Sturm PROCEEDINGS : Mr. Sturm explained that Apts. #5 and #6 each h.ad private toilets and handsinks , but tenants of these two units shared use of a shower room located off the common hallway. In regard to escape windows and light and ventilation, he said it would be quite expensive to put in larger windows in the two basement apartments , and it would require con- struction of windowwells outside each of them. He then recalled thati there were unused openings on another wall of each unit, used as coal chutes in the original construction when there were no basement apartments , which might be used to place escape windows . Alice Bijjani said this appeared to be a good solution , that it would not only provide the needed escape windows , but would also add light and venti- lation. She suggested, however, that if for some reason the coal chute openings were not feasible, and if the existing window openings had to be used, it would be necessary to include a variance on sill height because of the difficulty of complying with the 48-inch specification. She proposed that a step under each escape window be provided no more than 48 inches from the sill height. Mr. Gausman asked about the fire separation of the boiler area from the dwelling units in the basement. Mr. Sturm said he proposed to install a sprinkler system above the boiler as an alternative to shee�rock, which would interfere with the boiler. , � -3- 9/8/81 - Meeting No. I77 � �,`�'�"`��.�1 .:. , Alice Bijjani said a sprinkler system was an acceptable alternative, but it �,rould be necessary to get permission from the city Water Dept. Chairman Glassman read a letter from Merriam Park Community Council , in which they requested the board to postpone the hearing on this case until after the September 14 meeting of their Housing Committee. Mr. Knutson said he personally did not feel the board should have to wait for a community organization to meet before hearing an appeal. If the community organization had a strong interest , they should call a special meeting prior to the date when an appeal was scheduled to be heard by the Board of Appeals. The other board members concurred. BOARD ACTION: Mr. Knutson moved to grant a variance of Section 34. 11 , to permit tenants of Apts . #5 and #6 to share use of one shower facility, on condition that no more than one person occupy each dwelling unit. Also, Mr. Knutson moved to deny a variance of Section 34. 13 , pertaining to escape windows in sleeping rooms , except that, if the required window is more than 48 inches from the floor, a variance be granted on the sill height, provided that a permanent step be installed under each escape window � to compensate for the discrepancy. APPEARANCE : Oscar Valar Pierre Regnier, Attorney at Law FROCEEDINGS : Mr. Regnier reviewed a board decision made in March, 1977 , on an appeal filed by Mr. Valar, whereby a variance had been granted for tenants of five second floor units in this same building to share use of tztio bathroom facilities. Since that time , Mr. Valar had put into operation four dwelling units on the third floor. One of these units had its own private bathroom, but the remaining three shared a bathroom facility. The ot�ner was willing to accept the same restrietions placed on _the 1977 variance for the dwelling units on the third floor if the board decided in his favor, the conditions being that no more than one person occupy each of the units sharing a bathroom, and that the variance be in effect as long as Mr. Va1ar lived in the building. Mr. Regnier told the board that D4r. Valar' s daughter cleaned the shared bathroom daily, and the entire building was kept in excellent condition. T e appeal involves four basement apartments where the windows in each of the sleeping rooms are larger than required for use as escape windows , but the sill heights are several inches higher than the 48 inches required by code. Mr. Glassman suggested putting in a permanent step up toward �each of the sleeping room windows in the basement units , high enough so that the sills would be no more than 48 inches above the step level.
