ding. In the demolition removal of the subterranean tanks must
be included.
Inasmuch as the conditions outlined above constitute a public hazard and the owner
has ma.de no attempt to satisfactorily repair the dama.ge despite our warni.ngs, and
the continued va.cant and boarded up condition contributes a blighting influence on
the neig�borhood, it is the recommendation of this Division that this matter be
referr to the City Attorney's office for razing and removal through District
Cou ceed.ings.
