CASE N0. PROPERTY 0_ APPELLANT
I4- 80-H 1907 Marshall. Gregory J. Vannelli
(four units)
SUBTECT: Request waiver of St. Paul Legislative Code , Section 54. 14,
pertaining to light and ventilation, so as to obtain Certificate of Occu-
pancy. Owner has buyer for property , and closing is contingent on furnish-
ing a certificate .
Prior Hearing 5/13/80 : Case continued to June meeting.
APPEARANCE : Greg Vannelli
Alice Bij j ani
PROCEEDINGS: Pr. Vannelli said that light and ventilation requirements
for t e two third floor bedrooms would cost about $800 . He said he had
already spent $6 ,000 to comply with code rec{uirements .
Alice Bijjani distributed a rough sketch of the layout of the third floor ,
noting that in each bedroom the windows supplied only about one-third of
t}ie IiQht and ventilation the code required. She ointed out that one of
the roors had a substantial area of dead space that was partially walled
ofi. Ii= this spa.ce was closed off from the main area, light and ventil.a-
tian :. the remaining area would come much closer to the required scuare
ootage .
BOaRD ACTlON: Mr. Tieso -moved to grant a waiver of lighting and ventila-
ton requirements in one third floor hedroom on condition that a partially-
close off area be completely closed off except for a doorway, and on con-
dition that the remaining bedroom be provided with a window which complies
ith code requirements for light and ventilation. Mr. Glassman seconded
the motion. MOTION CARRIED AND SO ORDERED.

an examination of the permits showed that they specifically prohibited
the addition of these two units . She said these matters would be the
concern of the Zoning Board, however, in determining the number of units
that could legally be operated.
Ms . Bijjani stated that the only problem before this board was the situation
of Apt. #SC, where the shower was located outside of the walls of the
dwelling unit, and was shared with the sleeping room, Apt. #5 West. If
the Zoning Board should order a reduction in the number af units , the
problem would resolve itself, because there would then be sufficient bath
facilities for the remaining units .
BOARD ACTION : Mr. Glassman moved to grant a variance of Section 54. 11, to
permit occup ancy of Apt. #5C where the shower is located outside the walls
of the unit. Mrs . Peake secon de d. 110TION CARRIED AND SO ORDERED.

(8 units - 1 office)
SUBJECT: Request variance of Section 54. 11, pertaining to requirement of
bat— iroYom facilities within walls of dwelling units , to permit shared baths ,
because "apartments were constructed in their present manner in 1964 ," many
years prior to appellant' s purchase in 1979 .
APPEARANCE : Dennis J. Verneke
A1ice Bij j ani
PROCEEDINGS : Ms . Bijjani stated that the appellant' s contention that the
present number of apartments in operation was a situation a.n existence
since 1964 was untrue , so the recent expansion of the buil.ding was a vio-
lation of the zoning code . Expansion occurred in the creation of Apts .
#6 and #7. The city had received a letter from Mr. Werneke ' s father
stating that the aQartments had been put in in 1965 with permits , but

SUBJECT : Request variance of Section 54. 13, pertaining to occupancy of unt
more than 50% below grade , because of economic considerations ,
APPAR10E : Patrick Su1J.ivan
Alice Bij j ani
PROCEEDINS : Mr. Sullivan said he was willing to do whatever was necessary
ta provi e or the safety of occupants in the basement apartment , whether
it might be enlarged escape-type windows in the bedroom or the construction
of a second entrance . However, he was advised that a variane was necessary
because the unit was more than 50o below grade .
Ms . Bijjani asked the board, if it considered granting a variance , to put
conditions on it that would have the effect of correcting any possible
hazard that are not specifically listed in the 1aw, such as in this
situation. , where there is a wall separating the apartment from the heating
plant that should be finished with one hour fire retardant materials .
There should also be a one h.our fire retardant wall between the furnace
area and the pathway leading outside . She -requested that the board be
specific in spelling out the conditions on which a waiver would be granted,
and that they not use any such term as "in a manner acceptable to the
Hiusng Code Office ."
BORD ACTION : Mr. Glassman moved to grant a variance of St . Paul Legis-
lative Code , Section 54. 13, pertaining to basement occupancy , on condition
th at the dwelling unit and the exitway all be senarated from the heating
plant with one hour fire retardant materials , and that ,rindows of sufficient
dimensi.ons to satisfy light and ventilation requirements shall be installed.

SllEJECT : Request waiver of St . Paul Legislative Code , Section 54. I4 ,
peraining to light and ventilation, to permit occupancy of two-bedroom
tnit where one bedroom has no window, because of economic considerations .
'.#TEAR'VCE : Robert G. Bump
Alice Bij j ani -
PRCEEDINGS : Mr. Bump explained that , alhough only one aprtment as
inspecte and found in viol.ation of light and ventilation recuiremer.ts ,
i_n fact , at least one othe-r apartment in the complex had the identical
la;:out, One of the two bedrooms was on an inside wall where there was no
possi.bzlity nf putting in a windtw.
Alice Bi;ja.ni recom,.ndd that the best solution was to open up the l.iving
room area to he inside bedreom adjoining it , and to use it as a combination
ivi.ng roal.t- di.nin rom. This would make the unit a one-bedroom apartment ,
.nstead of wo, but it wot.1. malce a much more desirable place to live. She
me1-tioned the danger of such a lacativn far a beciroom irx case of fire. Such
a .onversi.on would involv extensive work, but the city would be ailling to
grant arlple time to complete the project .
yir. Bump fel it would furt.er limit the number of available low-rent
faml--sized apartrnents in he city, which were in such short supply.
ii. Tieso suggested that i.t might be desirable to have soe tye Gf inechani-
cal Leni.atzcr_ in tha windawless bedroom,
rrs, leake felt this was unnecessary, that the opening lietwen the Iiving
-roam and the bedraom was sufficient to provide adenuate ventilation, since
xie livrng room had two windows .
01.21 ACTION : Mr. Glassman moved that a waiver of Section 54. 14 , pextaining
to light and ventilation, be granted to pexmit occupancy of a i.wo-bedroam
