The basis for the recommendation is as follows: On July 13, 2000, an 18 year old and a 19 year old entered the premises of the Superamerica at 1333 Thomas Avenue as part of a liquor compliance check. The 18-year old female purchased a 12-pack of 1VIiller beer without being asked for identification. It is a violation of Minn. Stat. §340A.503 to sell alcohol to a person under the age of 21. Since this is considered a first violation, the licensing office will recommend a500.00 fine, pursuant to St. Paul Legislative Code §409.26. At this time you have three options on how to proceed: If you do not dispute the above facts and do not wish to have a public hearing, you vill need to pay the recommended fine for this violation. If this is your choice, you should make payment directly to the Office of License, Inspections and Environmental Protection, Room 300 Lowry Professional $uilding, 350 Saint Peter Street, Saint Paul, Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the fine will be considered to be a waiver of the hearing to which you are entitled. Page 2 Speedway Superamerica LLC August 8, 2000 00-f''9 Z. Altematively, if you do not dispute the above facts, but wish to have a public hearing before the Saint Paul City Council, you will need to send me a letter with a statement admitting the violation and requesting a hearing by Friday, August 18, 2000. The matter will then be scheduled before the City Council for a public hearing to determine what penalty, if any, to impose. You will have an opportunity to appear before the Council and make a statement on your own behalf as to the penalty to be imposed. 3. If you do dispute the above facts, a hearing will be scheduled before an Administrative Law Judge. At that hearing both you and the City will be able to appear and present witnesses, evidence, and cross-examine the other's witnesses. The St. Paul City Council will ultimately decide the case. Please let me know in writing no later than Friday, August 18, 2000, how you wish to proceed. If you have not contacted me by Friday, August 18, 2000, I will assume that you are not contesting the facts and will schedule this matter for the St. Paul City Council and have it placed on the Consent Agenda during which no public discussion is allowed and the recommended penalty will be imposed. If you have any questions, feel free to contact me at 266-8710. Sincerely, ` V • -f'ti Virginia D. Reilly) and Squad 791 (Sgt. Ramstad) were conducting liquor compliance checks of licensed liquor establishments in the city of St. Paul. We used two under aged checkers. We verified that both of the checkers were under the age of 21. We used Checker #56 (DOB OS-OS-82) and Checker #53 (DOB 08-29-80). We took all their personal property and gave them buy money. They were uained on how to conduct the checks. They were uained that they could not lie about their age and dates of birth. They had no form of identiFication to show. On this date at 1948 hours the checkers were sent into the Speramerica at 1333 Thomas Ave. The checkers purchased a 12-pack of MGD beer from the clerk who was later identified as JOHNSON, Linda Faye (DOB 03--OS-59, of 612 Chatsworth St. Paul, MN 55104 (H)N/A (V644- 7385). Checker #53 handed the money to JOHNSON. JOHNSON did not ask for an I.D. The checkers were wearing a transmittei and a mictophone and we were able to monitor the transaction as it occurred. The checkers returned with [he purchased beer and pointed out the clerk, JOHNSON, as being the party who had sold the beer to them. Sgt. Ramstad and I went into the store and identified ourselves. We told JOHNSON and the manager, MUNNEKE, Denny Glen (DOB 12-09-46, of 1671 Century CR Woodbury, MN 55125 (H)73S-SOSS (W6"r4-7385) abou[ tne vioiation. We toid JOHNSON and MUNNEKE that a report of the v;olation would be forwazded to LIEP and that possible criminal charges would be forthcoming. JOANSON and the beer were photographed. The beer was retumed to the store and the money was rewvered.
