RESOLVED, that the Council of the City of Saint Paul
does hereby approve and authorize the execution by the
proper City Officers, Traffic Control Signal Agreement
No. 60482, between the City of Saint Paul and the State
of Minnesota, Department of Transportation, covering the
install�tion and removal of a tempo�ary traffic control
signal and revision of the existing traffic controi
signal at Trunk Highway No. 5 (West Seventh Street) and
Kellogg Bouleva rd and an interconnect to the traffic
control sig�ai at West Seventh Street a�d Smith Ave�ue.
A copy of said agreement is attached hereto and in-
corporated herein by reference.

ACTIOM REQUESTED: Attached agreement covers the installataon and �e�novai of temporary
-�traffic signals and revision of the existing signals at W. Seventh St. and Kellogg Blvd.
and an interconnect to the signals at Smith Ave. and W. Seventh St.
PURPOSE AND RATIONALE FOR THIS ACTION: This signal work is requirad end will be scheduled
in conJunction with the street reconstruction proJect on W. Seventh St. between Kellogg
. Blvd. and Chestnut St. The State will let the contract for the signal cons�ruction and
will provide the sdministration and inspection. The City will participate in costs of
construction, provide the design and engineering, and provide the power supply to signal.s.
FINANCIAL IMPACT: Total construction costs (actual cont�act costs only) are estimated to
be $38,000.00. The State's 'share estimated to be $17,500.00. The City's share esti�ated
to be $20,500.00 to be paid from 1981 MSA funds.

referred to as the "State" , and the City of St. Paul , hereinafter � �

referred to as the "City" , F;ITI�ESSETH: �
VdHEREAS, the State has determined by the signal design
and a roval �
pp process that there is justification and it is in the I
�
Fublic' s best interest to provide and rEmove a temgorary traffic �
control signal. and revise the existing traffic control sign«1 on �
Trunk Highway No. 5 (West 7th Street) at Kellogg Eouleva:rd ana to
provide interconnection to Smith Aven�ze in the City; and
(�HEREAS, the City and State will share in •the cost,
maintenance and operation of the temporary and the revised traf-
fic control signal and interconnect as hereinafter set forth;
I�UT�, THEREFORE, IT IS AGREED AS FOLLCP7S : .
1. The City shall prepare the necessary plan, spe-
�cifications ancl proposal and shall perform the engineerinq and
insgection required to complete the items of work hereinafter set
forth. Such work as described immediately a.bove shall con�i.tute -
"Engineering and Insgection" and shall be so referred to
hereinafter.

2. The contract cost of the work or , if the work is
not contracted, the cost of all labor , materials, and equipment
rental required to complete the work, exceFt the cost of pro-
viding the power supply to the service Fole or pad, shall cons- . j
titute the actual "Construction Cost” and shall be so referred to �
hereinafter. '
3. The State with its own forces and equipment or �y
contract shall do the traffic control signal work provided for
under St�te Project r�o. 6201-55 with the Construction Cost shared
as follows:
a. Trunk Highway I�o. 5 (West 7th Street) at
Kellogq Eoulevard - Revise Signal System "A" . :
Estimated Const'ruction Cost $29 ,000. City' s
� share fifty percent. State' s share fifty
percent.
b. Trunk Highway No. 5. (West 7th Street) at
' Kellogg Boulevard - Temsporary Signal System
"B" . Estim�ted Construction Cost $6,000.

4. Upon execution of this agreement and a request in i
i
writing by the State, the City shall advance to the State an �
amount eyual to its share of the cost based on the actual bid �
price. •
5. Upon final payment to the contractor and
• cornputation of the City' s share for the work provided for herein,
that amount of the funds advanced by the City in excess of its
share will �e returned without interest and the City agrees to
pay to tl�e State that amount of its share which is in excess of
the amount of the funds advanced by the City.
6. The Cost to the City for Enqineering .and
Inspection and to the State for administering the construction
contract shall be considered equal . •
. ?. UFon comgletion of the work provided fcr in para-
graph 3 hereof, the City shall prcvide electrical power and shall
maintain and keep in repair the traffic control sigr_als, street
lights and interconnect at its cost and expense.
8. Any and all persons engaged in the aforesaid work �

to be performed by the State shall not be considered erngloyees of
the City and any and all claims that may or might arise under the
Worker ' s Compensation Act of this State on behalf of said
employees while so engaged, and any and all claims made by any
third party as a consequence of any act or omission on the part �

' of said employees while so engaged on any of the work
contemplated herein shall not be the obligation and responsi-
bility of the City. The State shall not be responsible under the
Worker ' s Compensation Act for any employees of the City. _ ;
9 . Timing of the temporary and revised traffic con-
trol signals provided for herein shall be determined by the
5tate' s District Traffic Engineer and the City' s Traffic
Engineer .
10. Ljpon execution by the City and. State and com-
pletion of the construction work Frovided for herein this
. agreement shail supersede and terminate the traffic control si�-
r.al maintenance and power provisions contained in any previous
agreements between the parties for 4�est 7th Street at Kellogg �
Boulevard in the City.
