The basis for the recommendation is as foliows: By letters dated Apri128, 2000 and May 25, 2000, you rvere informed that your license application could not be approved until you submitted a site plan in accordance with Saint Paul Legislative Code §62.108[5]. You were also notified that you would need to obtain a variance to permit outside storage within 300 feet of residential property, and sent an appiication form. As of today's date, you have neither applied for a variance, nor submitted the necessary site plan. Saint Paul Legislative Code § 310.06(b)(3) permits adverse action against a license which is or would be in violation of "any of the provisions of the Zoning Code, or the premises which are licensed or which are to be licensed do not comply with applicabie health, housing, fire, zoning and building codes and regulations." If you have not contacted me by Thursday, July 27, 2000, I will assume that you are not contesting the recommendation to deny your license application. Zangs - LIEP �� RE: 627 Bush Avenue - Request for adverse action to deny the license applications # 000001332 for a Second Hand Dealer Single Location and Recycling Collection Center. The applicant, Richard Wybierala ( dba Poor Richards), has failed to submit a site pian as required by the Saint Paui Zoning ordinance 62.108(5). Further, the applicant continues to violate Section 60.613(3) pertaining to exterior storage within 300 feet of residentially used property on the south side of Bush Avenue. These violations have existed on the property since August of 1995 and persist to the present. Mr Wybierala has been cited on two occasion previously and been found guilty in both instances. On March 21, 2000, Mr Wybierala app{ied for the licenses referenced above. On April 28, 2000, I wrote a letter to Mr Wybierala advising him of the need to submit a site plan and apply for a variance of the exterior storage setback requirement. Copies of the specific ordinances along with the appropriate zoning applications accompanied the letter. On May 25, 2000, having had no response to the 4128 letter, I sent another letter advising Mr Wybierala of the need for the above information and gave him a deadline of June 7, 2000 to comply. On June 6, 2000, I received a phone call from a Phil Sutherland, stating that he had been contacted that day by Richard Wybierala, to ascertain about the site plan. I explained to Mr. Sutherland the requirements and we discussed the problem of submitting a site plan before the June 7'" deadline. As of the date of this memo, my o�ce has not received the required information from the appiicant, to complete processing of his licensing request. I am therefore requesting this enforcement action. The basis for the recommendation is as foliows: By letters dated Apri128, 2000 and May 25, 2000, you rvere informed that your license application could not be approved until you submitted a site plan in accordance with Saint Paul Legislative Code §62.108[5]. You were also notified that you would need to obtain a variance to permit outside storage within 300 feet of residential property, and sent an appiication form. As of today's date, you have neither applied for a variance, nor submitted the necessary site plan. Saint Paul Legislative Code § 310.06(b)(3) permits adverse action against a license which is or would be in violation of "any of the provisions of the Zoning Code, or the premises which are licensed or which are to be licensed do not comply with applicabie health, housing, fire, zoning and building codes and regulations." Zangs - LIEP �� RE: 627 Bush Avenue - Request for adverse action to deny the license applications # 000001332 for a Second Hand Dealer Single Location and Recycling Collection Center. The applicant, Richard Wybierala ( dba Poor Richards), has failed to submit a site pian as required by the Saint Paui Zoning ordinance 62.108(5). Further, the applicant continues to violate Section 60.613(3) pertaining to exterior storage within 300 feet of residentially used property on the south side of Bush Avenue. These violations have existed on the property since August of 1995 and persist to the present. Mr Wybierala has been cited on two occasion previously and been found guilty in both instances. On March 21, 2000, Mr Wybierala app{ied for the licenses referenced above. On April 28, 2000, I wrote a letter to Mr Wybierala advising him of the need to submit a site plan and apply for a variance of the exterior storage setback requirement. Copies of the specific ordinances along with the appropriate zoning applications accompanied the letter. On May 25, 2000, having had no response to the 4128 letter, I sent another letter advising Mr Wybierala of the need for the above information and gave him a deadline of June 7, 2000 to comply. On June 6, 2000, I received a phone call from a Phil Sutherland, stating that he had been contacted that day by Richard Wybierala, to ascertain about the site plan. I explained to Mr. Sutherland the requirements and we discussed the problem of submitting a site plan before the June 7'" deadline. As of the date of this memo, my o�ce has not received the required information from the appiicant, to complete processing of his licensing request. I am therefore requesting this enforcement action. The applicant, Richard Wybierala ( dba Poor Richards), has failed to submit a site pian as required by the Saint Paui Zoning ordinance 62.108(5). Further, the applicant continues to violate Section 60.613(3) pertaining to exterior storage within 300 feet of residentially used property on the south side of Bush Avenue. These violations have existed on the property since August of 1995 and persist to the present. Mr Wybierala has been cited on two occasion previously and been found guilty in both instances. On March 21, 2000, Mr Wybierala app{ied for the licenses referenced above. On April 28, 2000, I wrote a letter to Mr Wybierala advising him of the need to submit a site plan and apply for a variance of the exterior storage setback requirement. Copies of the specific ordinances along with the appropriate zoning applications accompanied the letter. On May 25, 2000, having had no response to the 4128 letter, I sent another letter advising Mr Wybierala of the need for the above information and gave him a deadline of June 7, 2000 to comply. On June 6, 2000, I received a phone call from a Phil Sutherland, stating that he had been contacted that day by Richard Wybierala, to ascertain about the site plan. I explained to Mr. Sutherland the requirements and we discussed the problem of submitting a site plan before the June 7'" deadline. As of the date of this memo, my o�ce has not received the required information from the appiicant, to complete processing of his licensing request. I am therefore requesting this enforcement action.
