WHEREAS, the City Council has by resolution passed January
29, 1980 (C.F. No. 274355) appointed outside counsel to repre-
sent certain defendants in the lawsuit brought by Harold Mordh, Sr.
against the City of St. Paul, et al. ; and
WHEREAS, said appointments were made pursuant to City Charter
Section 5.02 providing for such appointments in the case of the
existence of special or unusual circumstances; and
WHEREAS, the City Attorney, after investigation of the various
allegations contained in said lawsuit and after having reached a
settlement in the related lawsuit of Carchedi vs. George Latimer,
et al. , now advises that the special and unusual circumstances giving
rise to the appointment of outside counsel no longer exist; now,
therefore, be it
RESOLVED, that the resolution appointing Theodore J. Collins
, as attorney for St. Paul Police Chief Richard Rowan, Ronald Patrick
Smith as attorney for St. Paul Police Officer David Weida, Patrick
H. 0'Neill as attorney for St. Paul Police Officer John Voita is
hereby rescinded; and, be it
FURTHER RESOLVED, that the attorneys fees provided for in
the resolution appointing the aforementioned outside counsel will
be honored for services rendered prior to the date of this
resolution but not beyond this date.
