of Lots l, 2 and 3, Block 9, Holcambe's Addition
(McIntyre Center) REVISID REPORT

This report supersedes rqy ori�ir�l report of December 12th, 1980.
The City of Sa.int Paul, at the request of�ts Department of Planning and
Economic Development, did acqui.re the sub�ect property with Community
Development Funds under Administrative Order D-�+233, approved May 17,
1978, to lease to the McIntyre Center for Gifted Children, pursua.nt to
Council File No. 270981, adopted May 2, 1978.
The Department of Planni.ng and Economic Development, by itsletter of
October 3, 1980, did declare this property surplus to the needs of the City _
and asked that it be vacated and deeded to the Housing and Redevelopment
Authority for disposition.
The Department of Public Works Yu�.s reviewed this m�tter and has no objection
to the vacation.
At the request of the Public Works Committee of the City of Saint �ul, I
have reviewed the request of Mr. Sid Tarshish, awner of Lot �+ of said block
tha.t abuts the subject property, asking that he be allaFred to purchase the
west half of Lot 3 of subject va.cation to be used for pa.rking for his
tena.nts. I have been advised by Walt Bo�wser, Assista.nt City Attorney� tha.t
to sell off or lease ar�y of the subject property other than for the sta.ted
purpose would be in conflict with what the property wa.s origirra.l�}r purchased
for. It also would greatly depreciate and curta.il ftiirther development of sa.id
property. �
No other public or private agencies involved ob�ected to the va.ca.tian. There-
fore, in view of the foregoing, I recommend the va.cation be approved and the
property be conveyed to the Housing and Redevelapment Authority, sub�ect to
the follcn+ring terms and conditions:
l. That the description of the praperty to be va.cated read
as follows:
All of Lots l, 2 and 3, Block 9, Holcombe's
Addition to Saint Pa.ul.

� �': That the va.cation be subject to all the terms and
conditions of Cha.pter 228 of the St. Paul Legislative
Cod.e, as amended.
a �'. Tha.t no ccm�pensation or posting of a bond be required,
insofar as the petitioner is the City of Saint Paul. '
� -� That ar�y conveyance of said property by the Housing and
Redevelapment Authority be in accordance with Minnesota
Statutes No. �+62.
� �5: That ar�y conveyance of said property by the Housing and
Redevelopment Authority be for the purposes of child
care or related services.
S � That if the property cea.ses to be used for child care or
related services, said property sha11 revert immediately
ta the Housing and Redevelopment Authority of the City of
Sa.int Paul for the original price.
� � That the Housing and Redevelopment Authority of the City
of Saint Paul, their assigns or successors by acceptance of the
terms and conditions of this va.cation agrees to indemnif�r,
defend and save harmless the City of Sai.nt Paul, its officers
and employees f�om all suits, actions, or claims of any
cha.racter,� including, but not limited to, a claim brought
because of ar�y in�uries, or da.mages received or sustained
by any person, persons or property, on account of this va-
- cation; or because of ar�y act or omission, neglect or mis-
conduct of said petitioner; or because of ar�y claim or
liability arising from or ba.sed on ar�y violation of any law
or regulation made in accordance with the law, whether by the
petitioner or ar�y of its agents or employees.
I further recommend�that the praper City Officials be authorized and directed
to convey the subject property to the Housing an� Redevelopment Authority
