An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes �462.357 and �64.210
of the Legislative Code, the Housing and Redevelopment Authority
duly petitioned to rezone Lots 5 and 6, Block 35, Rice and Irvine' s
Addition, located on the Northeast corner of Walnut and Irvine Park
at 50 and 54 Irvine Park, from RM-3 to RT-2 to allow development
compatible with the historic character of Irvine Park, the petition
having been certified by the Department of Finance and Management
Services on April 30, 1981 as having been consented to by at least
67� of the owners of the area of the property to be rezoned, and
further having been consented to by at least two-thirds of the
owners of the property situated within 100 feet of the total
contiguous descriptions of real estate held by the same owner or
any party purchasing any such contiguous property within one year
preceding the date of the petition; and
WHEREAS, The current Zoning Committee on June 18, 1981
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107.03 of the Admini-
strative Code, submitted its recommendation to the Planning Com-
mission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on July 10, 1981 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

WHEREAS, A public hearing before the City Council, having been
conducted on August 20, 1981 where all interested persons were
heard, and the Council having considered all the facts and recom-
mendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 29,
as incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on the Northeast corner of Walnut
and Irvine Park at 50 and 54 Irvine Park, being more
particularly described as Lots 5 and 6, Block 35,
Rice and Irvine' s Addition, be and is hereby rezoned
from RM-3 to RT-2.
Section 2 .
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Sir:
This letter is written in response to the petition of the Housing and Redevelopment
Authority to rezone property at 50 and 54 Irvine Park (NE corner Walnut and Irvine
Park) to allow rehabilitation of a structure on one of the lots and new construction
of a 2 or 3 unit structure on the other 1ot.
On June 18, 1981 , the Zoning Committee conducted a public hearing on the case.
One letter was received in opposition, stating a preference for single family
or duplex development on the site. The case was laid over to the next meeting
because a representative of the HRA failed to appear. The case was reeonsidered
on July 9, 1981 . At that time, the Zoning Committee voted 6-0 to recommend
approval of the rezoning.
The Planning Commission considered the Zoning Committee's recommendation on
July 10, 1981 and voted 17-0 to approve the rezoning.
The matter of the requested rezoning is scheduled to 6e heard by the City Council
on August 20, 1981 . Please notify me 6y August 19 if any mem6er of the City Council
wishes to have slides of the site presented at the City Council public hearing.

Ms. Daykin showed slides of the site and reviewed the staff report with a recomnendation
for approval .
One letter was received in opposition, stating a. preference for si.ngle family or duplex

John Wenker, Housing Division of PED gave testimony in support of this rezoning
request. � � -
Hearing no further testimony, Mr. Bryan closed the pub1ic hearing portion of the
meeting. _ .
Mr. Levy made a motion to approve the request for rezoning based on findings 4
throagh 7 of the staff repor�� t�1r� Ftanggi seconded ti�e motion. The motion for
approval was passed with a ro11 call vote of 6 to 0. �
