WHEREAS, Dr. John D. Lenzi on September 5, 1979 did petition
the City of Saint Paul for the vacation of certain property owned by
the City described as Lot 9, Block 6, Irvine 's Addition; and
WHEREAS, incident to the filing of the petition, Dr. Lenzi did
tender to the City of Saint Paul the $100.00 fee as required by
Chapter 228.03 of the Saint Paul Legislative Code; and
WHEREAS, inasmuch as vacation procedures were never commenced,
Dr. Lenzi has withdrawn his vacation petition request and has further
requested that the $100.00 fee paid be returned to him.
NOW THEREFORE BE IT RESOLVED, That the appropriate City officials
are hereby authorized and directed to return to Dr. Lenzi the $100.00
fee paid toward his request to vacate the property first mentioned
above.

Subject: Request for return of fYling fee to Dr. John D. Zenzi
The petitioner, Dr. John D. Lenzi, fYled a petition to vacate City-owned
property described as Lot 9, Block 6, Irvine's Addition, and located on
Payne Avenue and Ed.�erton Street. The subject property was and is under
study for the development of Swede Hollow Park by the Department of
Community Services and cannot be released at this time for public sa1e.
Dr. Lenzi was notified of this and by request withdrew his petition to
vacate the subject property. Dr. Lenzi has asked that his filing fee
be returned, amounting to $100.00.
Vacation procedures were never started by this off`i.ce. I therefore
recommend that the request be granted.
