RESOLVED, that upon execution and delivery of a release
in full to the City of Saint Paul, the proper City officers
are hereby authorized and directed to pay out of the Tort
Liability Fund, 09070-511-000, to Liberty Mutual Insurance
Company and A. James Dickenson, its attorney, the sum of
$426.14 in full settlement of their claim for dama.ges sustained
on February 15, 1978, as a result of the Co�unodore Hotel fire
and explosion.

RE: Claim of Liberty Mutual Insurance Co.
On February 15, 1978, Liberty Mutual Insurance Company insured
the home of Lyle A. Kaufenberg located at 76 N. Western Avenue,
directly across the street from the Commodore Hotel. Because
of the explosion, Mr. Kaufenberg' s home was dama.ged in the amount
of $3,982.65. This amount was paid by plaintiff insurance company.
The City of St. Paul has been held responsible for 10% of the
dama.ge attributable to the explosion, and together with interest,
the total settlement figure is $426. 14.
The office of the City Attorney recommends approval of this
settlement.
