An ordinance amending Section 409.07 of the
Saint Paul Legislative Code; relating to the
sale of intoxicating liquor on Sundays.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN;
Section l.
That Section 409.07, Subd. 2 (1) , of the Saint Paul Legislative
Code is hereby amended to read as follows:
Subd. 2. Sunday Sales.
(1) Notwithstanding the provisions of Subdivision 1,
establishments to which "on sale" licenses have been
issued or hereafter may be issued for the sale of intox-
icating liquors which are hotels or restaurants and which
have facilities for serving not less than 50 guests at
one time, may serve intoxicating liquors between the hours
of ��-e�e�ee�-r�ee� 10:00 a.m. and 12 o"clock midnight on
Sundays in conjunction with the serving of food, but no
liquor shall be served on Sundays other than to persons
who are seated at tables,� Arovided that the licensed
establishment is in conformance with the Minnesota Clean
Indoor Air Act.
Section 2.
This ordinance shall be in force and take effect on the later
of the following: 30 days after passage, approval and publication
or August l, 1981.

As we discussed, attached is a draft of an amendment to the Saint
Paul Legislative Code permitting the sale of intoxicating liquor
at 10:00 a.m. on Sunday. As you will see from the attached
S. F. 1084, compliance with the elean Indoor Air Act is a pre-
requisite for eligibility to open at 10:00 a.m.

. 6 BE IT ENACTED BY THE LEGISLATURE OE THE STATE OF MINN�SOTA:
7 Section 1. Minnesota Statutes 1980, Section 340. 14,
� Subdivision 5, is amended to read: �

15 may serve intoxicating liquors between the hours of I2 o' clock '
16 noon and I2 o' clock midnight on Sundays in conjunction with �h.e
17 serving of food. The governing body of any municipality within
18 the seven county metropolitan area, as defined in Ntinz�esota

25 (b) It is unlawful for any such establishment, directly or

3 .�p�cial license fro:n the municipality fihere£or. Such ��pecial -
4 l�cense may be issued by the gaverning body of the nu�icipaiity
5 �or a period of or.e year and for such a fee as it shali
6 determine, but not exceeding $200. The special license may be
7 revoked by the governing body, for cause. The provisions of
8 section 340. 112 shall anp3y t4 such license. Applicat�on for '
9 the special license shall be made to the governing body of the
10 municipality in the same manner as application for ather
lI licenses to sell intoxicatinq liquor are made.
12 (c� This subdivision shall not apply to any municipality
13 until authorized by the voters of the �municipality votinq on the
�4 question at a special election called for such purpose or at the
15 general electian �in the nunicipality, the election to be -
16 conducted in accordance witn the applicable provisions of the
17 Min.nesota election law. Provided, however, that municipal voter
18 approval shall not be required in the case of major airports
19 operated by public corporations organized and existing under
20 sections 473. 601 to 473 .679, which are operated by such public .
21 corporations as terminals for regular, scheduled air passenger

22 service where the lands or any part th�reof constitutinq the
23 same have been detached from cities under and pursuant to
24 sections 473. 625 to 473 . 631, nor in the case of comraon carriers
25 licensed under the provisions of sections 340. I1, subdivision 3,
26 and 340. I2 and any license to sell intoxicating liquors on �
27 Sunday issued to a common carrier by the commissioner of public
28 safety shall, in addition to all other license fees, require the
29 payment to the commissioner of public safety of a fee of $50 per
,
30 annum plus a fee of $5 for each duplicate. of said license
31 required to be posted in each place where intoxicating liquor is
32 sold by said common carrier.
