RESOLVED, that the Council of the City of 5aint Paul does
hereby approve an agreement whereby the Snelling-Hamline
Community Council will be granted permission to use a portion
of City owned property located at the northeast corner of
Hamline and Ashland Avenue, acquired for th� short line road
purposes, for an urban garden project for the 1981 growing
season, with no compensation to be paid to the City for the
use thereof, subject to the conditions contained in said
agreement including the provision that the Community Council
will provide public liability insurance protecting itself,
its assignees, agents and the City of Saint Paul for damage
to persons or property in minimum amounts of $100,000.00 per
loss and $300,000.00 per accident, agreeing to protect, hold
harmless and indemnify and defend the City of Saint Paul from
any and all claims or causes of action arising out of the use
of this property for an urban garden project and agreeing to
� maintain the property and restore it to its original condition
when requested to do so by the Director of the Department of
Public Works, and the proper city officers are authorized and
directed to execute an agreement on behalf of the City of
Saint Paul.
