Subject: Petition of the First Grand Avenue State Bank
for the vacation of the east 91.45 feet of the
alley in John Gaaxden's Third Addition
� Public Hearing - December 9, 1980
The petitioner desires the vacation of the east 91.�+5 feet of the alley
in John Gaaxden's Third Addition. The petitioner requests this vacation
in order to develop the site for a bank building with drive-up teller
facilities. The area proposed to be vacated is zoned B-2 and measures
20 feet by 91.�+5 feet, consisting of 1,828.�+ square feet.
The owner of parts of Lots 2� and 2�+ on the north side of Highland
Parkway expressed his displeasure with the proposed realignment of the
alley. He feels that the realignment will cause undue disruption to the
property owners within the block.
The Southwest Area District Council and area residents met with the
petitioner and worked out a revised site plan and alley realignment. The _
. District Council's Board of Directors now supports the vacation with the
deeding and improvement of a new alley to connect to Highland Parkway.
The Department of Public Works has no objection to the vacation subject
to the petitioner deeding and improving the new alley, as shawn on the
attached plan.
Northwestern Bell Telephone Company reports that there are phone lines
within the area proposed to be vacated and therefore requests that a
utility easement be retained.
Northern States Power Company seports that there axe no existin� gas
distributing facilities in the axea; ho�wever, 1Qorthwestern Bell Tele-
phone Company has a pole in the area with Northern States Power Company
conductors attached, and therefore requests a utility easement.
There were no objections from any other public or priva.te agencies
involved.
Based on an analysis of a11 the information received from public and _
private agencies, I recommend approva,l of the vacation, sub�ect #�o the
Pollawing terms and conditions:

� 1. That the description of the vacation read as follaws:
The east 91.�+5 feet of the alley in
John Gaarden's Third Addition.
/�2: That the vacation be subject to all the terms and
conditions of Chapter 228 of the St. Paul Legis-
lative Code, as amended.
��. That a specifYc easement be retained to protect
the interests of Northern States Pawer Compar�y
within the vacated alley.
3� That a specific easement be retained to protect
the interests of Northwestern Bell Telephone
Compaqy within the vacated alley.
�I That the petitioner deed to the City of St. Paul
an alley easement over the west 20 feet of I,ot 27,
John Gaarden's Third Addition and that portion of
Highland Paxkway (formerly Otto Avemze) vacated
adjoining the iaest 20 feet of said I�ot 27 in a
manner and form approved by the City Attorney,
and the City be authorized to accept said easement.
,j� That the petitioner improve the above new alley
section in a manner and form approved by the
Department of Public Works prior to the closing
off and obliteration of the e�a sting alley section.
��'. That the petitioner pay to the City the amount of
$250.00 as compensation for the vacation. This
amaunt represents the minimum compensation to help
defray the administrative costs of processing
vacations. This does not reflect any charge for�
the vacated City alley in as much as the petitioner
is dedicating a replacement alley of equal or greater
length.
�. That the petitioner flirnish the City with a bond in
the amount of $5,000.00, and by acceptance of the
terms and conditions of this vacation agrees to
indemnify, defend and save harmless the City of
Saint Paul, its officers and employees from all
suits, actions, or claims of any chaxacter, includin�,
but not limited to, a claim brought because of any
in�uries, or damages received or sustained by any
person, persons or property, on account of this vaca-
tion; or because of any act or omission, neglect or
misconduct of said petitioner; or because o� ar.Ly
claim or liability arising from or based on any
violation of any law or regulation made in accordance
with the law, whether by the petitioner or aqy of its
agents or employees.
