00-798Council File # �O � �qQ� OR#G1NAL Presented By Referred To Green Sheet # 10267$ Committee: Date t WHEREAS, Public Worfcs has proposed a sanitary sewer in the Odgen J Winthrop area of South Fiighwood; and 2 3 WHEREAS, approximately 1200 feet of the proposed sanitary sewer is to be cronstructed in a wooded area adjacent to the Odgen 4 Ravine; and 5 6 WHEREAS, Pubiic Works has completed a discretionary Environmental Assessment Worksheet (EAW) relating to said construction 7 and in accordance with the Minnesota Rules, Section 4410.1000; and 8 9 WHEREAS, said EAW was noticed for public comment on May 29, 2000 in the EQB Monitor; and 10 11 WHEREAS, Public Works prepared a Comment and Response document to the EAW dated, July 20,2000; and 12 13 WHEREAS, Public Works Sewer Utility has a copy of the EAW's and the Comment and Response document on file tor review; and 14 15 16 17 18 19 20 27 22 23 24 25 26 27 28 WHEREAS, Public Works, in accordance with Minnesota Rules, Section 4410.1700, subpart 7, has considered the following factors in its decision: A. The Type of environmental affects (tree Ioss, erosion and sedimeMaiion potential) and ihe extent oi these environmeMal aflecis (along the 1200 foot corridor) are reversible. B. There are no anticipated or future projects with cumulative affects. C. The environmenial aHects will be mitigated by the Ciry's ongoing construction policies and requirements. D. The environmental affects we2 anticipated and controlled by the Comprehensive Management Plan - Mississippi National River and Recreation Area and the City's Chapter 65, Zoning Code - River Corridor; and NOW, THEREFORE, BE IT RESOLVED that the Ciry of Saint Paul (acting as the responsible government unit under Minnesota Rules, 4410.0500) based upon an analysis and thorough review of the EAW intormation, comments and responses to comments; recommends a negative declaration on the need for an EIS on the proposed Ogden / Winthrop Sanitary Sewer Project.
