WHEREAS, Jeff Byrd applied to the Board of Zoning Appeals for
a variance from the strict application of the provisions of Section
61.101 of the scheduled regulations of the Saint Paul Zoning Code
for the purpose af permitting him to convert a single family home
into a duplex on a lot which is 296 feet less area than the minimum
6, 000 feet required, a five foot variance from the fifty foot mini-
mum lot width required and a seven foot side yard variance fram
the nine foot side yard requirement of the regulations; and
WHEREAS, Following a public hearing with notice to affected
property owners the Board of Zoning Appeals by its Resalution No.
8815 adopted March 10, 1981, denied the appeal for variances and
the owner of the prope�ty has subsequently filed an appeal from
this decision to the City Council pursuant to Section 64.204 of
the Zoning Code; and
WfiEREAS, The City Council acting pursuant to Section 64.204
through Section 64.207 and upon notice to appellant and other
affected property owners has conducted a public hearing on May 14,
1981 where all interested parties were given an opportunity to be
heard; and
WHEREAS, The Council having heard the statements made and
having considered the variance application, the report of staff,
the minutes and findings of the Board of Zoning Appeals, does
hereby
RESOLVE, That the Council of the City of Saint Paul does hereby
reverse the decision of the Board of Zoning Appeals in this matter
and does hereby grant the three variances requested by the applicant
based upon the findings made by the City Council that the subject
property at 373 Daly Street is zoned for two family use, it being

FURTHER RESOLVED, That the appeal of Jeff Byrd be and is hereby
granted; and, be it
FURTHER RESOLVED, That the City Clerk shall mail a copy of this
resolution to Jeff Byrd, the Zoning Administrator, the Planning Com-
mission, and the Board of Zoning Appeals.

Dear Sir:
This letter is written in response to the appeal of Jeff Byrd of a decision
of the Board of Zoning Appeals denying requests for variance in order to
convert a single family home to a duplex. The site is located at 373 Daly
Street which iS lot 26, Block 18, Thomas Daly Subdivision.
The Board of Zoning Appeals received three letters against the variance
requests. At the public hearing held on February 24, 1981 , three persons
spoke in opposition. The Board voted 5 to 1 to deny the request based upon
findings 1 , 2, and 5 of the staff report.
The appeal is scheduled for City Council public hearing on May 14, 1981 .
Please notify me by May 13, 1981 , if any member of the City Council wishes
to have slides of the site presented at the public hearing, or requests
additional information.

WHEREAS, JEFF BYRD has applied for a variance from the strict application of ' �

WHEREAS, the Saint Paul Board of Zoning Appeals conducted a public hearing on
February 24, 1981 , pursuant to said appeal in accordance with the requirements
of Section 64.203(a) of the Legislative Code; and
WHEREAS, the Saint Paul Board of Zoning Appeals based upon evidence pre��rite�
at the public hearing, as substantially reflected in the minutes attached
hereto, made the folloti,ring findings of fact:
l . That the strict application of the regulations enacted would result in
peculiar or exceptional practical difficulties to the owner of property
at 373 Daly Street as distinguished from mere inconvenience by reason of
the existing physical conditions of the property.
2. That the variance can be gr"anted without substantial detriment to the

3. That the request for variance is not based primarily on a desire for
economic gain.
NOtd, THEREFORE, BE IT RESOLVED, by the Saint Pau1 Board of Zoning Appeals that
under authority of the City's Legislative Code, Chapter 64.206, the variances
to allow the conversion of a single family home to a t►�lo-family home upon a
5,704 sq. ft. lot, with a width of 45 feet, and a north side yard of 2 feet be
denied, for property described in the legal description of the application for
variance and the si�te plan attached hereto.

JEFF BYRD (#8815) : Variance of 1ot width and side yard setback requirements
in order to convert an existing sin�le family home into a duolex at 373 Daly.
Mr. Tedesco showed slides of the site and reviewed his staff report with a
recommendation for denial . Three letters were receivec+ in opposition
expressing concern regarding traffic, the fact that it is alreac±,y converted
to a duplex and rented, and the probability of it not being o�vner-occupie�i.
Staff also indicated that the Assessor's records , which are not always up to
date, stated that the structure was not a duplex but that it could have been
converted recently.
Jeff Byrd, appellant, state� that the upstairs is rented but if the variance
is not approved, it will be vacated. He explained that v�hen he bought the
property, he noticed that there were other duplexes in the block on the same
size lots as the �roperty in question. Fie converted the structure into a
duplex and did the work himself. In December of 1981 , a variance was granted
allowing a single family home to be converted to a duplex at 400 Daly Street.
He commented that the driveway extends the entire lenc�th of the lot and did
not feel that parking t�ould be a big problem. He is presently living in the
place and as no intention of mo�.��ing at this tin,e.
Dorothy 4landeschneider, 369 Daly, stated that the lots in the area are small
and there is a parking problem. She has discusse� the parking situation v�ith
the appellant several times trying to work out an alternative to her opposinc�
the variance. He suggested that he would have his tenants park in the back
yard but she did not feel they should 'nave to look out at a parkinc7 lot.
She also r�entioned that there are a lot of small children in the neiqhborhood
and the traffic is heavy. She presented 2 letters in opposition from
Evelyn Slack, 368 Daly, and Jackie Mason , 377 Daly.
Lorraine Zimmerman , 361 Daly, spoke in opposition stating that the street is
exceptionally narrow and at times they are unable to park in front of their
house.
Bernadine Hinkley, 362 Daly, spoke in opposition also indicating that the
street is very narrow and busy, and they iiave a difficult time gettinc� into
their driveway.
Hearing no further testimony, P-1s. Morton closed the public hearing portion of
the meeting. '

and 5 of the staff report. Mr. Peterson seconded the motion. The motion

A. PURPOSE: Applicant requests variances of lot width and side yard setback requirements
in order to convert an existing single family home into a duplex.
B. FRONTAGE & AREA: This rectangular lot has 45 feet fronting Daly, with a depth of
126.75 feet, for a total area of 5,704 square feet.
C. SITE CONDITIONS: A two-story house covers most of the front portion of the house. A
one-car garage is in the southwest corner of the lot, access is to Daly Street. The
lot is level .
D. AREA CONDITIONS: Surrounding land use appears to be one- and two-family residential .
E. VARIANCE: Section 61 .101 Schedule of Regulations requires a lot area of at least
6,000 square feet for a two family home. The applicant proposes 5,704 square feet.
A variance of 296 square feet is requested.
Section 61 .101 Schedule of Regulations requires that two-family structures be built
upon zoning lots with a lot width of at least 50 feet. The applicant's lot is 45 feet
wide. A variance of 5 feet is requested.
Section 61 . 101 requires a side yard setback of at least 9 feet for a two-family home.
The applicant's structure is built 2 feet from the north �i�'e yard. A variance of
7 feet is requested.
F. FINDINGS:
1 . The applicant contends the size of the lot presents hardship. However, a 45'x127'
sized lot can be used in its present form -- as a single family home (as intended
by the Ordinance). The strict application of the regulations enacted would not
result in peculiar or exceptional practical difficulties as distinguished from
mere inconvenience by reason of the existing physical conditions of the property.
2. The variance cannot be granted without substantially impairing the intent and
purpose of the Ordinance.
