An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes §462. 357 and §64. 210
of the Legislative Code, 5hephard Park Partnership duly petitioned
to rezone Lots 1 through 14, 29 through 32, and parts of Lots 15
through 28 that lie north of the railroad tracks, Block 6, Palis-
ade Addition, located in an area bounded by Benson, Madison,
Rackwood and Springfield, from B-2 to RM-1 for the purpose of
constructing a 64-unit condominium complex, the petition having
been certified by the Department of Finance and Management Services
on February 11, 1981 as having been consented to by at least 67$ of
the owners of the area of the property to be. rezoned, and further
having been consented to by at least two-thirds of the owners of
the property situated within 100. feet of the total contiguous
descriptions of real estate held by the same owner or any party
purchasing any such contiguous property within one year preceding
the date of the petition; and
WHEREAS, The current Planning Committee on April 11, 1981
conducted a public hearing for �he purpose of considering the
rezoning petition, and pursuant to Section 107. 03 of the Admini-
strative Code, submitted its recommendation to the Planning Com-
mission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on April 24, 1981 and recommended
that the City Council approve the petition; and
WHEREAS, Notice ot a public hearing before the City Council
on the said rezoning petition was duly published in the official

Dear Sir:
This is written in response to the petition of the Shepard Park
Partnership to rezone the above described property from B-2 (Community
Business District) to RM-1 (Multiple-Family Residential ) in order to
construct a 64-unit, two-story condominium complex.
On April 16, 1981 , the Zoning Committee of the Planning Commission
conducted a public hearing on this case, and recorr�nended approval of
the rezoning to RM-1 on a Vote of 6 to 0.
The Planning Commission considered the Zoning Committee's recommendation
on April 24, and recommended approval of the rezoning from B-2 to RM-1
on a vote of 15 to 0.
This matter is scheduled for hearing before the City Council on May 28,

SH::PARD PARK PARTNERSHIP (#8831 } : Petition to rezone from B-2 to RM-1 area
bounded by Benson, P1adison, Rockwood and the railroad.
The applicant was present. There was no opposition present at the hearing:
Mr. Torstenson showed slides of the site and reviewed his staff report with
a recommendation for approval . A letter was received from the Chicago-Milwaukee
St. Paul Facific Railroad Company expressing concern with fencing and buffering
along the railroad right-of-way.
Stu Nolan, representing Shepard Park Partnership, explained that the proposal
is for a 64-unit, two story condominium complex with 64 garages plus additional
on-site parking spaces priced in the 50 to 60 thousand dollar bracket. They
have applied for McKnight funds which looks promising if the program gets off
the ground. They feel that this is a much more compatible plan than the present
comm�rcial zoning. .
Kathy Tarnowski , representing the Southwest Area Distri�t Council , spoke in
support of the rezoning stating it is more compatible with the Sheparcl Park
area tlian the present business zone. She indicated that they are concerned
about 1�.he adequacy of recreational space because of the increase in housing
density from what was originally projected.
Hearing no further testimony, Mr. Bryan closed the public hearing portion of
the meeting.
Ms. Summers made a motion to recommend approval of the rezoning based on
findings 1 and 2 of the staff report. Ms. Karns seconded the motion. The
motion passed on a roll call vote of 6 to 0.

The Southwest Area District Council board of directors on April 13, 1981
discassed the application by the Shepaxd Park Partnership to re-zone
the parcel of land between Benson and the railroad tracks to RM-1 so that
6�t detached two-story condominium units can b� built there.
The Sou�hwest Area District Council �upports the re-zoning ta RM-I. The
SWAD Council would like to request that the ci,ty work with the neighborhood,
the district and the Shepard Paxk Partnership in redefinition of the
publicly dedicated recrea'tional space needs of the Shepard Park area in
view oP the increase in housing density that this pro�ect would provide
over and above what was originally pro�ected in the Octaber, 1977
Environmental Impact Statement.

A. SUFFICIENCY:� The application was filed on a consent petition subscribed and sworn to
before a notary public on August 18, 1980; declared sufficient b,y the Finance
Department on February 11 , 1981 ; -and received in the Planning Office on February 19,
198i . Seventy-two parcels were eligible, 4° parcels were needed, and 50 were obtained.
The purpose of the rezoning from B-1 to RM-1 was stated on the petition as buildiny a
64-unit, two-story condominium complex.
B. FRONTAGE & AREA: This irregularly shaped parcel has a 660' frontage on Benson, a
288.65' frontage �n the vacated Springfield, and a total arEa of 166,884 square feet.
C. SITE/AREA CO�DITIONS: The site is level and vacant. There are single family homes
north of the site, across Benson, apartment buildings to the south and west, and
ind�.�strial uses c�ast of the site. A railroad right-of-�,ray runs along the southwest
side of the site.
D. FINDIPdGS: �
1 . The District 15 Plan, part of the City's Comprehensive Plan, makes �no specific
recommendation regarding the site.
2. Uses permitted under the proposed RM-1 zoning are harmonious with adjacent land use,
provided that there is adequate buffering along the railroad righ�:-of-way. The
proposed RM-1 zoning is more harmonious witti the single family homes acrass Benson
than the existing B-2 zoning. Adequate buffering along t�e railroad right-of-way
will be assured by the site plan review authority of the Planning Commission.
E. STAFF RECOMMENDATION: Based on findings 1 and 2 above, staff recommends approval of the
rezoning.
