RESOLVED, tha.t upon execution and delivery of a release
in full to the City of Saint Paul, the proper City officers
are hereby authorized and directed to pay out of the Tort
Liability Fund 09070-511-000 to Kenneth Sinn and Irene Sinn
the sum of $52,500.00 in full settlement of their claim for
dama.ges sustained August 21, 1979, as a result of an accident
with a City vehicle at or near White Bear Avenue and East Third
Street in Saint Paul.

RE: Kenneth Sinn and Irene Sinn vs . Metropolitan
Transit Commission, City of St. Paul and
Robert Koutz
This case was tried at Stillwater, Minnesota, Ma.rch 4, 5, and
6, 1981, on the issues between the MTC, the plaintiff and the
City of St. Paul arising out of an accident between a garbage �
truck and an MTC bus on August 21, 1979 .
The jury found that the sole cause of the accident was the
negligence of the driver employed by the City of St. Paul .
The value of the plaintiff's case had been fixed by agreement
at $52,500. MTC proved damages of $21, 781 .15.
This office recommends that this judgment be paid.
