Larpenteur Avenue and at 712 E. Paul , Minnesota 55102 Re: 704 and 712 Fast Larpenteur Avenue Dear Council Members: Prior to the construction of the duplexes at 704 and 712 Larpenteur Avenue, I was employed by Coffman and Broad. As an employee of Coffman and Broad, I sold the buildinqs and arranged the financing for the construction of the two duplexes. I was also a member of a group of investors which purchased the land on which the duplexes were built and which constructed the buildings. It was the original pur.pose of the investors, which was a joint venture, to build a four-plex on the two lots . We subsequently found out that the Zoninq Code was such that a four-plex could not he constr.ucted in that �rea. The investors then decided they could have four units by build�.ng two duplexes with a common driveway. The purpose of the joint venture was to make a profit from the construction and rental of the four units. If. the buildings were not profitable, the plan was to sell hoth buildings as a unit. For this reason no easement agreement was ever prepared for the common driveway. Although the title to the property from time to time was in different names, this was for financing purposes. The actual ownership was in the same group of people all of whom had equity in both buildings. At the time of filinq for a building permit , it was the intention to develop the property as a single unit. The property was under the actual ownership and control of a sinqle group of persons. AA-1 Builders and Supply Incorporated, of which I am the president, eventually bought out the interests of the other owners , and this corporation became the sole owner of the property and ultimately sold the entire premises to Arlington House. Larpenteur Ave. � City Council Hearing: December 18, 1980 Dear P�adam: � This is written in response to the appeal of �ale Swails and Marilyn Tach�ny to a decision of the Board of Zoning Appeals that the P7anning Commission eommitted no error of fact or procedure in granting a Special Condition Use Permit to Arlington House for a staffed emergency shelter program for up to 20 minors in two existing duplexes at 704 and 712 East Larpenteur Avenue. On July 16, 1980 the Zoning Committee of the Planning Commission held a public hearing on this case, and recommended approval of the Special Condition Use �ermit on a roll call vote of 5 to 1 . On July 25, 1980 the Planning Commission aranted the Special Condition Use Permit to Arlington House on a roll call vote of 15 to 2. On September 23, 1980 the Board of Zoning Appeals held a public hearing on the appeal of Dale Swails and Marilyn Tacheny to the decision of the Planning Commission to issue the Permit. A motion was made to uphold the appeal because the two duplexes are or� separate zoning luts and, therefore, one of the conditions spECifie� by tne Zoning Ordinance for Residential Group Homes in Single Family Zoning Districts, that a minimum distance of 1 ,320 feet is required between zoning lots used for Residential Group Home facilities , is not met. The motion failed on a roll call vote of 4 to 2. As long as the special conditions stated in the Zoning Ordinance are met, according to Assistant City Attorney Jerry Segal , the City cannot deny the permit. Of the three conditions specified for Residential Group Homes , the only issue in this case is that regarding the requirement for the 1 ,320 foot distance between zoning lots used for group homes. A "zoning lot" is defined in Section 60.350 of the Zoning Ordinance as "a single tract of land, which, at the t�me of filing for a building permit, is designated by its owners or developer as a tract to be used, developed, or built upon as a unit, under oNrnership or control of one person or joint tenants. (It) may include one or more lots of record." There may be more than one building on a zoning 1ot. The two dunlexes were built in 1974; although the contractor was the same in both cases, the name of the owner on each permit is different. The property was sald to � Arlington House by AA-1 Builders. According to Dick Johnson, President of AA-1 Builders the two duplexes were developed as rental property by a graup of investors in a joint venture situation; Mr. Johnson was one of the investors, as were the two people whose names are on the permits. Torstenson showed slides of the site and revieu�ed his staff report with a recommendation that the Planning Commission cornmitted no error of fact or procedure in granting a Special Condition Use Perr�it to Arlington House. Marilyn Tacheny, 726 E. Larpenteur, stated she was before the Board as a concerned neighbor and a member of the District 5 Planning Council . She read a letter from District 5 reversing their original decision stating that their main ohjections were: (1 ) the location in question would not provide the atr�osphere conducive to the welfare o� participants in the Arlington House program; (2) research by members of the District Council i�►dicates that there were numerous problems encountered by neighbors and former land- lords of Arlington House; and (3) the question of separation of such facilities under the 1320' regulation has never been resolved or answered by City staff. She also read a letter from Mary Kay Smith, Residential Licensing Consultant from the Minnesota Departrnent of Public 4Jelfare, in which she advises Mr. Ling that he is operating illegally and without � State l�icense since September 1 , 1980 at the Larpenteur Avenue address. P4s. Tacheny remarked that she went into other neighborhoods where �lrlington House had previously been located and residents there have indicated that they have had a lot of problems with them; their obscenities and vulqarities , drug problems that went on in the facilities while supposedly being supervised and one place asked them to leave. She said these people are willing to write or come forward if they should have to appeal to the City Council . She felt the neighborhood should r�ot have to be subjected to this and that they were dealt with very unfairly. She asked that the matter be reconsidered and more things checked into. P1s. Morton clarified that remarks should be directed as to where the Planning Commission erred. P1arilyn Tacheny referred to the 1320' rule in the Ordinance and stated that the duplexes are two completely different structures. They are two different homes side by side, not 1320' apart. Dale Swails, 1661 Payne Avenue, testified tiiat he also questions the 1320' regulation. He commented that he had talked with an attorney u�ho stated that there is a Minnesota State statute whereby if a majority of neighbors ` �rithin a certain distance of a property were against a Special Condition Permit, it could not legally be issued. ._�.,__..._�... __ ..._ _,_. _._T..___.,�.�.,_.._;.__�_...�_.� ._-----� _.._��__. ._._ ___,.___�------__ _ - - __�,� �.._..w_ . .� �r._._ DALE SI,IAILS & MARILYPJ TACHENY (#8725) PAGE 2 Mr. Segal commented that if there is such a law, he was not aware of it and asked Mr. Swails if he knew the reference number of the law? Dale Swails stated he did not know the reference number but definitely knew there was such a law. He added that he did not feel this case was similar � to the 6•Jilder Corporation case. LJilder bought the property with the entire purpose of cornbining it into one property and although there were two - buildings , they were operating it as one piece of property only. Arlington House is taking two existing buildings, t4vo separate lots , separate legal descriptions and trying to combine thern into one. These structures were never built ��ith the intention of being consolidated into one. � Ms. P1orton asked the City Attorney if the Board should be concerned with the � fact that Arlington House was operating without permits from the State? . P1r. Segal responded that it was his opinion that it should have no bearing on the appeal that the Board is considering; that matter would have to be taken up with the State Licensing Office or possibly the County Attorney. Fred Clapp, 2270 St. Clair, reported that they were the developers of the property immediately to the west of Greenbrier Street tivhich contains 28 residential building lots, 9 of which are within 350 feet of the property in question. Ne felt there should be an eler��ent of good faith in maintaining the character and continuity of the neighborhood. In 1979 their company pledged to the neighborhood council , Public Works Committee and to the City Council that nothing would ever be built on the lots they own except single family residential dwellings. He said by allo�,�ing this facility to operate, it would reduce the value of these lots , may even make it impossible to sell them, and it would also reduce the saleability and market value of every house in the neighborhood. Crnest Cutting, attorney representing Arlington House, stated that in their opinion the findings of the staff report are correct and they feel the precedent was set and the interpretation has been made regarding the 1320' spacing, and that the action of the Board of Appeals should be consistent with previous interpretation and action of the City. He added that all the special conditions which are specified in the Zoning Code were met. Mary Osiecki , 1323 Forest asked the City Attorney whether it was mandatory for the Board of Zoning Appeals or the Planning Commission to issue a permit simply because the conditions contained in the Ordinance are met? Mr. Segal commented that if the specified conditions as stated in the Zoning Ordinance are rnet, the City cannot deny the permit for reasons other than those specified in the Ordinance. He also mentioned that a Special Condition Use Permit is issued before group hornes are licensed and that this has been a standard practice. Hearing no further testimony, Ms. Morton closed the public hearing portion of the meeting. Mr. Segal clarified that the concern the residents have is the question of whether you can have two buildings within 1320 feet. He then referred to Section 60.350 which defines a zoning lot as a single tract of land wMich at the time of filinc� for a building perrnit is designated by its owners or developer as a tract to be used, developed or built upon as a unit under one a�vnership or control of one person or joint tenants. He said that in the past this has been interpreted to mean tha� you first determine what the zoning lot was at the tirne the building permits were issued. If the entire tract or parcel on which the two duplexes are located is a single zoning lot, the two buildinos would constitute a single group home facility. The issue before the Board is the definition of a zoning lot and whether the buildinas constitute 1 or 2 zoning lots. " , P�s. Lane reported that 704 Larpenteur was built on Lots 6 and 7, and 7l2 Larpenteur was built on Lots 4 and 5. ' � P�r. Segal indicated that it requires one to go back to the original building permit and determine whether,at the time of applying for the building permit, the developer considered the property to be built as a unit. It would have to be determined what tract of land was included in the building permit application and would be treated as a unit. The Zoning Ordinance than provides that the zoning lot can include more than 1 lot of record. In this case, there are two duplexes and two separate building permits. Th� question could be raised that even though ta�o single permits were applied for, the intent of the owner was to treat both propertie� as a single unit. Ms. Lane reported that there were ttvo different owners but the contractor, in both cases } was the same. She also mentioned that whenever two structures are built, there are always two separate building permits taken out. h1r. Segal stated that the issue before the 6oard is whether the Board agrees with the interpretation placed on the Zoning Ordinance �y the Planniny Commission, which determined that the zoning lot includes the four lots or the two duplexes because they issued the permit, or whether the Board feels that the interpretation should be more narrow and limited to the description of the property on the building permit itself. Ms. Summers made a motion to uphold the appeal of Dale Swails and Marilyn Tacheny based on the fact that the lots in question are two distinct and separate zoning lots and the 1320' rule would apply, and that the Planning Commission did err in granting a Special Condition Use permit to Arlington House. Mr. Woods seconded the motion. The motion failed on a roll call � vote of 4 to 2 with Mr. Grais , Mr. Kirk, f�fs. Morton and Mr. Parrish voting against the motion. I was also a member of a group of investors which purchased the land on which the duplexes were built and which constructed the buildings . It was the original pur.pose of the investors, which was a joint venture, to build a four-plex on the two lots . We subsequently found out that the Zoninq Code was such that a four-plex could not be constructed in that area. The investors then decided they could have four units by building two duplexes with a common driveway. The purpose of the joint venture was to make a profit f_rom the construction and rental of the four units, If the buildings were not profitable, the plan was to sell t�oth huildings as a unit. For this reason no easement agreement was ever prepared for the common driveway. Although the title to the propert_y from time to time was in different names, this was for financing purposes. The actual ownership was in the same group of people all of whom had equity in both buildings. At the time of filing for a building permit , it was the intention to develop the property as a single unit. The property was under the actual ownership and control of a single group of persons. AA-1 Builders and Supply Incorporated, of which I am the president, eventually bought out the interests of the other owners , and this corporation became the sole owner of the property and ultimately sold the entire premises to Arlington House. SITE/AREA CONDITIONS: The site is occupied by two duplexes with a common driveway. There are two dou le garages at the rear of the property. Mount Zion Cemetery is just west of the site, and Son's of Jacob Cemetery is to the southeast; there is a driving range across Larpenteur from the site. Single family �residences abut the property to the east and south. � D. ZONING HISTORY: A public hearing was held by the Current Planning and Zoning Committee of the Planning Commission on July 16, 1980, at which time the Committee recommended approval of the Special Condition Use Permit on a role call vote of 5 to 1 . The Planning Commission, on July 25, 1980, granted a Special Condition Use Permit to ArTington House for a staffed emergency shelter program for up to 20 minors in the two existing duplexes at 704 and 712 E. Larpenteur on a roil call vote of 15 to 2. E. ADMINISTRATIVE REVIEW: Section 64.205(a) of the St. Paul Zoning Ordinance gives the Board of Zoning Appeals the power of Administrative Review: "To hear and decide appeals where it is alleged by the appellant. . . that there is an error in any fact or procedure in any order, requirement, permit, decision or refusal made b,y the Planning Commission ir� carrying out or enforcing any provisions of this Ordinar�ce." - Section 60.338 defines Residential Group Home as "a building or struc�ure where persons reside for purposes of rehabilitation, treatment, or. special care. . . . Such persons may be orphaned, suffer chemical or emotional impairment, or suffer social malajustment dependency." Section 60.413(e) permits a Residential Group Home in an R-3 One-Family Residential Zoning District subject to the following conditions: 1 . No more than ten (10) group home residents may be housed in excess of the persons allowed by the definition of "family" , except that structures designed or newly built specifically for such use may allow a greater number provided that all other conditions of the Special llse Permit are met. 2. The minimum lot size is that prescribed for one-family dwellings for the district in wh.ich the institutional group home is located. 3. A minimum distance of 1320 feet will be required between zoning lots used for Residential Group Home facilities. According to City Planning records, no other Residential Group Home is within 1320 feet. The Residential Group Home closest to the site, and the only other Residential Group Home in District 5 (Arlington House for Boys at 1060 Greenbrier) is about 6600 feet away. G.
