An Ordinance amending Chapter 60 of the
St. Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, s�462.357 and 364.210
of the Legislative Code, Michael and Mary Franz and John and Ju�lith
Heinl duly petitioned to rezone Lots 11 through 14, inclusive,
Block l, Como Park Second Addition, located on the north side o�
Front Avenue between Argyle and Chatsworth, from B-2 to RT-1 f�r
the purpose of retaining and reinforcing the predominant resid ntial
character of the sites and of the general area, the petition having
been certified by the Department of Finance and Management Services
on November 23, 1979 as having been consented to by at least 67$
of the owners of the area of the property to be rezoned, and
further, having been consented to by at least two-thirds of the
owners of the property situated within 100 feet of the total
contiguous descriptions of real estate held by the same owner or
any party purchasing any such contiguous` property within one year
preceding the date ef the petition; and
WHEREAS, The current planning committee on January 3, 1980
conducted a public hearing for the purpose of considering the re-
zoning petition, and, pursuant to Section 107. 03 of the Administra-
tive Code, submitted its recommendation to the Planning Commission
that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on January 11, 1980 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

WHEREAS, A public hearing before the City Council, having been
conducted on March 20, 1980 where all interested persons were
heard, and the Council having considered all the facts and recom-
mendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the zoning map of the City of Saint Paul, Sheet No. 11,
as incorporated by reference in Section 60. 401 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on the north side of Front
Avenue -between Argyle and Chatsworth, being more
particularly descrihec? as Lots 11 through l4,
inclusive, Block 1, Como Park Second Addition,
be and is hereby rezoned from B-2 to RT-l.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Madam:
This is written in response to the petition of Michael and Mary Franz and
John and Judith Heinl to rezone from B-2 (Community Business) to RT-1
(Two Family Residence) property fronting on Front Avenue at the corner of
N. Chatsworth. The rezoning would affect the two adjacent properties,
each consisting of two 25 ft. wide lots for a total width of 100 ft.
Frontage on Chatsworth is 108.03 ft. for a total area of 10,803 sq. ft.
The purpose for rezoning is to retain and reinforce the predominant
residential character of the two sites and of the general area.
On January 3, 1980 the Current Planning & Zoning Committee of the Planning
Commission held a public hearing on the matter. There was no opposition
�ither in person or in written form regarding this request. It was noted
by staff during the hearing that the proposed downzoning is in keeping
with the neighb9rhood character and is supported by the District 6 Land
Use Task Force. The Task Force is in the process of preparing the final
land use recommendations for District 6 that will be formally presented
to the Planning Commission for consideration in the near future. The plan
strongly recommends the retention of this area for single and two family
housing. The Committee on a vote of 5 to 0, recommended approval based
on staff findings 1 through 5 and the fact that the present single family
use could be converted to duplexes.
On January 11 , 1980 the Planning Commission considered the petition. On
a vote of 13 to 0, the Commission voted to recommend approval of the down-
zoning to RT-1 .
This matter is scheduled to be heard by the City Council on March 20, 1980.

The meeting was chaired by James Bryan, Chairman.

The applicant was present There was no opposition present at the hearir�cr.
Mr. Jung showed slides of the site and reviewed the staff report. Staff
recommends approval of the rezoning. A letter was received from District 6
in support af the rezoning.
Michael Franz, 987 Front, applicant, stated that the purpose �of the reznning
is to keep small businesses from expanding. Peopie in the area are making
improvements on their homes and they want the Como area to stay residentfat.
Mr. Lanegran asked if it was the intention of the homeowners to convert those
houses into duplexes and was told by the applicant that was nct their intentian.
There being no further testimony, Mr. Bryan closed the public hearing portion
of the meEtirg.
Mr. Pangal asked staff how they could recommend an RT-i to ti�at property when
it is not contiquous to another RT-1 zone. He questioned whether this was
spot zoning. He stated that the applicant wants single family homes which
would be R-4. It would make mare sense to chanQe it ta R-4 which would then
make it contiguous with the other R-4 immediately adjacent to it. "
Mr. Jung stated that since Front and Chatsworth are major streets, the Tonq
range intent would be to provide for housing that would be more than single
family in nature. He also commented that the City Attorney's previaus ruling
which states that if a requested chancte is in accordance with the Comprehensi�re
Pian, then such rezoning is not spot zoning; conversely, if a praposed rezoning
is spot zoning, then it cannot be in accordance with the Comprehensive Plan.
Since the District 6 Land Use Task Force supports this contention under their
planning program, it is assumed that this would fall under that category.
Mr. Warn stated that staff is looking ahead a few months. The Corr�nittee of 100
and the Mayor are extremely interested in allowing two-family conversions on
appropriately sized lots throughout the city. 7his revision is going to be
requested formally within the near future from the Mayor's Office.
Mr. Pangal stated that according to the definition given by the City Attorney,
Mr. Straughn, this type of rezoning ti�ould constitute spot zoning because the
District 6 Plan has not been formally adopted.

Mr. Segal reported that the legal advice gi,ven by Mr. Straughn was general
in the sense that it did not say that you could never have a different zone
which is contiguous to another zone. The opinion stated that certain factors
would be considered by a court in reviewing what the city does in rezoning
property. Some factors which would be considered are: Is the proposed
zoning in accordance with the Comprehensive R1an? Are there changing conditions
in the area or mistakes in .the origi'�al zoning which warrant the change in the
zoning? Is the area to be rezoned small? Tf the area is small , the courts
take a very hard look at it. Also considered is whether the use to be
permitted under the proposed rezoning is substantially different from the nature
of the prevailing uses in the surrounding area which would mean more than just
the contiguous property.
Mr. Levy made a motion to recorranend approval of the rezoning to RT-t based on
staff findings 1 through 5. Ms. Karns seconded the motian. The motion passed
on a roll call vote of 5 to 1 with Mr. Pangal voting against the motion.

6. STAFF INVESTIGATION & REPORT: DATE Dec. 10, 1979 BY Edward J. Warn
A. SUFFICIENCY: The applicant's request was�filed on a consent petition subscribed and
sworn to before a notary public November 12, 1979; declared suffi'cient by the Finance
Department on November 23, 1979. . Twenty-seven parcels were eligible, eighteen parcels
were required and twenty-one parcels were signed.
B. HISTORY: While there is no zoning history for these parcels, the primary reason for
the rezoning petition is the zoning history on 991-97 Front Avenue which consists of a
duplex and automobile rspair garage. This neighbor�ng property, also zoned B-2, has
been the subject of several zoning cases including: 1 ) In June 1977, the Planning
Commission determined that the existing business was not similar to an auto service
station and could not expand as a cor�nercial repair garage. Since the proposal at the
time was to remove the duplex, the Current Planning and Zoning Committee recomnended
the applicant apply for a B-3 rezoning to make the garage a conforming use. This was
done in July 1977, under the short form petition. 2) On July 22, 1977 , the Planning
Comnission recomnended denial of the B-3 zoning. 3) �n October 4, 1977, the applicant
withdrew the rezoning request before City Council could act on the matter. 4� On
November 27, 1979, the Board of Zoning Appeals denied a variance request to subdivide
the property into two saleable lots (i .e. , the duplex an�::,the automobile repair garage.}
(See also Section H of this report.)
C. PURPOSE: The applicants wish to rezone their property from B-2 (Corr�unfty Business
Distr t) to RT-1 (Two-family residential ) . They wish to retain and reinforce the
residential character of the area.
D. FRONTAGE AND AREA: The four 25 ft. lots at the nor�hwest corner of Front and Chatsworth
have a tota of 00 foot frontag� on Front and 108.Q3 foot frontage on Chatsworth for a
total area of 10,803 sq. ft.
E. SITE/AREA CONDITIONS: The site is level and slightly above street grade. Two single
family detached, owner-�ccupied homes currently occupy the site. A corr�nercial auto
repair garage abuts the site on the west (see History above) . A vacant lot used for
parking automobiles for the cor�nercial auto repair garage abuts the site acrass the
alley to the north. A gasoline station and auto repair abuts t:he site across Chatsworth
to the east. (This property was also the subject of a recent rezoning to B-3 (denied) .
Calvary Cemetery occupies the southeast corner of the intersection of Front and _
Chatsworth. Various mixed commercial and residential structures occupy the south side
of Front across the street from the subject property.
F. FINDINGS OF FACT:
1 . The 1922 Zoning Ordinance identified this site and the entire narth side of Front
between Grotto and Lexington as commercial . The south side of Front between
Lexington and Dale was also zoned commercial with the exception �f Calvary Cemetery.
2. The 1963 Comprehensive Land Use Plan identified this site for "one and two fiami'ty
residences and town or row houses with a maximum density of 15 dwelljngs per net
acre".
3. The District 6 Land Use Task Force recommends approval of the rezoning (see also
Section H of this report.) '

4. Rezoning of the subject property wiil reinforce the residentiai cMaracter of the
block bounded by Front, Argyle, Hatch and Chatsworth. ,�

5. If the property were left in a 6-2 zone, construction of new conforming businesses
would be detrimental to the residential character of the area.
6. Metropolitan Transit Cor�nission buses (#5 route) that connect the University of
Minnesota and Como Park with downtown St. Paul travel on Chatsworth north of
Front Avenue and on Front Avenue east of Chatsworth. The site has good transit
service.
7. Rezoning to RT-1 will allow the internal conversion af the two existing single
family homes into duplexes.
G. STAFF RECOMMENDATTON: Based on Findings 1-5, Staff recomnends approual of the rezoning
request.
H. OTHER CONSIDERATIONS: The District 6 Land Use Task Force strongly recommends that the
anning Comn�ssion consider rezoning the adjacent automobile repair garage to a
residential classificatian.
The City Attorney's office has stated that the Planning Comnission may not legally
rezone any property other than that property that is a part of the petition. Nate:
the automobile repair garage is not a part of this petition. The peti�ioners could,
however, withdraw their rezoning request and resubmit a new rezoning request far the
entire B-2 zoning on the north side of Front between Chatswor�h and Argyle. The two
property owners, that have initiated this petition, own more than two-thirds of the
total area zoned B-2 and, therefore, could legally file a petition if they also could
obtain the signatures of two-thirds of the property owners within 100 feet of the
properties in question.
It is also the Staff's understanding that future rezoning of this site as a part of
the "40 Acre Study" would be difficult due to the low number of consent petition
signatures that would be required, as well as the fact that the site is not 40 acres
in size.
Planning staff would recorr�nend rezoning the entire north side of Front between
Chatsworth and Argyle (includes the automobile repair garage) to RT-1 if the prope�
petitions were filed.
