WHEREAS, A municipality may, pursuant to Minnesota Statutes,
Section 462.353, carry on comprehensive municipal planning activi-
ties for guiding the future development and improvement of the
municipality; and
WHEREAS, The Council of the City of Saint Paul may, pursuant
to Minnesota Statutes, Section 462.355, Subdivision 3, adopt or
amend a comprehensive plan or portion thereof after a recommen-
dation by the Planning Commission; and
WHEREAS, The Planning Commission has in substantial part
recommended adoption of a plan for District 10 as a part of the
City comprehensive plan; and
WHEREAS, The Planning Commission's Certification of the
District 10 Plan (1) recommended that Section 4 .7 of the Social
Development Plan component of the District 10 Plan be recognized
as the position of Como Community regarding the Job Corps Center,
but that Section 4.7 not be adopted as part of the Comprehensive
Plan, and (2) withheld approval of Section 5.1.4 Recommendations
1� and 17, and Section 5.2.4 Recommendation 3, of the Economic
Development Plan Component; and
WHEREAS, the policy of the City o� Saint Paul regarding the
Job Corps Center is set forth in C�,ty Council Resolution CF
272989, adopted May 22, 1979, and Section 4.7 of the District 10
Plan is expressly noted to be a statement of the Como Community 's
concern regard.ing the Center which does not propose any action
on the part of the City; and

WHEREAS, the following action by the Council of the City
of Saint Paul is not an implicit adoption of the Comprehensive
Plan of 1963 , or any portion thereof heretofore recommended by
the Planning Commission nor does it affect Resolution CF
272989 which remains in force; now, therefore, be it
RESOLVED That the Council of the City of Saint Paul, does
hereby adopt the District 10 Plan including, notwithstanding
the contrary recommendation of the Planning Commission, Section
4.7 and 4.7 .1 as the statement of position and recommendations
of the Como Community District Council regarding the Job Corps
Center, but excluding, as recommended by the Planning Commission,
recommendations 15 and 17 of Section 5.1.4 and recommendation
3 of Section 5.2.4, which Plan adoption is subject to such
review by the Metropolitan Council as may be required by law;
and be it
FURTHER RESOLVED that the comments of the Planning Commission
respecting Sections 5.1.4 and 5.2.4 of the Plan be subject to
such further discu�sa.ons between the District Council, the
Commi�sion and the City Council as may be appropriate.

Dear Councilwoman Showalterz
You requested further response to your inquiry at the November 18 ,
1980 public hearing on the Como Community District 10 Plan re-
specting the nature of the City Council action on the Plan and
the effect of approval of Section 4.7 of the Plan. Of specific
concern to you is the effect, if any, of adoption of Section 4.7 .1
Recommendation 2 on the Job Corps Ad Hoe Citizen Comm�ttee hereto-
fore created by the City Council. (Resolutions CF 272733 adopted
March 29, 1979; CF 272989 adopted May 22 , 1979) pursuant to
agreement between the Governor of Minnesota and the National
Job Corps Director, Department of Labor.
Section 4 .7 of the Plan is a statement of the Como Community 's
opposition to a Job Corps Center program undertaking by the
Department of Labor (DOL) at the Bethel College site and the
reasons therefor. Section 4 .7 .1 is a series of eight recommen-
dations of Como Community should DOL choose to implement the
program over the Committee 's objection. Each of these recommen-
elations is prefaced by the language, "The Department of Labor
should" . The Planning Commission certification of the District
10 Plan tb the City Council recommended that Section 4 .7 be
recognized as the community's position respecting Job Corps
Center without adopting the Section as part of the Saint Paul
Comprehensive Plan, noting that DOL, not the City, would be
responsible for implementing the recommendation proposals . •
The Section 4.7.1 recommendations, intended by the Community
to have effect in the event the Job Corps program is implemented
by DOL and then to the extent they might be accepted by DOL,
identify a number of specific actions directed at particulars
of operation of the Job Corps Center, viz : DOL and the State
renegotiate a Job Corps Center agreement; DOL consent to an
enrollment limit with a Minnesota residency and a Minnesota
school attendance eligibility requirement; DOL recognize a
Community Advisory Committee elected from District 10 and Falcon
Heights; DOL delegate to this Committee responsibility to screen
applicants, impose disciplinary actions , "screen, monitor, and
consult with" the program operator, and evaluate the proqram "in
terms of how and where it may not be in compliance with Public
Law 94-142" authorizing the program.

The District 10 Plan was considered by the City Council for
adoption as a component of the Saint Paul Comprehensive Plan.
"The comprehensive plan shall contain objectives, policies ,
standards and programs to guide public and private land use,
development, redevelopment and preservation of all lands and
waters within the jurisdiction of" the City. Minn. Stat.
Section 473.859, Subd. l. A comprehensive plan, once
adopted , is to be subsequently implemented by separate
adoption of zoning and building codes, subdivision regulation,
public facilities, capital improvment plans and other controls
within the capability of the City to enact and enforce. Minn.
Stat. Section 473.859, Subd. 4.
Sections 4.7 and 4.7 . 1 of the District 10 Plan are in the
nature of specific recommendations affecting the operation
of the Federal Job Corps Program. They are not a program to
guide land use, development, redevelopment or preservation.
As an implementation and operational program these Sections
are entirely dependent upon the acquiescence and agreement
of the Department of Labor which agreement the City cannot
compel as the specifics do not relate to authorized land
use or physical development regulation.
Because Sections 4 .7 and 4 .7 .1 are not the stuff of comprehen-
sive planning within the statutory definition or scheme, their
inclusion in the District Plan and incorporation into the
Comprehensive Plan is but a statement of position and request
addressed to the Department of Labor by the Community, which
can have force and effect only in the event and to the extent
DOL accedes to the request.
Accordingly, the existence and functioning af the Job Corps Ad
Hoc Citizen Committee is not affected by City Council adoption
of the District 10 Plan as part of the Saint Paul Comprehensive .
Plan. Should DOL recognize a commu nity advisory committee as
requested by Recommendation 2 , the continued existence of the
Committee would not be affected, although its function could be
affected by the particulars of the DOL response.

The Council of the City of St. Paul has fixed the 18th day of November at
7 :30 P.M. at Chelsea Heights Recreation Center, Hamline at Hoyt to conduct a r

On October 24, 1980, after holding a public hearing, the Planning Commission
certified the District 10 Plan except for the following recommendations:
1 ) Retaining Midway Stadium in the district; 2) Establishing restrictive cov-
enants, limiting building height for Energy Park land in the district; 3)
Developing a 300 foot wide linear park along the west side of Lexington Parkway
from Pierce �utler to Rosen Road; and 4) Recommendations pertaining to the
Humphrey/BeL�ei Job Corps. District plans are proposed amendments to the �
Comprehensive Plan, and must be adopted by the City Council before they come
into legal e;�ect. "Certification" by the Planning Commission represents
their recorur;er,�ation to the Mayor and the City Council that the plan should
be adopted. I am distributing to you copies of the plan for review preparatory
to your public hearing in the District.
The District 10 Plan has already undergone an extensive review process. It was
approved by the District 10 Communi�ty Council . It was circulated by the Planning
Commission to City departments and agencies, both as a preliminary plan and in
its present form. It was also circulated to all adjacent districts.
I am impressed by the understanding of city issues and the dedication of the
residents toward their own communities. I am pleased to transmit their District 10
Plan to you.
