BE IT RESOLVED, That the Council of the City of Saint Paul hereby
certifies and approves the action of the City of Saint Paul Board of Appeals
and Review pertaining to the following listed property and as shown by the
Excerpted Minutes of said Board of Appeals and Review, dated May 12, 1981,
and marked EXHIBIT A, and attached hereto and made a part hereof by refer-

PROCEEDINGS : Mr. Sullivan said that he had completed the work required
under the variance granted in June 1980 by the October 15 deadline , but
a later inspection by the city had found the fire separation improperly
done. The variance was rescinded by the board in February 1981. He had
not been notified that his case was. to be discussed and felt the a�tian
was unfair without giving him a chance to explain his side of the story.
He contacted the city and an inspector came out to describe how the work
should be done. A new completion date of April 14 was set, or, if the
work could not be done by that time , he was to send a copy of the written
contract to the housing code office. His contractor' s wife died in April ,
so there had been a delay beyond April 14.
Alice Bijjani said the work had only been started the previous Friday,
May 8. She spoke of numerous efforts to get action on the deficiencies
of the property and the slow response from Mr. Sullivan. She said there
was still a need for a door closer in the boiler �area, and a bathroom
that lacked a han dsink , an electrical outlet, and ventilation.
Mr. Sullivan said there was a handsink now, and the other three items
were probably done by this time.
BOARD ACTION: Mr. Tilton moved that the variance granted in June ,� 1980 ,
e reinstate , on condition that the handsink, electrical outlet , ventila-
tion device , and door closer in the boiler area, be in place as required
by the city within one week. Ms . Burg seconded. MOTION CARRIED AND SO
ORDERED.

PROCEEDINGS : Alice Bijjani said that the bathroom in the basement unit
was also being used by the dental office on the first floor.
Dr. Hamilton stated that the b athroom is used very little by patients ,
perhaps twice a day, but he planned to install a bathroom on the first
floor for the dental office in the future. He had put in a large escape-
type window in the sleepin g room of the b asement unit in April , and this
had been approved by a city inspector. He had also installed mechanical
ventilation in the bathroom. All gases used in connection with his dental
practice were stored in an approved concrete block room.

building. The main entrance door was kept locked and could be entered only
by the tenants , and the first floor bathroom was also locked and could be
opened only by the first floor tenant.

Alice Bijjani stated that the sheetrock which was meant to provide fire
separation of the heating plant from the basement apartment did not extend
to the ceiling. Additional sheetrock should be appTied to correct the
� problem. In addition , there was no provision for emergency escape from
the sleeping room, there being only a small window �oo high off the floor.

John Roberson suggested that a door be cut into the sleeping room leading
directly to a stairway exit. This would provide the rec{uired emergency
escape route and would be less costly than installing escape-type windows
wi th a windowiae 11.
Mr. Latuff said his parents would do whatever was necessary for the safety
of the tenants .
Alice Bijjani pointed out the existence of a zoning problem. She said the
third unit was added sometime in the past illegally, and it would be neces-
sary for the Latuffs to go to the Zoning Board for nermission to operate
more than two dwelling units .
BOARD ACTION: Mr. Tilton moved to grant a variance of Section 54. 13, to
permit occupancy of a dwelling unit more than 50% below grade , on condition
that a second exitway from the sleeping room, either a larger, escape-type
window or a door to a passage which is excluded by a �ire-separated wall
from the furnace area, be nrovided within four months . Ms . Burg seconded.

PROCEEDINGS: Mr. Cherrier stated he had owned this property since 1960 ,
at w ic time it was being operated as a 10-unit plus duplex building.
Apartments were one to three-room units with cooking facilities and without
private bathrooms , but each apartment �Jas occupied by one person only, and
no more than four persons shared use of one b athroom. The owners occupied
one of the apartments .
A1ice Bijjani distributed a sketch of the basement floor plan, pointing out
that tl�e one unit there lacked a suitable emergency escape route . The
bedroom area was enclosed and iiad no window to provide light and ventila-
tion. She suggested that the bedroom be opened up to the rest of the unit
where there were windows , although these would give only 6 . 3% instead of
the required 10% light and ventilatio�. She suggested that one of the
windows in the adjacent laundry area be altered to furnish an escape route
that would be separated from passage through the furnace area.
BOARD ACTION: Chairman Glassman moved that a variance of Section 54.14
be gxant—eT to permit occupancy of the basement unit where light and ventila-
tion are deficient , on condition that an enclosed emergency escape_ route
be provided in the adjacent laundry area and that the wa11s enclosing
the bedroom of the apartment be removed. He also moved that a variance
of Section 54 . 11 be granted to permit use of the basement unit where the
bathroom is locate d outside of the unit. Mr. Knutson seconded. MOTION
CARRIED AND SO ORDERED.

The matter of electrical service inadeauacies was discussed. Mr. Knutson

groblem, chronically overloaded wiring deteriorates , and 30-amp with
220-volt service is seriously deficient for the number of apartments in
the building.

electrical rec{uirements listed in the electrical report section of the
city' s letter of 3/27/81 be denied. Mr. Gausman seconded. MOTION CARRIED

PROCEEDINGS : Mr. Storey said he was doing extensive rehab work on the
the property and would be bringing it into compliance with the electrical
code , as well as doing the required fire separation work in the boiler
area. He proposed to combine the two third floor units intc� one larger
unit, which would have its own bathroom. On the second floor he would
combine Apts . #3 an d #5, and this too would have its own bathroom. There
would then be no apartments without their own bathrooms .
Alice Bijjani said, by reducing the third floor to one apartment, there
would be no requirement of an additional exit , nor would a smoke door between
the second and third floors be required. With the matter of the exitways
and shared bathrooms taken care of, there was only the problem of insuffi-
cient light and ventilation in the third f2oor area. .

PROCEEDINGS: Ms . Kester. said she was in process of restoring the property
and ad already installed larger windows in the basement area , but she
would need a variance to permit occupancy of an apartment more than SOo
below grade. There were other items that needed attention , but before
going to further expense , she wanted permission to use the area as a
dwelling unit. If_her appeal was granted, she would do all the remaining
wo,rk required.
Alice Bijjani requested that, if the board granted the variance , it be
on condition that the exitway be separated from the heating area.
BOARD ACTION: Mr. Knutson moved that a variance of Section 54.13 be
grante to permit occupancy of a dwelli�g unit more than SO% below grade ,
on condition that the exitway be separated from the heating area by use of
fire-retardant materials . Ms . Burg seconded. MOTION CARRIED AND S0

PROCEEDINGS : Mr. Storey said he was doing extensive rehab work on thc
the property and would be bring}ng it into compliance with the electrical
code , as well as doing the required fire separation work in the boiler
area. He proposed to combine the two third floor units into one larger
unit, which would have its own bathroom. On the second floor he would
combine Apts . #3 and #5, and this too would have its own bathroom. There
would then be no apartments without their own bathrooms .
Alice Bijjani said, by reducing the third floor to one apartment, there
would be no requirement of an additional exit , nor would a smoke door between
the second and thirrl floors be required. With the matter of the exittaays
and shared bathrooms taken care of, there was only the problem of insuffi-
cient light and ventilation in the third floor area.
BOARD ACTION : Mr. Gausman moved that the variance of Section 54. 14, per-
taining to light and ventilation, be grantecl to permit occupancy of the
third floor dwelling unit. Ms . Burg seconded. MOTION CARRIED AND SO
ORDERED.

PROCEEDINGS: Alice Bijjani stated that the buildings were identical in
floor plan. There were two exits for all apartments , one enclosed and
the other not. The fire code requires that all exits in a three-story
building be protected. One alternative to constructing a fire wa11 would
be to fire-rate doors of the apartments .
Mr. Indritz said some of the doors already are fire-rated, but some are
• hollow-core . In addition, the fire insvector told him that the doors
should be equipped with automatic closers . Mr. Indritz said he was appeal-
ing the door closer requirement. He didn� t think these were necessary,
and it would cost about $3,000 per building.
Ms . Bijjani explained that fire-rating a11 doors and putting closers
on them would accomplish almost as much as enclosing the stair tower.
Without these , fire and smoke from any one of the apartments adjoining
the open stairway would quickly spread to other parts of the building.
BOARD ACTION: Mr. Knutson moved that a variance of Section 13.03, per-
taining to stair tower enclosures , be granted on condition that all
apartment doors be fire-rated and equipped with automatic closers .
Mr. Gausman secon ded. MOTION• CARRIED AND SO ORDERED.

There was a discussion of the inspector's report on the presence of com-
bustible material in the boiler area. Mr. Indritz explained that at the
building in question, 555 S. Cleveland, there was no boiler. The area
referred to iaas the caretaker' s workshop. A lawn mower and a snowblower
� were kept in the area during the off-seasons , but were always drained,
spark plugs removed, and cle aned up before storage. Ms . Bijjani said
he should check with the fire inspector as� to proper storage of fuel for
these types of equipment. .
In regard to his appeal of the order to remove extension cords , Mr. Indritz
said this concerned small utility fluorescent lights , housed in metal
structures , attached to the bottom of cupboards above the kitchen sinks .
Apparently, the problem was that they were not grounded. and were not
equipped with three-pronged plugs .
Mr. Knutson advised that the lights should either be wired praperly or
removed, as they were a potential hazard.
BOARD ACTION : Mr. Knutson moved to deny the appeal on Section 54. 12 ,
pertaining to use of extension cords . Ms. Burg seconded. MOTION CARRIED
AND SO ORDERED.

rooms and a sitting room in his b asement. He had applied for financing
under a government program, but final approval was dependent on obtaining
a variance because the basement was more than 50% below grade. His plans
called for putting in escape windows in each sleeping room, and wiring
would be up to code.
Alice Bijjani said it was also important to provide fire separatian
between the heating area and the exitway.
BOARD ACTION : Mr. Tilton moved that a variance of Section 54. 13 be
grante on condition that the heating area• be separated from the exitway
by a fire wa11 and that the sleeping rooms be provided with escape windows.
