Subject: petition of Thoma.s S. Hanten for the vacation of
Southeasterly 80 feet of alley in Block �+, Merriam
park 5th Addition.
Public Hearing - September l, 1981
The petitioner, Thoma.s Hanten, requests this alley vacated for the follaw-
ing reasons :
a) To eliminate excess alley traffic.
b) To facilitate the deepening of certain
St. Anthor�y frontage lots.
c) To �ive privacy to the back yards of the
St. Anthon�y frontage lots and to increase
green area for said lots.
The petitioner will dedicate and improve a 20 foot by 80 foot area, (1,600
square feet) for alley purposes. The area to be vacated is approximately 75
feet long by 16 reet (1,200 square feet) and is zoned R-�+.
The Department of Public Works has no objections to the proposed vacation,
subject to the deeding and improvement of the proposed new alley outlet, all
to be accomplished by January l, 1983.
The Northern States Power Compa.r�y reports having equipment (1 pole) in the
proposed vacation area. They request that their interest be protected.
Northwestern Bell Telephone Compar�y has an aerial cable on a joint use,
power-telephone in the proposed vacation area and they request that their
interest be protected.
The Department of Planning and Economic Development has reviewed this va.-
cation and finds no objection to the vacation as proposed.
There were no other objections or recommenda.tions from ar�y other public or
private agencies involved.
In view of the foregoing, I recommend that the vacation be approved, subject
to the foliawing terms and conditions:

That part of alley in Block 4, Merriam pa,rk
Fifth Addition to the city of Saint Paul,
Minnesota lying Southeasterly of the extended
Northwester]y li.ne of Lot 2, Block �+ of said
Addition.
► .2". Tha.t the vacation be subject to all the terms and
conditions of Chapter 130, codified March l, 1981 of
the St, Pa.ul Legislative Code, including the retention
of all public utilities easements.
��: Tha.t an easement be retained to protect the interest
of Northern States Power ComparlY.
��: That an easement be retained to protect the interest
of Northwestern Bell Telephone Comgaqy.
�(s1: Tha.t the petitioners will deed a new alley outlet with
access to Pillshury Avenue in accordance with the
follawing conditions :
a) That the new alley must be dedicated in a
manner and form approved by the City Attorney
and constructed to the satisfaction of the
Depa.rtment of Public Works.
b) Tha.t the description of the new alley be de-
scribed as follows, to wit:

Minnesota; beginning at a point on the
south lot line 4j.87 feet west of the
southeast corner thereof; thence running

39•05 feet; thence 3eflecting to the left
on a line N 49° 33' 48" W for 26.23 feet;
thence southerly parallel with west lot
line for 56.Og feet; thence easterly on
south �ot line for 20 feet and there
terminating.
c) Tha.t the new a11ey section must be constructed
and deeded prior to the barric�:ding off and
obliteration of the e�isting alley, all to be
accomp�ished before January l, 1983.
d) That the netitioners must be responsible for

the pe�itioner w���� be dedicating and improving more
land than he is getting by this v��.cation.
(��'. That the petitioner furnish the City with a bond in
the amount of �2,000.00, and in addition thereto, by
acceptance oi the terms and conditions of this v�cation,
agrees to indemnif„ defend and save harmless the City
of Saint Faul, its officers and employees from all suits,
actions, or claims of ar�y character, including, but not
limited to, a claim brought because of any injuries, or
dama,ges received or sustained by at� person, pe��sons or
property, on account of this vacation; or because of
ar�,r act or omission, negiect o: misconduct of said
petitioner; or because of ar�r ciaim or liability arising
irom or based on �.rLy violation of arLy law or regulation
made in accordance with the lasa, whether by the petitioner

I flirther recommend that the proper City officials be authorized to accept
