APPEARAN.CE: Patrick Sullivan � . -2- S/12/81 - Meeting No. 173 �� � y3� PROCEEDINGS : Mr. Sullivan said that he had completed the work required under the variance granted in June 1980 by the October 15 deadline , but a later inspection by the city had found the fire separation improperly done. The variance was rescinded by the board in February 1981. He had not been notified that his case was. to be discussed and felt the a�tian was unfair without giving him a chance to explain his side of the story. He contacted the city and an inspector came out to describe how the work should be done. A new completion date of April 14 was set, or, if the work could not be done by that time , he was to send a copy of the written contract to the housing code office. His contractor' s wife died in April , so there had been a delay beyond April 14. Alice Bijjani said the work had only been started the previous Friday, May 8. She spoke of numerous efforts to get action on the deficiencies of the property and the slow response from Mr. Sullivan. She said there was still a need for a door closer in the boiler �area, and a bathroom that lacked a han dsink , an electrical outlet, and ventilation. Mr. Sullivan said there was a handsink now, and the other three items were probably done by this time. BOARD ACTION: Mr. Tilton moved that the variance granted in June ,� 1980 , e reinstate , on condition that the handsink, electrical outlet , ventila- tion device , and door closer in the boiler area, be in place as required by the city within one week. The owners occupied one of the apartments . A1ice Bijjani distributed a sketch of the basement floor plan, pointing out that tl�e one unit there lacked a suitable emergency escape route . The bedroom area was enclosed and iiad no window to provide light and ventila- tion. She suggested that the bedroom be opened up to the rest of the unit where there were windows , although these would give only 6 . 3% instead of the required 10% light and ventilatio�. She suggested that one of the windows in the adjacent laundry area be altered to furnish an escape route that would be separated from passage through the furnace area. He proposed to combine the two third floor units into one larger unit, which would have its own bathroom. On the second floor he would combine Apts . #3 and #5, and this too would have its own bathroom. There would then be no apartments without their own bathrooms . Alice Bijjani said, by reducing the third floor to one apartment, there would be no requirement of an additional exit , nor would a smoke door between the second and thirrl floors be required. With the matter of the exittaays and shared bathrooms taken care of, there was only the problem of insuffi- cient light and ventilation in the third floor area. BOARD ACTION : Mr. Gausman moved that the variance of Section 54. 14, per- taining to light and ventilation, be grantecl to permit occupancy of the third floor dwelling unit. Ms . Burg seconded. There were two exits for all apartments , one enclosed and the other not. The fire code requires that all exits in a three-story building be protected. One alternative to constructing a fire wa11 would be to fire-rate doors of the apartments . Mr. Indritz said some of the doors already are fire-rated, but some are • hollow-core . In addition, the fire insvector told him that the doors should be equipped with automatic closers . Mr. Indritz said he was appeal- ing the door closer requirement. He didn� t think these were necessary, and it would cost about $3,000 per building. Ms . Bijjani explained that fire-rating a11 doors and putting closers on them would accomplish almost as much as enclosing the stair tower. Without these , fire and smoke from any one of the apartments adjoining the open stairway would quickly spread to other parts of the building. BOARD ACTION: Mr. Knutson moved that a variance of Section 13.03, per- taining to stair tower enclosures , be granted on condition that all apartment doors be fire-rated and equipped with automatic closers . Mr. Gausman secon ded. MOTION• CARRIED AND SO ORDERED. THE VOTE: Ayes - 6 Nays - 0 . Abstentions - 0 There was a discussion of the inspector's report on the presence of com- bustible material in the boiler area. Mr. Indritz explained that at the building in question, 555 S. Cleveland, there was no boiler. The area referred to iaas the caretaker' s workshop. A lawn mower and a snowblower � were kept in the area during the off-seasons , but were always drained, spark plugs removed, and cle aned up before storage. Ms . Bijjani said he should check with the fire inspector as� to proper storage of fuel for these types of equipment. . In regard to his appeal of the order to remove extension cords , Mr. Indritz said this concerned small utility fluorescent lights , housed in metal structures , attached to the bottom of cupboards above the kitchen sinks . Apparently, the problem was that they were not grounded. and were not equipped with three-pronged plugs . Mr. Knutson advised that the lights should either be wired praperly or removed, as they were a potential hazard. BOARD ACTION : Mr. Knutson moved to deny the appeal on Section 54. 12 , pertaining to use of extension cords . Ms. Burg seconded. MOTION CARRIED AND SO ORDERED. He had applied for financing under a government program, but final approval was dependent on obtaining a variance because the basement was more than 50% below grade. His plans called for putting in escape windows in each sleeping room, and wiring would be up to code. Alice Bijjani said it was also important to provide fire separatian between the heating area and the exitway. BOARD ACTION : Mr. Tilton moved that a variance of Section 54. 13 be grante on condition that the heating area• be separated from the exitway by a fire wa11 and that the sleeping rooms be provided with escape windows.
