An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining
to zoning for the City of Saint Paul and
the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, �462 .357 and �64.210
of the Legislative Code, St. John Evangelical Lutheran Church duly
petitioned to rezone the South 1/2 of vacated alley adjacent and
Lots 1 and 2, Block 1, Schurmeier's 7th Street Addition; and,
except the East 15 feet and except the South 71 feet, all of Lot 3,
and, except the South 71 feet of the East 35 feet, all of Lot 4,
Block 2, Officer's Rearrangement, located near the bluff leading
down from Margaret Street to Minnehaha, from RM-2 to B-3 for the
purpose of using the property as a development site with other
adjacent property presently zoned B-3, the petition having been
certified by the Department of Finance and Management Services on
December 16, 1980 as having been consented to by at least 67� of
the owners of the area of the property to be rezoned, and further
having been consented to by at least two-thirds of the owners of the
property situated within 100 feet of the total contiguous descrip-
tions of real estate held by the same owner or any party purchasing
any such contiguous property within one year preceding the date of
the petition; and
WHEREAS, The current Planning Committee on February 2, 1981
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107 .03 of the Admini-
strative Code, submitted its recommendation to the Planning Commission
that tl�e petition be granted; and
W�-IE�REAS, The Planning Commission considered the rezoning petition
at its meeting held on February 13, 1981 and recommended that the
City Council approve the petition; and

WHEREAS, Notice of a public hearing before the City Council on
the said rezoning petition was duly published in the official news-
paper of the City on March 7, 1981 and notices were duly mailed to
each owner of affected property and property situated wholly or
partly within 350 feet of the property sought to be rezoned; and
WHEREAS, A public hearing before the City Council, having been
conducted on March 24, 1981, where all interested persons were heard,
and the Council having considered all the facts and recommendations
concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 14, as
incorporated by reference in Section 60 .401 of the Saint Paul Legis-
lative Code, as amended, is hereby further amended as f�llows:
That property located near the bluff leading down from
Margaret Street to Minnehaha, being more particularly
described as the South 1/2 of vacated alley adjacent
and Lots 1 and 2, Block l, Schurmeier 's 7th Street
Addition; and, except the East 15 feet and except the
South 71 feet, all of Lot 3, and, except the South 71
feet of the East 35 feet, all of Lot 4, Block 2,
Officer's Rearrangement, be and is hereby rezoned
from RM-2 to B-3 .
Section 2 .
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Madam:
This letter is written in response to the petition of St. John Evangelical
Church to rezone property along the vacated right-of-way of Beech Street,
west of Arcade street, from RM-2 to B-3.
The petition was filed on P�ovember 25, 1980, found sufficient on
December 16, 1980, and received by the Planning Department on January 2, 1981 .
The Zoning Committee of the Planning Commission held a public hearing on
February 2, 1981 ; one person spoke, not so much in opposition as incredulity
that anyone would wish to start a business on E. Seventh. Staff reported
that the rezoning was to allow development of a now vacant property along
P1innehaha and Arcade for commercial use as a grocery market with other store
space as well . I recommended approval of the rezoning. The Zoning Committee
voted 3 to 0 to also recommend approval .
At their February 13, 1981 , meeting, the Planning Commission considered the
Committee's recommendation and voted 14 to 0 to recommend approval of the
rezoning.
The matter is scheduled to be heard by the City Council on March 24, 1981

A. SUFFICIENCY: The application was filed on November 25, 1980, by consent petition,
subscribed and sworn to on June 22, 1980, declared sufficient on December 16, 1980,
and receiv.ed by the Planning Division on January 2, 1981 . Forty-one parcels were
eligible to sign; 28 needed. Consent was obtained from 32 parcels.
B. PURPOSE: The purpose is to rezone a small strip of land from RM-2 to B-3 to use as
part of development site already zoned B-3, southwest of the intersection of Arcade
and Minnehaha.
C. SITE & AREA CONDITIONS: The parcel is part of an area of vacant land along the top
and sides of the bluff leading down from Margaret Street to Minnehaha. There is no
access into the site because Beech and Hope streets are unimproved. The site itself
consists of a hillside and ravine. It is adjacent to the playground for St. John
Evange;ical Lutheran School .
D. FINDINGS: .
1 . The St. Paul Land Use Plan designates this area as part of the E. 7th Street and
Arcade mixed use strip.
2. The Dayton's Bluff District 6 Plan designates the site for corr�nercial use.
3. The site is separated from Minnehaha by slopes over 12%. The Land Use Plan
recommends special consideration be given to development on environmentally
sensitive areas' (Policy 2.1-1 ).
4. The site while zoned RM-2 has no potential for residential development due to
its location and slope conditions.
E. STAFF APdALYSIS: The proposal is consistent with the City`s Comprehensive Plan. -
While slope conditions call for careful consideration of potential �rading or filling
required by new development, it speaks to careful site plan review as the proposal
for new construction is developed.
F. STAFF RECOMMENDATION: Based on findings 1 , 2, and 4, staff recommends approval of
the rezoning from RM-2 to B-3. LL
