WHEREAS, the PURCHASER has a need for a specific service; and WHEREAS, the STATE, is empowered to enter into income contracts pursuant to Minnesota Statutes, Chapter 136F; NOW, THEREFORE, it is agreed: I, niJTIES OF STATE. The STATE agrees to provide the following: 1. The Law Enforcement Continuing Education Program of Century College will provide a minimum of 3�� hours of POST approved training for the period September 1, 2000 through June 3Q 2001. 2. Registration for training will be conducted on a first-come, first-served basis with priority give to licensed ofFicers/dispatchers from participating member agencies. The number of enrollments from individual agencies may be limited in some cases in order to accommodate all member agencies fairly. 3. The Training Program will be continually evaluated by means of course evaluations completed at the conclusion of each training session, and program and curriculum evaluations and surveys will be solicited from par:icipating ageacies. Trai.^.eng programs will be offe,red at Century College. 4. Quartedy enrollment reports will be provided to participating member agencies. 5. Courses not covered by thls training agreement include Firearms Qua]iFicatioit and Training Program. Any other course esclLded by this agreement will be so identified in the trair.ing brochure. II, nUTIES OF PURCHASHR. The PURCHASER (participating agency) agrees to the following: 1. Padicipating agencies will publicize the program to officers and promote courses intemally. 2. In order to best meet the specific needs of law enforcement, training officers/dispatchers from participating member Law Enforcement agencies will be invited to scheduled meerings to participate in the review of past and future curriculum and training concerns. Oo $03 III. .,r�ONSIDERATION AND TERMS OF PAYMENT. A. Consideration for all services performed and goods or materials supplied by the STATE pursuant to ttus contract sball be paid by the PURCHASER as follows: Annual cost is $295 per slot for full-rime licensed officersldispatchers with the pucchase of 6 or more slots. Annual cost for 1-5 slou is $325 per slot. St Paul Police Department has made the commitment to purchase ten (10) slots totaling $2950. B. Term of Pa ent. Payment shall be made by the PURCHASER no later than 30 days following receipt of the invoice. The STATE will invoice the participating agency quarterly according to the following schedule: November, 2000 March, 2001 June,2001 N. TERM OF CONTRACT. This conhact shall be effective on Sentember 1, 200 , or upan the date that the final required signature is obtained by the STATE, whichever occurs later, and shall remain in effect until June 30, 2001, or until all obligations set forth in this contract have been satisfactorily fulfilled, whichever occurs first. V. ('ANCELLATION. Century College reserves the right to cancel courses due to lack of enrollment. Departments will NOT receive confianation of registrafion, but will be contacted by phone or by mail if the class is filled or canceled. Notice of regisuarion cancellarion by an officer must be received three working days prior to the start of the course. Agencies or officers who fail to give such notice will be billed and the participating departmenUagency will be billed $10/officer for "NO SHOWS:' VI. ATtTUnRT�FD REPRESENTATIVE5. The PURCHASER'S Authorized Representarive for the purposes of administration of this conTMact is John Narrineton. The STATE'S Authorized Representative for the purposes of administration of this contract is Toan Peterson. Each authorized representative shall have fmal authority for acceptance of services of the other party and shall have responsibility to ensure that all payments due to the other party are paid pursuant to the terms of this contract. VR. ASSIGNMF.NT. Neither the PURCHASER noz the STATE shall assign or transfer any rights or obligations under this contract without the prior written approval of the other pazty. VIIL LiABILITY. The PURCHASER shall indemnify, save, and hold the STATE, its agents and employees ha*mless from any and all claims or causes of action arising from the performance of this contract by the PURCHASER or PURCHASER'S agents or employees. This clause shall not be consuued to bar any legal remedies the PURCHASER may have for the STATE'S failure to fulfill its obligations pursuant to this contract. oo-t03 IX. AM ERICANS WITH DISABI LITIES ACT COMPLIANCE (hereinafter "ADA"l. The PURCHASER is responsible for complying with the Americans with Disabiliries Act, 42 U.S.C. 12101, et. seq. and regulations promulgated pursuant to it. The STATE IS NOT responsible for issues or challenges related to wmpliance with the ADA beyond iu own routine use of facilities, services, or other azeas coveted by the ADA. X. AMENDMENTS. Any amendmenu to this contract shall be in writing and sball be executed by the same parties who executed the original contract or their successors in o�ce. XI. (iOVERNMENT DATA PRACTICES. The PURCHASER agrees to comply with the Minnesota Govemment Data Pracrices Act, Minnesota Statutes Chapter 13, as it applies to all data provided by the STATE in accordance with this contract and as it applies to all data created, collected, received, stored, used, maintained or disseminated by the PURCHASER in accordance with this contract. The civil remedies of Minnesota Statutes Section 13.8, apply to the release of the data referred to in this Article by either the PURCHASER or the STATE. In the event the PURCHASER receives a request to release the data refeaed to in this Article, the PURCHASER must immediately notify the STATE. The STATE will give the PURCHASER instrucrions conceming this release of data to the requesting party before the data is released. XII. niRISDICTION AND VENUE. This contract shall be govemed by the laws of the State of Minnesota. Venue for all legal proceedings azising out of this contract, or the breach thereof, shall be located only in the state or federal court with competent jurisdiction in Ramsey County, Minnesota. XIII. STATE AUDITS. The books, records, documents, and accounting procedures and practices of the PURCHASER relevant to this contract shall be subject to examination by the conuacting department and the Legislative Auditor. WHEREAS, the PURCHASER has a need for a specific service; and WHEREAS, the STATE, is empowered to enter into income contracts pursuant to Minnesota Statutes, Chapter 136F; NOW, THEREFORE, it is agreed: I, niJTIES OF STATE. The STATE agrees to provide the following: 1. The Law Enforcement Continuing Education Program of Century College will provide a minimum of 3�� hours of POST approved training for the period September 1, 2000 through June 3Q 2001. 2. Registration for training will be conducted on a first-come, first-served basis with priority give to licensed ofFicers/dispatchers from participating member agencies. The number of enrollments from individual agencies may be limited in some cases in order to accommodate all member agencies fairly. 3. The Training Program will be continually evaluated by means of course evaluations completed at the conclusion of each training session, and program and curriculum evaluations and surveys will be solicited from par:icipating ageacies. Trai.^.eng programs will be offe,red at Century College. 4. Quartedy enrollment reports will be provided to participating member agencies. 5. Courses not covered by thls training agreement include Firearms Qua]iFicatioit and Training Program. Any other course esclLded by this agreement will be so identified in the trair.ing brochure. II, nUTIES OF PURCHASHR. The PURCHASER (participating agency) agrees to the following: 1. Padicipating agencies will publicize the program to officers and promote courses intemally. 2. In order to best meet the specific needs of law enforcement, training officers/dispatchers from participating member Law Enforcement agencies will be invited to scheduled meerings to participate in the review of past and future curriculum and training concerns. Oo $03 III. .,r�ONSIDERATION AND TERMS OF PAYMENT. A. Consideration for all services performed and goods or materials supplied by the STATE pursuant to ttus contract sball be paid by the PURCHASER as follows: Annual cost is $295 per slot for full-rime licensed officersldispatchers with the pucchase of 6 or more slots. Annual cost for 1-5 slou is $325 per slot. St Paul Police Department has made the commitment to purchase ten (10) slots totaling $2950. B. Term of Pa ent. Payment shall be made by the PURCHASER no later than 30 days following receipt of the invoice. The STATE will invoice the participating agency quarterly according to the following schedule: November, 2000 March, 2001 June,2001 N. TERM OF CONTRACT. This conhact shall be effective on Sentember 1, 200 , or upan the date that the final required signature is obtained by the STATE, whichever occurs later, and shall remain in effect until June 30, 2001, or until all obligations set forth in this contract have been satisfactorily fulfilled, whichever occurs first. V. ('ANCELLATION. Century College reserves the right to cancel courses due to lack of enrollment. Departments will NOT receive confianation of registrafion, but will be contacted by phone or by mail if the class is filled or canceled. Notice of regisuarion cancellarion by an officer must be received three working days prior to the start of the course. Agencies or officers who fail to give such notice will be billed and the participating departmenUagency will be billed $10/officer for "NO SHOWS:' VI. ATtTUnRT�FD REPRESENTATIVE5. The PURCHASER'S Authorized Representarive for the purposes of administration of this conTMact is John Narrineton. The STATE'S Authorized Representative for the purposes of administration of this contract is Toan Peterson. Each authorized representative shall have fmal authority for acceptance of services of the other party and shall have responsibility to ensure that all payments due to the other party are paid pursuant to the terms of this contract. VR. ASSIGNMF.NT. Neither the PURCHASER noz the STATE shall assign or transfer any rights or obligations under this contract without the prior written approval of the other pazty. VIIL LiABILITY. The PURCHASER shall indemnify, save, and hold the STATE, its agents and employees ha*mless from any and all claims or causes of action arising from the performance of this contract by the PURCHASER or PURCHASER'S agents or employees. This clause shall not be consuued to bar any legal remedies the PURCHASER may have for the STATE'S failure to fulfill its obligations pursuant to this contract. oo-t03 IX. AM ERICANS WITH DISABI LITIES ACT COMPLIANCE (hereinafter "ADA"l. The PURCHASER is responsible for complying with the Americans with Disabiliries Act, 42 U.S.C. 12101, et. seq. and regulations promulgated pursuant to it. The STATE IS NOT responsible for issues or challenges related to wmpliance with the ADA beyond iu own routine use of facilities, services, or other azeas coveted by the ADA. X. AMENDMENTS. Any amendmenu to this contract shall be in writing and sball be executed by the same parties who executed the original contract or their successors in o�ce. XI. (iOVERNMENT DATA PRACTICES. The PURCHASER agrees to comply with the Minnesota Govemment Data Pracrices Act, Minnesota Statutes Chapter 13, as it applies to all data provided by the STATE in accordance with this contract and as it applies to all data created, collected, received, stored, used, maintained or disseminated by the PURCHASER in accordance with this contract. The civil remedies of Minnesota Statutes Section 13.8, apply to the release of the data referred to in this Article by either the PURCHASER or the STATE. In the event the PURCHASER receives a request to release the data refeaed to in this Article, the PURCHASER must immediately notify the STATE. The STATE will give the PURCHASER instrucrions conceming this release of data to the requesting party before the data is released. XII. niRISDICTION AND VENUE. This contract shall be govemed by the laws of the State of Minnesota. Venue for all legal proceedings azising out of this contract, or the breach thereof, shall be located only in the state or federal court with competent jurisdiction in Ramsey County, Minnesota. XIII. STATE AUDITS. The books, records, documents, and accounting procedures and practices of the PURCHASER relevant to this contract shall be subject to examination by the conuacting department and the Legislative Auditor.
