F. 275707 ; and WHEREAS, the Saint Paul City Council , in the same resolution, ordered the Building Inspector to cease and desist from issuance of any building permits until six months from the initiation date of this 40 Acre Study, other than those permits which may be necessary for repair of or alteration of presently existing structures, which repairs or alterations do not change the existing use of such structure; and WHEREAS, the Planning Division of Planning and Economic Development has completed much of the background research for this Grand-Oakland 40 Acre Study and provided this information to both the Summit Hill Association on January 8, 1981 and to the Grand Avenue Business Association an January 13, 198T; and WHEREAS, the Grand Avenue Business Association and the Summit Hill Association have requested a 60 day extension to this six-month interim moratorium on all proposed developments in the Grand-Oakland area to allow a sufficient amount of time for public review of the findings and possible zoning alternatives and to allow a joint working group of both organizations to attempt to develop a consensus or a compromise position and zoning recommendation for this area; NOW, THEREFORE, BE IT RESOLVED, that the Saint Paul City Council does hereby extend the interim moratorium for 60 days on all proposed developments within the Grand-OakYand area described in C. F. 275707 to allow more time for public review and discussion of the 40 Acre Study findings and possible zoning alternatives in this area and to allow the joint working group of the Grand Avenue Business Association and the Summit Hill Association to attempt to develop a consensus or compromise position and zoning recommendation for this area. Warn Principal Planner Department of PTanning and Economic Development llth Floor CITY HALL ANNEX Dear Mr. Warn: This is in response to your memo o� May 28th regarding the proposed 40 acre study for Grand Avenue. I understand that the Council will request the Planning Commission to study the zoning maps for Grand Avenue, especially because of a discrepancy which occurred on two maps published in 1975. � You expressed concern that building permits may be issued pending the completion of the 40 acre study and that incompatible uses would be made of this property. In a 1976 decision, the Minnesota Supreme Court upheld a moratorium on a new building while the City was contemplating adoption of a new comprehensive plan subject to certain guidelines. Therefore, if . you are contemplating requesting that the Council adopt such a building limitation on Grand Avenue, you should be advised of these guidelines. In the case of Almquist v. Town of Marshan, 245 N.W. 2d 819 (1976) , the Supreme Court up e a two-year uil ing moratorium, and held that; "We hold that where a municipality enacts in good faith and without discrimination, a moratorium on development which is of limited duration, is valid if upon enactment, the study proceeds promptly and appropriate zoning ordinances are expeditiously adopted when it is completed. ° � M Edward J. Dear Ladie� and Gentlemen; This is a request to include my property along wi.th certain corrections which have bten recommended by the Board of Zoning Appe�ls for Zoning Nt�ps 27 and 28. I have not appeared before the Board with nq proposed corzection since I learned of the pending action af ter they �rrote their reco�mendations. In February, 1973, I bought and moved into the tri-plex at 547-549 Grand Nill. At that tiue the zoning on our lot was as "C'• residential ind our hoae existed as a legal aad conforming use. In 1975, when the new Zoning Code was enacted, the Eastern edge of the multiple-family zoning ar�a on our block was drawn on the West side of our property instead of on the East side. This meant that our house bec�me a leg�l, but non-conforming use. Since corrections are being nade to the Zoning Maps at this time, I aa requestina that the boundazy of the RM-2 area be re-drawn to inclnde our property. It wauld seem that this should have been done in 1975 due to the follawing: l. The house was built as a duplex in 1906. 2. The house was converted to a tri-plex and received a certificate of occupancy in approxi�ately 1970. 3. The t�vo buildings immediately West of our house were built as single-fau�ily hones and later converted to multiple- family use. They remain in a multiple-family zoning area. 4. CORRECTIONS TO ZCNING rtAPS #27 & #28 (Zoning File �lo. 8435� � P1r. Jung reviewed his staff report and showed slides of the subject area. He explained that it was felt the previous division was not correct and research was done recent�y to determine the attitude of the City Council at the time th� ordinance was passed in 1975. For this reason, maps dating back previous to the ordinance and rnaps published when the ordinance was adopted in 1975 were studied. P1r. Jung said tfie third map he had submitted to the Board showed current conditions of land use and the 7ast map in the group showed recommended changes. He then read a quote from Counci�man Robert Sylvester of the City Counci� baGk in July of 1975, and reviewed inter-department m�mos requesting opinions fram th� City Attorney's office and th� fact that no reply was received regarding this. Ne said staff fe�ls it is possible to prvperly zone the area, and the Board of Zoning A�peals gets into the matter b�cause of Section 6d.402{f) of the Zoning Ordinance so they can request that a recorrmendatifln be made that they have reviewed the matter and ask that a resolution be drawn �►p to reflect the map chang�s. The discussion that ensued included the fact that there were no contemplated changes to the north side of Grand �Avenue, and that Exhibit #4 submitted by ��r. Jung was the Yray the map should finally look. However, east of Oakland and on the south side of Grand chere are conflicts. Two apartment structures were in the B-2 area and abviously sf�ou7d be in the RM area, but they are surrounded by single family ham�s which, according t� . the City Council , were in the 8�2 area. Pir. Grais mqved to approve the proposed change�. Mr, Sega1 �nd�cated there may be an error regarding the desi,gnati,on east of Oaklar�d. Following di�cussi.on, the error was noted and recti.fi`ed by designating the area Rt1-2 rather than R-2. t�1r. Grais made a motion to approve the modified plan includinq �ytr. Since the P7arch 1977 revision date, it has be�n brought to staff's attention that further research of the area should be underta{en since the C%ty Council 's intentions may nat have been followed exactly. BOARD' s AUThORIZATIO�I: Section 60.402(f) af the Ordinance states: "4lhere unzoned property may existy or where, due to the scale�, iack of de�a�il , or illegibility of the Zoning h1ap, there is any uneertainty, contradiction, or con- fliction as to the intended locat'ion of any district boundaries shown thereon, interpretation concerning the exact location Qf the district boundary lines shaTT be determineci by the Ci�y Council , upon ���ritten applica�ion, or upon the Council 's otivn motion following review and reconmendation by the Qoard of Zoning Appeal�." STAFF REC0�1�1ENDATIONS: Due to original errors in draf�ing based partially on the overl situation, there exists some. uncertainty, contradiction and confliction regarding the intended designation of the t�vo clusters shown in Exhibit 3. Staff believes that the northeast quadrant o-F the intersection of Grand and Oakland should indeed be dzsignated RM-2 since th� 1973 and ]975 zoning maps (Exhibit 1 and 2� shoVr this by arrow and there exists no Council minutes to indicate otherwise. The south side of Grand �vest of Oak1and, however, shauld be designated as Counc-i1 intended, that all one and tv�o family residences plus commercial uses be zoned B-2. Higher densities are thus zoned Rt�i-2. Therefore, the zoning line along the a11ey betwe Grand and Lir�coln (on �•9ap 27) shoufid be revised to include properties at 580 and 578-76 Grand as Ri�1-2, the remainder to be shown as B-2. F. My reasons are as follows; I. On the supposedly corrected Zoning INaps 2� b 28 there aze still boundary draf ting errors originally made in 1975 which have not been corrected; a) Specifically, the house at 543 Lincoln and the duplex at 688-690 Oakland were included in the B-2 zoning alonq Grand. This goes beyond a literal reading of the City Conncil resolutioa of July 16, 1975 which deals with property on Grand Avenue west of the extended center line of Oaklsnd. Properties should be zoned RM-2. b) The 3-fa�i.ly dwelling at 547-549 Grand Hill was included in an R-2 zoning area rather than an RM-2 zoning area. (Please refer to my letter to members of the Council dated April 25, 1980.) Property should be RM-2. II. Zoning N1ap 2� also needs changes regarding the Grand and Oakland area. (The current revision dated 5-79 and the previous revision d�ted 4-7'7 both show the northea:st coraer of Grand and Oalcland zoned as B-2. ) III. At least two owners of �ffected property (543 Lincoln and 568 Grand) do not want their property zoned B-2. IV. Many people, including neighbors living in the immediate area, the Summit Hi11 Association and District 16 representatives, have voiced opposition to any B-2 zoning on the corner of Grand and Oakland. I request that the entire question be referred to the Bo�rd of 8oning Appeals for further study and action based upon citizen input. If the Council decides this c�n not be done, I request that at a minimum the boundary drafting errors listed above in Sections I and II be corrected to show the affected properties as RM-2 zoning. Warn, Principal P,lanner, PED � , SUBJECT: Zoning at East End of Grand Avenue Please be advised that the City Council on May 27, 1980, voted to lay over indefinitely the map corrections at the east end of Grand Avenue (Zoning File #8435). In taking this action they also initiated a 40 acre study, the center of which is the intersection of Grand and Oakland, to solve the zoning boundary disparity in the vicinity of Grand and Oakland and to examine the propriety of the existing zoning along Grand Avenue. I respectfully submit �tfiat any future building permit applications aff�cting property on the north or south side of Grand (between the alleys) between Dale and Oakland extended , should not be granted without consultation from the City Attorney's Office.
