1 BE IT RESOLVED, that, upon the petition of Scott A. and Chelsea H. Allan, as documented in

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That a permanent utility easement sha11 be retained within the vacated area to protect the interest
of Northern States Power Company-Electric.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of U.S. West Communicauon, Inc.
That, with the accompanying Uulity Easement Certificates of Intended Non-Use, filed
voluntarily on behalf of Northern States Power Company-Gas, District Bnergy St. Paul,
Incorporated, MCI Metro Incorporated, MediaOne, The Water Utility and The Department of
Public W orks, made a part hereof by this reference and filed in the office of the City Clerk of
Saint Paul, the City, for itself and on behalf of these corporations and departments, waives the
right to the uulity easements in the vacated area described above.

That the peutioners, their successors and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers and employees from ail suits, actions or claims of any character
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or peufioners' use of this property, inciuding but not limited
to, a claim brought because of any act of omission neglect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulation made in
accordance with the ]aw, whether by the petitioners or any of their agents or employees.
25 6. That the peuuoners, their successors and assigns shall within 60 days of the effecuve date of this
26 resolution, file with the Ciry Clerk an acceptance in wridng of the conditions of this resolution

I have requested a date of August 23 , 2000 for a Public Hearing to approve the
attached Council Resolution. The purpose af the resolution is to vacate property
desczibed as follows:
that part of the north-south alley in Block 4, Holterhoff and Mead's Addition to the City
of St. Paul, lying south of the easterly extension of the north line of Lot 6, and north of
the easterly extension of the south line of Lot 7, all in said Block 4..
I have enclosed photocopies of the Green Shezt, the Council Resoluuon, and a map
of the area to be vacated. Please let me know if there is anything else you might need for
this. These properties are located in City Council Ward 6, Planning District 5.

The Department of Public Works has reviewed the above-referenced request. This portion of the alley
is unimproved and undriveable. The abutting property owners would like to fence off the area to better
maintain it and reduce vandalism. The remaining portion of this alley (10' wide x 75` long) is graded
and used by the two businesses on Payne Avenue. This vacation wili not change the current use of the
alley. Therefore, the Department of Public Works has no objections to the proposed vacation.

The Department of Public Works has reviewed the above-referenced request. This portion of the alley
is unimproved and undriveable. The abutting property owners would like to fence off the azea to better
maintain it and reduce vandalism. The remaining portion of this alley (10' wide x 75' long) is graded
and used by the two businesses on Payne Avenue. This vacation will not change the current use of the
alley. Therefore, the Department of Public Works has no objections to the proposed vacation.

of Northern States Power Company-Electric.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of U.S. West Communicauon, Inc.
That, with the accompanying Uulity Easement Certificates of Intended Non-Use, filed
voluntarily on behalf of Northern States Power Company-Gas, District Bnergy St. Paul,
Incorporated, MCI Metro Incorporated, MediaOne, The Water Utility and The Department of
Public W orks, made a part hereof by this reference and filed in the office of the City Clerk of
Saint Paul, the City, for itself and on behalf of these corporations and departments, waives the

because of any claims or liability arising from any violation of any law or regulation made in

is unimproved and undriveable. The abutting property owners would like to fence off the area to better
maintain it and reduce vandalism. The remaining portion of this alley (10' wide x 75` long) is graded
and used by the two businesses on Payne Avenue. This vacation wili not change the current use of the
alley. Therefore, the Department of Public Works has no objections to the proposed vacation.

vacation of the property described as follows:
that part of the north-south alley in Block 4, Holterhoff and Mead's Addition
to the City of St. Paul, lying south of the easterly extension of the north
line of Lot 6, and north of the easterly extension of the south line of Lot 7,

This inquiry pertains to the vacation of City right-of-way only. Depending on the
petifioner's reason for requesting this vacation and the intended use for the vacated right-of-
