RESOLVED, that the Licensee, Bee Thao and Adam Thao d/b/a Thai Esan Restaurant
(License ID No. 19990000773), located at 432 University Avenue West in Saint Paul is hereby
ordered to pay a fine of $500.00 for the violation of Sale of Alcoholic Beverages to Underage
Persons.
Said fine shall be paid to the Office of License, Inspections and Environmental Protection
within thirty (30) days of the adoption of this resolution by the Council and signature by the
Mayor.
This resolution and the action of the Council in this matter are based upon the facts
contained in the August 7, 2000, Notice of Violation letter to the licensee and the Police Report
CN 00-135305. The licensee did not contest the facts of the violation.

Please take notice that this matter has been set on the Consent Agenda for the Council meeting
scheduled for 3:30 p.m., Wednesday, September 20, 2000 in the City Council Chambers, Third
Floor, Saint Paul City Hall and Ramsey County Courthouse.
Enclosed aze copies of the proposed resolution and other documents which will be presented to
the City Council for their consideration. This is an uncontested matter, in that the facts
concerning the sale of alcohol to an under age person have not been denied. The
recommendation of the license office will be for a$500.00 fine.

for the premises at 432 University Avenue West in Saint Paul

Deaz Bee Thao and Adam Thao:
The Office of License, Inspections and Environmental Protection has recommended
adverse action against the 3.2 Malt On-Sale License held by Bee Thao and Adam Thao, d/b(a
Thai Esan Restaurant, for the premises at 432 University Avenue West in Saint Paul. The basis
for the recommendation is as follows:
On July 12, 2000, a 19 year old male entered the premises of
Thai Esan Restaurant and ordered a Miller Lite beer. The
waitress served him the beer without asking for proof of age.
Selling alcohol to a person under the age of 21 is a violation of
Minn. Stat. §340A.503.
Since this is considered a first violation, the licensing office will recommend a�500.00 fine,
pursuant to St. Paul Legislative Code §409.26.
At this time you have three options on ho�v to proceed:
1. If you do not dispuFe the above facts and do not wish to have a public hearing, you will
need to pay the recommended fine for this violation. If this is your choice, you should
make payment directly to the Office of License, Inspections and Environmental
Protection, Room 300 Lowry Professional Building, 350 Saint Peter Street, Saint Paul,
Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the
fine will be considered to be a waiver of the hearing to which you are entitled.

2. Alternatively, if you do not dispute the above facts, but wish to have a public hearing
before the Saint Paul City Council, you will need to send me a letter with a statement `
admitting the violation and requesting a hearing by Friday, August 18, 2000. The matter
will then be scheduled before the City Council for a public hearing to determine what
penalty, if any, to impose. You wiil have an opportunity to appeaz before the Council and
make a statement on your own behalf as to the penalty to be imposed.
Ifyou do dispute the above facts, a hearing will be scheduled before an Administrative
Law Jud�e. At that hearing both you and the City will be able to appear and present
witnesses, evidence, and cr.oss-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. Please let me know in writing no later than Friday,
August 18, 2060, how you wish to proceed.
If you have not contacted me by Friday, August 18, 2000, I will assume that you are
not contesting the facts and will schedule this matter for the St. Paul City Council and have
it placed on the Consent Agenda during which no public discussion is allowed and the
recommended penalty will be imposed.

I, Sgt Ramstad, am assigned to the Vice Unit. The Vice Unit doing liquor
compliance checks of all licensed liquor establisl�menu in [he City of St Paul.
We aze using checkers that ue under the age of 21. They have been uained in
how to conduct the checks. Theg aze told that they can not lie about their age
or date of birth. They wear a microphone and a transmitter sa we can monitor
their conversation to determine if the check was conducted ptoperiy.
On 7i 12/2000 I went out and ccnducted checks using Checker `,r` S.i.
I verified that his date of birth was 8/29/1980 making him 18 years of age. I
took any form of identification he had along with any money he had. He was
given department funds to malce any purchases. '
At about 1730 hours I directed him in to Chiang Rai Restaurant az 432
University Ave W. He went in and sat down. The waisress came and he
ordered a Miller Lite. The waitress rehuned with an open Miller Lite bottle
and a glass. She gave the beer to the checker. At no time did the wai�ess
inquire about the age of the checker.
I enzeced and notified the waitress of the violation. The Checker was
alone at the tabie with the beer in froni of him . Tfie waiiress thought the
checker was about 19 years old. She does not work az the restaurant. She
was just filling in for the day to help ihe family. She has never had any liquor
compliance training.

The Office of License, Inspections and Environmental Protection has recommended
adverse action against the 3.2 Malt On-Sale License held by Bee Thao and Adam Thao, d/b(a
Thai Esan Restaurant, for the premises at 432 University Avenue West in Saint Paul. The basis
for the recommendation is as follows:
On July 12, 2000, a 19 year old male entered the premises of
Thai Esan Restaurant and ordered a Miller Lite beer. The
waitress served him the beer without asking for proof of age.
Selling alcohol to a person under the age of 21 is a violation of
Minn. Stat. §340A.503.
Since this is considered a first violation, the licensing office will recommend a�500.00 fine,
pursuant to St. Paul Legislative Code §409.26.
At this time you have three options on ho�v to proceed:
1. If you do not dispuFe the above facts and do not wish to have a public hearing, you will
need to pay the recommended fine for this violation. If this is your choice, you should
make payment directly to the Office of License, Inspections and Environmental
Protection, Room 300 Lowry Professional Building, 350 Saint Peter Street, Saint Paul,
Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the
fine will be considered to be a waiver of the hearing to which you are entitled.

2. Alternatively, if you do not dispute the above facts, but wish to have a public hearing
before the Saint Paul City Council, you will need to send me a letter with a statement `
admitting the violation and requesting a hearing by Friday, August 18, 2000. The matter
will then be scheduled before the City Council for a public hearing to determine what
penalty, if any, to impose. You wiil have an opportunity to appeaz before the Council and
make a statement on your own behalf as to the penalty to be imposed.
Ifyou do dispute the above facts, a hearing will be scheduled before an Administrative
Law Jud�e. At that hearing both you and the City will be able to appear and present
witnesses, evidence, and cr.oss-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. Please let me know in writing no later than Friday,
August 18, 2060, how you wish to proceed.
If you have not contacted me by Friday, August 18, 2000, I will assume that you are
not contesting the facts and will schedule this matter for the St. Paul City Council and have
it placed on the Consent Agenda during which no public discussion is allowed and the
recommended penalty will be imposed.

I, Sgt Ramstad, am assigned to the Vice Unit. The Vice Unit doing liquor
compliance checks of all licensed liquor establisl�menu in [he City of St Paul.
We aze using checkers that ue under the age of 21. They have been uained in
how to conduct the checks. Theg aze told that they can not lie about their age
or date of birth. They wear a microphone and a transmitter sa we can monitor
their conversation to determine if the check was conducted ptoperiy.
On 7i 12/2000 I went out and ccnducted checks using Checker `,r` S.i.
I verified that his date of birth was 8/29/1980 making him 18 years of age. I
took any form of identification he had along with any money he had. He was
given department funds to malce any purchases. '
At about 1730 hours I directed him in to Chiang Rai Restaurant az 432
University Ave W. He went in and sat down. The waisress came and he
ordered a Miller Lite. The waitress rehuned with an open Miller Lite bottle
and a glass. She gave the beer to the checker. At no time did the wai�ess
inquire about the age of the checker.
I enzeced and notified the waitress of the violation. The Checker was
alone at the tabie with the beer in froni of him . Tfie waiiress thought the
checker was about 19 years old. She does not work az the restaurant. She
was just filling in for the day to help ihe family. She has never had any liquor
compliance training.

ordered to pay a fine of $500.00 for the violation of Sale of Alcoholic Beverages to Underage
Persons.
Said fine shall be paid to the Office of License, Inspections and Environmental Protection
within thirty (30) days of the adoption of this resolution by the Council and signature by the
Mayor.
This resolution and the action of the Council in this matter are based upon the facts
contained in the August 7, 2000, Notice of Violation letter to the licensee and the Police Report

Deaz Bee Thao and Adam Thao:
The Office of License, Inspections and Environmental Protection has recommended
adverse action against the 3.2 Malt On-Sale License held by Bee Thao and Adam Thao, d/b(a
Thai Esan Restaurant, for the premises at 432 University Avenue West in Saint Paul. The basis
for the recommendation is as follows:
On July 12, 2000, a 19 year old male entered the premises of
Thai Esan Restaurant and ordered a Miller Lite beer. The
waitress served him the beer without asking for proof of age.
Selling alcohol to a person under the age of 21 is a violation of
Minn. Stat. §340A.503.
Since this is considered a first violation, the licensing office will recommend a�500.00 fine,
pursuant to St. Paul Legislative Code §409.26.
At this time you have three options on ho�v to proceed:
1. If you do not dispuFe the above facts and do not wish to have a public hearing, you will
need to pay the recommended fine for this violation. If this is your choice, you should
make payment directly to the Office of License, Inspections and Environmental
Protection, Room 300 Lowry Professional Building, 350 Saint Peter Street, Saint Paul,
Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the
fine will be considered to be a waiver of the hearing to which you are entitled.

2. Alternatively, if you do not dispute the above facts, but wish to have a public hearing
before the Saint Paul City Council, you will need to send me a letter with a statement `
admitting the violation and requesting a hearing by Friday, August 18, 2000. The matter
will then be scheduled before the City Council for a public hearing to determine what
penalty, if any, to impose. You wiil have an opportunity to appeaz before the Council and
make a statement on your own behalf as to the penalty to be imposed.
Ifyou do dispute the above facts, a hearing will be scheduled before an Administrative
Law Jud�e. At that hearing both you and the City will be able to appear and present
witnesses, evidence, and cr.oss-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. Please let me know in writing no later than Friday,
August 18, 2060, how you wish to proceed.
If you have not contacted me by Friday, August 18, 2000, I will assume that you are
not contesting the facts and will schedule this matter for the St. Paul City Council and have
it placed on the Consent Agenda during which no public discussion is allowed and the
recommended penalty will be imposed.

I, Sgt Ramstad, am assigned to the Vice Unit. The Vice Unit doing liquor
compliance checks of all licensed liquor establisl�menu in [he City of St Paul.
We aze using checkers that ue under the age of 21. They have been uained in
how to conduct the checks. Theg aze told that they can not lie about their age
or date of birth. They wear a microphone and a transmitter sa we can monitor
their conversation to determine if the check was conducted ptoperiy.
On 7i 12/2000 I went out and ccnducted checks using Checker `,r` S.i.
I verified that his date of birth was 8/29/1980 making him 18 years of age. I
took any form of identification he had along with any money he had. He was
given department funds to malce any purchases. '
At about 1730 hours I directed him in to Chiang Rai Restaurant az 432
University Ave W. He went in and sat down. The waisress came and he
ordered a Miller Lite. The waitress rehuned with an open Miller Lite bottle
and a glass. She gave the beer to the checker. At no time did the wai�ess
inquire about the age of the checker.
I enzeced and notified the waitress of the violation. The Checker was
alone at the tabie with the beer in froni of him . Tfie waiiress thought the
checker was about 19 years old. She does not work az the restaurant. She
was just filling in for the day to help ihe family. She has never had any liquor
compliance training.
