An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes �462.357 and �64.210
of the Legislative Code, Burnie Battle, Sr. duly petitioned to
rezone Lots 1 and 2, Block 10, Butterfield Syndicate Addition
No. 1, located on the Southwest corner of FuTi���and Dale at 624
Fuller, from RM-1 to B-2 for an electrical contractor's office,
the petition having been certified by the Department of Finance
and Management Services on June l, 1981 as having been consented
to by at least 67% of the owners of the area of the property to be
rezoned, and further having been consented to by at least two-
thirds of the owners of the property situated within 100 feet of
the total contiguous descriptions of real estate held by the same
owner or any party purchasing any such contiguous property within
one year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on July 9, 1981 conducted
a public hearing for the purpose of considering the rezoning petition,
and pursuant to Section 107 .03 of the Administrative Code, submitted
its recommendation to the Planning Commission that the petition be
granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on July 10, 1981 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Cauncil
an the said rezoning petition was duly published in the official

WHEREAS, A public hearing before the City Council, having been
conducted on August 20, 1981 where all interested persons were
heard, and the Council having considered all the facts and recom-
mendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the zoning map of the City of Saint Paul, Sheet No. 20,
as incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on the Southwest corner of
Fuller and Dale at 624 Fuller, being more particu-
larly described as Lots 1 and 2, Block 10, Butter-
field Syndicate Addition No. l, be and is hereby
rezoned from RM-1 to B-2.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Sir:
This letter is written in response to the petition of Burnie Battle to rezone
property at 624 Fuller (SW corner Fuller and Dale) from RM-1 (multi-family
residential ) to B-2 (corr�nunity business) for an electrical contractor's office.
On July 9, 1981 , the Zoning Committee conducted a public hearing on this case.
No correspondence was received. One person testified, neither in opposition
nor support. The Zoning Committee voted 6-0 to recommend approval of the
rezoning.
The Planning Commission considered the Zoning Corr�nittee's recommendation on
July 10, 1981 and voted 16-0 to approve the rezoning.
The matter of the requested rezoning is scheduled to be heard by the City
Council on August 20, 1981 . Please notify me by August 19 if any member of
the City Council wishes to have slides of the site presented at the City
Council public hearing.

A. PURPOSE: Rezone from RM-1 to B-2 for an electrical contractor's office.
B. SUFFICIENCY: The petition was declared sufficient on June 1 , 1981 , by the Finance
Department and was received in th�e Planning Office on June 10. Fourteen parcels were
eligible to sign the petition; 10 parcels were needed; and 10 parcels were obtained.
C. FRONTAGE & AREA: The parcel has a frontage of 79.60' on Fuller and a frontage of
120.78 on Dale for an area of 9,614 sq. ft.
D. SITE & AREA CONDITIONS: The site is occupied by a 2-story brick structure set close
to the lot lines. Surrounding land uses include Uni-Dale Mall to the northeast, the
University Avenue commercial strip to the north, one and two family residential to
the south, and Central Village housing to the southeast.
E. ZONING HISTORY: On April 13, 1981 , the petitioner applied for a change of nonconforming
use from a church and 1 apartment unit to an electrical contractor's office. The
Zoning Committee determined that since a church is a permitted �se in an RM-1 district,
the structure did not have nonconforming status and� the applicant therefore had no
grounds for a change of nonconforming use. The Zoning Committee voted 5 to 0 to
recommend denial of the request. On May 8, 1981 , the Planning Commission voted 16 to 0
to deny the change of nonconforming use.
F. FINDINGS:
l . The parcel was zoned commercial from 1922 until it was rezoned RM-1 under the 1975 �
Zoning Ordinance.
2. The Land Use Plan designates the Dale/Univeristy area as a mixed use strip. The
Plan states that "Intensifying existing retail uses , encouraginq new business
uses and providing opportunities for housing can help to provide a healthy �mage
for all of St. Paul 's commercial strips ." (p.26)
3. The rezoning is compatible with surrounding land uses �& -wi11 not cr.eate..�isharmony
between land uses. Uni-Dale Mall , which is kitty-corner from the site, is zoned
B-3. .
4. The Economic Development Strategy of the Comprehensive Plan states that " . . .the
' City shall consider the feasibility of rezoning residential land that would be
more suitable for commercial or industrial purposes." (p.13) The location of
the site and the existence of a commercial structure on the site make it
appropriate for cor�nercial use.
G. STAFF RECOMMENDATION: Based on findings 2, 3, and 4, staff recommends approval of
the rezoning to B-2.

The applicant was present. There was no opposition present at the hearing.
Ms. Daykin showed slides of the site and reviewed the staff report recorrIInending
approval. of the rezoning request.
Burnie Battle of 624 Fuller gave testimony stating he wishes to move his business
to a more commercial area and he intends to build a new garage for his equipment.
Tiger Jack gave testimony neither in favor nor support of the project.
Hearing no further testimon�, Mr. Bryan closed the public hearing portion of
the meeting.
P1r. Hanggi made a motion to recommend approYal of the rezoning request based on findings
2 through 4 of the staff report. Mr. t�evy seconded the motion. The motion for
approval was passed with a roll call vote of 6 to 0:.
