authorized and directed to enter into an Agreem�ent with the Minnesota
State Fair to hold a Fireworks Display at the Minnesota State Fairgraunds
on Saturday, July 4, 1981 (rain date - July 5, 1981) , and further
RESOLVED, That the City of Saint Paul hereby sha11 hold
harmless and indemnify the Min�esata St`ate Fair tor liability incurred
on accaunt of any claim by any person w�rking at or participating in
the Fireworks Display who suffers injury to his/her pexson or property
anywhere on the Fai.rgrounds as a result of the acts or omissions of the

P�TRPOSE AND RATIONALE FOR THI� ACTION: Entering into an agreement with the r—
Minnesota State Fairgrounds for the lease of the Grandstand Seating Area and
Infield, plus Parking Area for the period, Saturday July 4th Fireworks Display,
(Sunday July 5th rain date) anG Friday July 3rd and Sunday July 5th for set-up
and tear down. There will be a basic rental for the seating of $1,000 and 5%
of the gross parking, gate and grandstand ticket sales receipts over $10,000.

a lease agreement, whereby Lessor leases to Lessee ar�d Lessee hires from Lessor
the Minnesota �State Fair Grandstand Seating Area & Infield, as well as all parking
areas with the exception ot Bloc�c 53 and the Campgrounds
for the public conduct of a Firework Display . "

Lessee shall be responsible for any and all costs incurred by Lessor as a result
of this usage, including but not limited to all property loss, and/or damage to
l.essor' s property caused directly or indire.ctly by Lessee, its agE�rlts, employees,�
guests, participants and/or attendees,
It is required that Le�,see post an advance deposit of $ 8,070.0o with this office
on/before Mondav, June 1, 1981 r Failure to post said
depcsit as specified shall work an automatic cancellation of this lease. Zf �.essee
should, for any reason, cancel after' posti,ng said payment, lessor may retain as
iiquidated damage, the ful] deRosit and/or a sum equal to the expense already
incurred in preparation for this rental . Lessee further agrees to make full
payment of outstanding balance within 30 days of invoice date.

It is agreed that in the event any person on the grounds of the Minnesota State
Faii� for the purpose of �vorking at, participating in and/or attending the �
City of St. Paul Firework Display , during the period Of
Friday, July 3, 1981 through Monday, July 6, 1981 , H1h0 suffers injury to h7S
pers�n or property anyti�here on the Fairgrounds as a result of the acts or
omissions of the Lessee, Lessee's agents, participants and/or attendees and makes
claim against the Minnesota State Fair for such injury, that the
City of St. Paul, Dept. of Community Services shall hold harmless and indemnif�

the Minnesota State Fair for liability incurred on account of any such claim.
Lessee is required to provide a policy of general liability insurance in an amount
and form satisfactory to Lessor vahich will protect Lessor from the aforesaid
third party claims. A certificate of the foregoing insurance must be provided for
Lessor's review and files no later than Monday, June 1� 1981
Failure to provide said certificate as specified shall 4rork an automatic cance]lation
of this� lease.
Arrangements for Lessee' s physical needs must by made by contacting Lessor's
Asst. Supt. of P1aht Services, .Phillip Fisher(612) 642-2214. Lessee agrees to meet •
with Lessor no later than Monday, June 1, 1981
to arrange the physical needs for this facility usage. Please have the appropriate
individual sign both copies of ti�is lease and return the original as specified tQ
the undersigned before Monday, December i, 1980 � Failure to
execute and return as specified shall result in the cancellation of i:his offer.

Lessee must file a :«=oters outline with Lessor 30 days in advance of event date,
with said outli-�e tc :�clude: detailed outline of events, performances, etc. in
connection with this �-.�ent, na�es of all performers, performance times, exact
stage, lighting anc scsnd requirements as well as detailed security, crowd control,
parking, traffic anc �anitation provisions..
A detailed seat�ng s�ecification chart, ticket price scale, ticket manifest and
ticket reconcil���c:r� ��aterials must be provided for Lessors �nspection and
files in connec�ion r:i�h the event. �
' All posted parking and traffic restrictions shall be in full force and effect
aurir.o the period o� t:�is rental. Lessee shall be responsible fqr r�aintaining
parl;�no and traffic rules and regulations.

The minimum number of security required for this event will be thirty five patrol
oificers and ten mounted patrol officers. Ten officers must start their duty at
4:00 P.M. , ten officers must start at 5:00 P.*1. , and the remainder should begin
their duty at 6:00 P.r1. on July 4, 1981. T�ao officers should cover the grounds
fro� Noon to 4:00 P.:•1. on July 4, 1981. �
Due to the scheduling of other events on the Fairgrounds, Lessee's movement on the
grounds will be restricted during the period of this rental. Please note the
barricades that will be posted during this rental, on the attached map.
