An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes �462.357 and §64.210
of the Legislative Code, Peter and Sadie Latuff duly petitioned to
rezone Lots 12 and 14, Block 7, Sweeney' s Addition, located on the
Northwest corner of Annapolis and Charlton at 253 W. Annapolis from
R-4 to RT-2 to allow the structure to continue to be used as a
three-plex, the petition having been certified by the Department
of Fi�ance and Management Sereices on June 2, 1981 as having been
consented to by at least 67� of the owners of the area of the
property to be rezoned, and further having been consented to by
at least two-thirds of the owners of the property situated within
100 feet of the total contiguous descriptions of real estate held
by the same owner or any party purchasing any such contiguous
property within one year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on July 16, 1981
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107.03 of the Admini-
strative Code, submitted its recommendation to the Planning Com-
mission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on July 24, 1981 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

Dear Sir:
This letter is written in response to the petition of Peter and Sadie Latuff
to rezone property at 253 W. Annapolis (northwest corner Annapolis and
Charlton) from R-4 (single-family residential ) to RT-2 (three and four family
residential ) to allow the structure to continue to 6e used as three-plex.
On July 16, 1981 , the Zoning Committee conducted a public hearing on the
case. A neighbor at 261 Annapolis testified in support of the rezoning. On
a vote of 5-0, the Zoning Committee recommended approval of the rezoning.
The Planning Commission considered the Zoning Committee's recommendation on
July 24, 1981 , and voted 14-0 to approve the rezoning.
The matter of the requested rezoning is scheduled to be heard by the City
Council on August 20, 1981 . Please notify me by August 19 if any member
of the City Council wishes to have slides of the site presented at the City
Council public hearing.

B. SUFFICIENCY: The petition was declared sufficient by the Finance Department on June 2,
98 . .Eig t parcels were eligible to sign the petition; 6 parcels were needed; and
6 parcels were obtained.
C, SITE & AREA CONDITIONS: The site consists of two lots with a square footage of approx-
imately 14,200 sq. ft. The site is occupied by a 12 story house with a foundation size
of 1 ,552 sq. ft. The site is located on the edge of the city limits bordering West
St. Paul , North of the site is primarily single-family residential . South of the site
is mixed single-family and multi-family with 2 commercial uses on the corners of
Dodd Road and Annapolis, Both Dodd Road and Annapolis Street are classified as collector
streets,
D, FINDINGS;
�.
1 . The si.te was zoned "A" residence from 1922 unitl it was designated R-4 in 1975.
2. According to Building Department records, the structure was built by the applicant
in 1949 as a single-family house. A second unit was added in 1950, apparently without
a building permit. A third unit was in place by 1964, also built without a building
� � permit.
3. The applicant's lot size of 14,200 sq. ft. is sufficient to meet the lot area require-
ment and to accommodate the room count of 6 rooms.
4. The Land Use Plan (p.23) states that conversion of single-family homes to 2 or 3
units can create additional housing units without consuming additional resources.
Policy 4.1-5 (p.24) states that the city will establish criteria to allow sensitive.
reuse and conversion of existing housing structures. The site appears to have
sufficient lot area, and off-street parking to allow the conversion to 3 units.
5. The structure contains 3 rental units. The Housing Plan (p.9, Objective 2(B)
encourages the preservation of existing rental housing in the city's housing stock.
6. The site is located on the fringe of a single-family zone at a busy intersection.
The rezoning would be compatible with the prevailing mix of various residential uses
and commercial uses and would not create disharmony between land uses.
7. Based on the above 3 findings, the rezoning is found to be in conformance with the
Comprehensive Plan.
� E. STAFF RECOMMENDATION: Based on findings 4, 5, 6, and 7 , staff recommends approval of
the rezoning to -2.
