An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes �462.357 and �64.210
of the Legislative Code, Robert Hoffman and David Curry duly
petitioned to rezone Lots 1 and 2, Block 2, Palace Addition,
located on the Southwest corner of Ashland Avenue and Grotto
Street at 744 Ashland from RT-1 to RM-3 to allow conversion of
the former building to 18 condominium units, the petition having
been certified by the Department of Finance and Management Services
on April 8, 1981 as having been consented to by at least 67� of
the owners of the area of the property to be rezoned, and further
having been consented to by at least two-thirds of the owners of
the property situated within 100 feet of the total contiguous
descriptions of real estate held by the same owner or any party
purchasing any such contiguous property within one year preceding
the date of the petition; and
WHEREAS, The current Zoning Committee on July 9, 1981
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107 .03 of the Admini-
strative Code, submitted its recommendation to the Planning
Commission; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on July 10, 1981 and recammended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

WHEREAS, A public hearing before the City Council, having been
conducted on August 20, 1981 where all interested persons were
heard, and the Council having considered all the facts and
recommendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the zoning map of the City of Saint Paul, Sheet No. 20,
as incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on the Southwest corner of
Ashland Avenue and Grotto Street at 744 Ashland,
being more particularly described as Lots 1 and
2, Block 2, Palace Addition, be and is hereby
rezoned from RT-1 to RM-3.
Section 2 .
This ordinance shall take effect and be in force thirty (30)

Dear Sir:
This letter is written in response to the petition of Robert Hoffman and
David Curry to rezone property at 744 Ashland (Southwest corner of Ashland
and Grotto) from RT-1 (one and two family residential ) to RM-3 (high-rise,
multi-family residential ) to allow conversion of the former Beth Israel
Synagogue to 18 condominiums.
On May 21 , 1981 , the Zoning Committee conducted a public hearing on the case,
at which time the applicant indicated that an RM-2 zoning would be acceptable.
One letter was received in support of the rezoning. Testimony at the hearing
included a neighbor at 770 Holly concerned about the density of the project,
and a representative of the United Way, which owns the Performing Arts Center
across the alley, who wanted the case laid over to allow him to market the
Performing Arts Center units. On a vote of 4-0, the Zoning Committee voted
to lay the case over to allow the Board of Zoning Appeals to act on the
variance.
On June 23, 1981 , the Board of Zoning Appeals voted 5-0 to approve the density
variance.
On July 9, 1981 , the Zoning Committee reconsidered the rezoning request and
recommended denial of the RM-3 rezoning 6ut approval of the rezoning to RM-2.
The Planning Commission considered the Zoning Committee's recommendation on
July 10, 1981 , and voted 17-0 to approve the rezoning to RM-2.
The matter of the requested rezoning is scheduled to be heard by City Council
on August 20, 1981 . Please notify me by August 19 if any member of the City
Council wishes to have slides of the site presented at the City Council public
hearing.

on findings 1 and 8 of the staff report; and then recorr�nended approval to rezor�e

The appellant was present. There was no opposition present at the hearing.
P1s. Daykin showed slides of the site and reviewed her staff report with a
recomnendation for approval contingent on rezoning the parcel to RM-2.
P�o correspondence was received on this matter.
Robert Hoffman, also representing David Curry, owners of the building at
74� Ashland, stated that they concur with the staff findings as far as the
density. The building has been vacant for a great number of years and is
beginning to deteriorate fast. They feel their proposal will be a very
positive project for the area arid have met with no opposition.� He then
presented drawings of what the building will look like on completion of the
praject.
David Curry submitted a petition with 32 signatures of residents in the area
in support of the project. _ �

recommendation for denial of the rezoning to RM-3 based on findings 1 and 8,
and based on findings 4, 5, 6, 7 and 9, staff recommends approval of the rezoning
to RM-2. There was 1 letter received in support of the rezoning. There was no
correspondence received in opposition.
Ms. Lane called to attention a correction to the staff findings noting
finding #2 should read: "The proposed� conversion of the vacant Beth Israel Synagogue
would� create . . ." , rather than "The proposed conversion of the vacant Performing
Arts Center would create . . ." .
Robert A. Hoffman, 3401 G�rard Avenue N. , Minneapolis, representing David Curry and
himself who are co-owners of the Beth Israel Synagogue, stated that the building was
originally built in approximately 1900, and has been vacant for approximately 10
years. He feels that their proposal would be a positive addition to the neighborhood
and would be providing 18 family units with no parking problem because underground .
parking will be provided. He said that he and Mr. Curry are in favor of the staff's
recommendations.
Larry Mazzitello, 770 Holly, expressed his concerns about density in the neighborhood.
He pointed out there is presently a parking problem and the Performing Arts Center
will have the ability to meet the 12 number of parking spaces per unit. He
. continued to say that this project, with the proposed construction of an underground
parking facility, won't meet the 12 parking spaces per unit requirement. This has
him very worried. He would like to see the Performing Arts Center marketed
successfully before he can be convinced that this will be a good project for the
neighborhood.

Ken Mahal , 6100 Green Valley Drive, Bloomington, spoke representing owners of
741 Holly, The United Way. He requested a 30 day delay because the sale of the
Performing Arts Center has not yet been finalized. He and his client feel that
since the Performing Arts Center was first that the rezoning of 744 Ashland
should be delayed until the Perfarming Arts Center's sale is resolved.
Robert A Hoffman, 3401 Girard Avenue N. , Minneapolis, responded with a comment
that he and Mr. Curry have o�uned the property, 744 Ashland, for over 2 years, and
have been working on this project since that time. Mr. Hoffman expressed concern
that they are being put in jeopardy, contingent to the sale of the Performing
Arts Center. He feels that they should not be held responsible for whether their
deal goes through or not. He also explained that the financing is not a problem.
He said that they own the building and that there are no purchase agreements on
the building or any contingents on McKnight funds. He stated that they intend to
get the financing and that they are committed to the project. Mr. Hoffman also
responded to the matter of density, he pointed out that many homes have been moved
aut of the area for the park and made a reference to the staff's report on that
issue. '
Hearing no further testimony, Mr. Bryan closed the public hearing portion of the
meeting.
Ms. Summers asked if District 8 had taken a position on the rezoning.
Ms. Daykin informed the committee that District 8 did not choose to submit a letter.
She explained that District 8 had voted in March to deny since they didn't know
if it would be used as rental or owner-occupied.
Mr. Pangal expressed his concern as also stated by Mr. Mazziteilo in reference
to the very limited parking situation. He stated that he wo�ld like to see the
matter go first to the Board of Zoning Appeals to see if they would grant the
variance.
Mr. Pangal made a motion recommending the case be laid over until the first meeting
in July to allow the Board of Zoning Appeals to act on variance request. Mr.
Armstead seconded the motion. �he motion passed on a role call vote of 4 to 0.

Gentlemen:
In response to the suggested zoning variance I support
any changes effecting a more constructive use of this
building. Currently the building is vacant and has become a
playground for neighborhood children. 'I'his use is both
detrimental to the structure and the children. Also, I
expect an eighteen unit condominium will generate more tax
revenue than a vacant building.
The enclosed photographs evince the decay taking place.
The building is being demolished brick by brick. The loose
brick.s rzther unfortunately have beconme the toys of
vandals . One bricic unfortunately finding its way through
the back window of my car. The building has become a mess
approaching nuisance and it needs to be cleaned up.
A renovated multi-family dwelling would be an asset to
the community bringing in people who want to live close to
their employement in an established community.
Distilled to its simplest form, I supp_ort conversion to
a multi-family unit. I am, however, concerned with two
minor points; first provisions for parking the approximately _
twenty-five cars that come with conversion.- Secondly, �
snould the variance be granted, when will the conversion
begin. I want the mess of loose bricks and debris cleaned
up prompt ly.
