An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes §462 . 357 and �64.210
of the Legislative Code, the Port Authority of the City of Saint Paul,
Burlington Northern, Inc. , City of Saint Paul and Koppers Campany,
Inc. duly petitioned to rezone an. area north of DeCourcy Road between
Lexington and Jones from RM-2 to I-1, and from I-1 and I-2 to RM-2,
RM-3 and B-2 for the purpose of constructing housing, commercial,
office, and light industrial structures in the Energy Park, the
petition having been certified by the Department of Finance and
Management Services on May 6, 1981 as having been consented to by
at least 67� of the owners of the area of the property to be rezone�.,
and further having been consented to by at least twa-thirds of the
owners of the property situated within 100 feet of the total conti�--
uous descriptions of real estate held by the same owner or any party
purchasing any such contiguous property within one year preceding
the date of the petition; and
WHEREAS, The current Planning Committee on May 21, 1981 conducted.
a public hearing for the purpose of considering the rezoning petition,
and pursuant to 5ection 107 .03 of the Administrative Code, submitted
its recommendation to the Planning Commission that the petition be
granted; and
WHEREAS, The Planning Commission considered the rezoning petition
at its meeting held on May 22, 1981 and recommended that the City
Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Couneil an

WHEREAS, A public hearing before the City Council, having been
conducted on June 2, 1981 where all interested persons were heard,

This is written in response to the petition of the Port Authority of the
City of St. Paul and Koppers Company to rezone an area north of Decourcy
Road and east of Jones (legal description provided by applicant) from
I-1 to RM-2, and to rezone an area along Rosen Road west of Jones (see
legal description) from RM-2 to I-1 in order to construct light industrial ,
commercial , and residential structures in the Energy Park.
On May 21 , 1981 , the Zoning Committee of the Planning Commission conducted
a public hearing on this case and recommended approval of the rezonings
on a vote of 6 to 0.
The Planning Commission considered the Zoning Committee's recommendation
on May 22, 1981 , and recommended approval of the rezonings on a vote of
13 to 0.
This matter is scheduled for hearing before the City Council on June 2,
1981 .

A. SUFFICIENCY: The ar�lication was filed on a consent petition subscribed and sworn to
before a notary pubiic on April 24, 1981 ; declared sufficient by the Finance Department
� on May 6, 1981 ; and received in the Planning Office on May 12, 1981 . Nine parcels
were eligible, 6 parcels were needed, and 9 were obtained. The purpose of the rezoning
is stated on the petition as constructing light industrial , eommercial and residential
structures in the Energy Park.
B. SITE/AREA CONDITIONS: The area to be rezoned from I-1 to RM-2, north of Decourcy, east
of Jones, and just southwest of the Burlington Northern Shops area, is currently a
gravel pit. The principal existing use of the area to be rezoned from RM-2 to I-1 ,
along Rosen Road west of Jones, is the old Midway Stadium parking lot.
C. FINDINGS: .
l . The St. Paul Land Use Plan identifies the site as a portion of tf�e Energy Park •
_ employment-housing mixed use cluster. .
2. The site is in District 10. The District 10 Plan indicates the site should be
used for industrial uses and housirig.
3. The Planning Division Staff is revif�wing the Energy Park plan for consistency with
the Comprehensive Plan. The uses s�ggested for the area to be rezoned do not
�onfl i ct wi th the Compreh�r�si��e P1 an.
4. The proposed uses and rezonings for this portion of Energy Park are consistent
with the City's Comprehensive Plan, and would be beneficial to the surrounding
community.
D. STAFF RECOMMENDATION: Based on findings 1 through 4 above, staff recommends approval
of the proposed rezonings. -

Dear Sir:
This is written in response to the petition of Burlington Northern to
rezone the Burlington Northern passenger car shops area, north of
Decourcy Road between Lexington and Jones , from I-1 and I-2 to RM-2,
RM-3, and B-2 in order to construct housing, commercial , and office
structures in Energy Park.
The proposed rezonings are described on the attached map, which divides
the area to be rezoned into eleven separate areas , each with its own
proposed rezoning (legal descriptions provided by applicant) . In the
four cases where the map shows two proposed rezonings for a single area,
the final proposal is for B-2.
On May 21 , 1981 , the Zoning Committee of the Planning Corr�nission
conducted a public hearing on this case, and recommended approval of
the rezonings on a vote of 6 to 0.
The Planning Commission considered the Zoning Committee's recommendation
on May 22, 1981 , and recommended approval of the rezonings on a vote of
13to0.
This matter is scheduled for hearing before the City Council on June 2,
1981 .

A. SUFFICIENCY: The application was filed on a consent petition subscri5ed and sworn to
be�or ae notary public on May l , 1981 ; declared sufficient by the Finance Department
on May 6, 1981 ; and received in the Planning Office on May 12, 1981 . Twelve parcels
were eligible, 9 parcels were needed, and 9 were obtained. The purpose of the rezoning
is stated on the petition as constructing housing, commercial , and office structures .in
Energy Park.
B. SITE/AREA CONDITIONS: The area to be rezoned is the Burlington Northern Como Shops
ar�a, which fronts on Decourcy Road. A railroad right-of-way runs along the northern
border of the area to be rezoned. An I-1 Industrial strip of land between 150' and
160' wide runs between the area to be rezoned and the R-3 single-family zoned Como
Park between Lexington and Hamline, and between the area to be rezoned and an apartmen.t
complex west of Hamline. There are existing and planned indust.rial uses south of
Decourcy Drive, across from the site.
C. FINDINGS: . _
1 . The St. Paul Land Use Plan identifies the site as a portion of the Energy Park
employment-housing mixed use cluster.
2. The site is in District 10. The District 10 Plan states , "Residents feel that
future commercial development should concentrate i�� a core area." It goes on to
state, regardir�y the proposec: commercial �ev�loprrer�t i3� En�rgy Park, "Commercial
growth will be strategically located on a parcel of land along the west side of
Lexington Parkway. . . .Adequate consideration should be given to ensure that this
commercial use meets the needs of the Energy Park and adjacent communities."
3. The Planning Division Staff is reviewing the Energy Park plan for consistency
with the Comprehensive Plan. The uses suggested for the area to be rezoned do
not conflict with the Comprehensive Plan. �
4. The area to be rezoned is divided into eleven separate areas , each with its own
proposed rezoning. Because plans have not yet been finalized, there are two
proposed rezonings for a single area in four of the eleven cases. There will be
only one proposed rezoning for each area by the time of the City Council hearing
on this case. The final proposal must ensure that access to commercial parking -
lots is not ar_ross residentially zoned land.
5. The proposed uses and rezonings for this portion of Energy Park are consistent
with the City's Comprehensive Plan, and wouid be benefic��al to the surraunding
community.
6. The strip of land between �he �rea to be rezoned and Jessamine, which is currently
a main line rail corridar and zoned ?-� , is owned by the applicant. I�lith the nevr
zoning as proposed for the site, uses permitted under an I-1 zoning district would
be substantial1y different from the prevailing uses in the surrounding area; this
could cause disharmony.
D. STAFF RECOhiM�PlDATION: 6ased on findings 1 through 6 above, staff recommends approval
of the proposed rezonings, and that the strip of land along the i�orth s�ide o�� ti�e
area �o be rezened (.the main line railroacl right-of-way currently zoned I-1 and ownecf
by the applicant� be rezoned to correspond to the zoning proposed for the site (Rh1-3
on the east .portion and B-2 on the west) .
