He said he had already spent $6 ,000 to comply with code rec{uirements . Alice Bijjani distributed a rough sketch of the layout of the third floor , noting that in each bedroom the windows supplied only about one-third of t}ie IiQht and ventilation the code required. She �ointed out that one of the roor�s had a substantial area of dead space that was partially walled ofi. Ii= this spa.ce was closed off from the main area, light and ventil.a- tian :�. the remaining area would come much closer to the required sc�uare �ootage . BOaRD ACTlON: Mr. Tieso -moved to grant a waiver of lighting and ventila- t�on requirements in one third floor hedroom on condition that a partially- close� off area be completely closed off except for a doorway, and on con- dition that the remaining bedroom be provided with a window which complies ��ith code requirements for light and ventilation. She said these matters would be the concern of the Zoning Board, however, in determining the number of units that could legally be operated. Ms . Bijjani stated that the only problem before this board was the situation of Apt. #SC, where the shower was located outside of the walls of the dwelling unit, and was shared with the sleeping room, Apt. #5 West. If the Zoning Board should order a reduction in the number af units , the problem would resolve itself, because there would then be sufficient bath facilities for the remaining units . BOARD ACTION : Mr. Glassman moved to grant a variance of Section 54. 11, to permit occup ancy of Apt. #5C where the shower is located outside the walls of the unit. Mrs . However, he was advised that a varian�e was necessary because the unit was more than 50o below grade . Ms . Bijjani asked the board, if it considered granting a variance , to put conditions on it that would have the effect of correcting any possible hazard� that are not specifically listed in the 1aw, such as in this situation. , where there is a wall separating the apartment from the heating plant that should be finished with one hour fire retardant materials . There should also be a one h.our fire retardant wall between the furnace area and the pathway leading outside . She -requested that the board be specific in spelling out the conditions on which a waiver would be granted, and that they not use any such term as "in a manner acceptable to the Hius�ng Code Office ." BO�RD ACTION : Mr. Glassman moved to grant a variance of St . Paul Legis- lative Code , Section 54. 13, pertaining to basement occupancy , on condition th at the dwelling unit and the exitway �all be senarated from the heating plant with one hour fire retardant materials , and that �,rindows of sufficient dimensi.ons to satisfy light and ventilation requirements shall be installed. l��r.
