WHEREAS, Chapter 293 of the Saint Paul Zegislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and
WHEREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a finding
by the City Council that full compliance with Chapter 293 woulcl
constitute an unreasonable hardship on an applicant, other
persons or on the community; ancl '
WHEREAS, Radio Rey Inc., represented by, Juanita C.
Gonzalez, General Manager, who has been designated as the
responsible person on the application, has applied for a variance
to allow live music at 10 River Park Plaza, on September 16,
2000; and
WHEREAS, applicant is seeking a variance for the hours of
12:00 p.m. to 12:00 a.m. on September 16, 2000; and
WHEREAS, if applicant is not granted a variance it will not
be able to present the live music; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance to Radio Rey, subject to the following
conditions:
1) The variance shall be for the hours of 12:00
p.m. to 12:00 a.m. on September 16, 2000.
2) All electronically powered equipment used in
conjunction with the event shall not exceed
100 dBA from 12:00 p.m. until 12:00 a.m. on
September 16, 2000. Measurement of the sound
level shall be performed at a distance of 100
feet from the sound source, or from the sound
mix, whichever is closer to the sound source.

On July 31, 1999, Radio Rey celebrated its 20�' anniversary with a concert and Fiesta on the
vacant property beriveen Robert and Wabasha and Plato and Fillmore Streets . At your request,
the Saint Paul City Council passed a resolution allowing you to exceed the legal sound limits
during this event. They authorized you to have 100 dBA at the music mix until 12:00 midnight.
The resolution also required that you provide equipment and staff to monitor the sound levels
during the time the music was played.
During the night of the event Steve Roy, from our office, was there to monitor the sound and to
confirm that you were in compliance with the conditions approved by the City Councii. During
the evening the following issues were found to be in violation of the variance request:

1) There was no one on-site who was assigned to monitor the sound levels with a sound
monitor.

one exceprion - the condirion that the organizers meet with LIEP staff on Tuesday,
September 12 at 2:00 p.m. to resolve the issues that resulted from the Juty 31, 1999,
noise variance.
Coleman - What were the issues that arose last year?
Curtis - Read violations listed in the letter
Coleman - What I wonder if we shouldn't add those conditions in addition to the meeting
condition.
Curtis - It was my understanding from Christine Rozek that there were some other issues
and concerns that staff would like to discuss with them. These aze the ones on written
record from last year.
Coleman - I would like to say that we include those things in there as conditions of
granting the variance - that they shall provide someotte to control the board .... you just
outlined those conditions, I'm sure we can get those on the record in addition to the
meeting. Lets spell it out for them in advance.
Dan - Perhaps failure to meet with staff would result in this not being granted.
Coleman - Any of those conditions not being met would cancel the ............
Coleman - If we just translate those into "thou shalls" I thiuk we'll have our condirions.

On July 31, 1999, Radio Rey celebrated its 20�' anniversary with a concert and Fiesta on the
vacant property beriveen Robert and Wabasha and Plato and Fillmore Streets . At your request,
the Saint Paul City Council passed a resolution allowing you to exceed the legal sound limits
during this event. They authorized you to have 100 dBA at the music mix until 12:00 midnight.
The resolution also required that you provide equipment and staff to monitor the sound levels
during the time the music was played.
During the night of the event Steve Roy, from our office, was there to monitor the sound and to
confirm that you were in compliance with the conditions approved by the City Councii. During
the evening the following issues were found to be in violation of the variance request:

1) There was no one on-site who was assigned to monitor the sound levels with a sound
monitor.

2) There was no sound monitoring equipment at the site. ` ,

3) The band that c e here from California provided their own person to control the sound

Roger Curtis - Office of LIEP recommended approval of the sound level variance with
one exceprion - the condirion that the organizers meet with LIEP staff on Tuesday,
September 12 at 2:00 p.m. to resolve the issues that resulted from the Juty 31, 1999,
noise variance.
Coleman - What were the issues that arose last year?
Curtis - Read violations listed in the letter
Coleman - What I wonder if we shouldn't add those conditions in addition to the meeting
condition.
Curtis - It was my understanding from Christine Rozek that there were some other issues
and concerns that staff would like to discuss with them. These aze the ones on written
record from last year.
Coleman - I would like to say that we include those things in there as conditions of
granting the variance - that they shall provide someotte to control the board .... you just
outlined those conditions, I'm sure we can get those on the record in addition to the
meeting. Lets spell it out for them in advance.
Dan - Perhaps failure to meet with staff would result in this not being granted.
Coleman - Any of those conditions not being met would cancel the ............
Coleman - If we just translate those into "thou shalls" I thiuk we'll have our condirions.
Dan - And, no meeting, no permit.
