00-754Council File # O O — �}S �{ RESOLUTION CITY OF SAINT PAUL, MINNESOTA Green Sheet # � � 7 13 Presented By / � Refened To Committee: Date 2 0 WHEREAS, Green Mill Inn, Inc. d/b/a Green Mill Brewing Co., for the premises at 57 Hamline Avenue, has requested the removai of one of the conditions on its license; and WHEREAS, the condition which they have requested be removed is Condition #9, which reads: "The On-Sale Liquor license will revert back to the City if Chris Bangs sells the Green Mill.' ; and WHEREAS, the Macalester Groveland Community Council has reviewed the request and 9 10 11 12 13 14 15 16 17 have no objection to the removal of the condition; and WHEREAS, liquor licenses are not transferable, and eliminating the condition on the license would not permit the licensee to sell or transfer his license; and WHEREAS, even if the condition is removed, and the business is sold, the purchaser would be required to apply for a license and go tl�rough the neighborhood notificarion requirements set forth in Chapter 409 of the Saint Paul Legislative Code; now, therefore, be it 18 RESOLVED, that condition # 9 on the license held by Green Mill Inn, Inc. d/b/a Green 14 Mill Brewing Co., which states that "The On-Sale Liquor license will revert back to the City if 20 Chris Bangs sells the Green Mill" is hereby removed from the license.
