Villaume III �� Deputy City Attorney RE: Claims of Thoma.s Blanck and Robert Lushanko Thoma.s Blanck is an architect who, on February 15, 1978, had offices located in the Commodore Hotel. It was Mr. Blanck who first became aware of the gas leak and assisted in warning other guests and tenants of the building. He was standing in the north parking lot when the large explosion occurred and sustained a minor injury. Mr. Blanck' s architectural office was totally destroyed by the fire and explosion. He submitted a total claim of $7,636.62 which detailed almost each and every item which was lost. The claim was eventually resolved in the amount of $7,000 and pursuant to the Court' s findings the City of St. Paul is liable for 10%. Robert Lushanko was in the vicinity of the hotel when he was caught up in the traffic congestion of the fire equipment and being unable to leave got out of his car and was watching the activities when the explosion occurred. He was struck in the face by flying glass, requiring out-patient treatment at the hospital where the wound was closed. Approxima.tely five weeks later he returned to the doctor where an additional piece of glass was found and removed. He claims that the wound continues to be bothersome and that cosmetic surgery remains possible. His total expenses were $249.50 and his claim was settled in the amount of $2,500. Again, by reason of the Court' s finding, the City of St. Paul is responsible for $250.00. The amounts have been paid by Northern States Power Company on our behalf and this resolution would effect our reimbursing them for payments on our behalf.
