WHEREAS, The Council of the City of Saint Paul by Council
Resolution C.F. 276266, adopted January 27, 1981, and C.F. 276384,
adopted February 17, 1981 did separately approve the puk�lic sale
of differen�k tax forfeited property in the City of Saint Paul; and
WHEREAS, A request has been made to the City Cour..cil to amend
C.F. 276266 so as to provide that the tax forfeited property re-
ferred to therein be released to the Housing and Redevelopment
Authority of the City of Saint Paul for private redevelopment in-
stead of publicly selling the property; and
WHEREAS, A request has been made to the City Council to delete
condition #2 of C.F. 276384 as a permanent easement for the catch
basin has been recorded_ and in the event Curfew Street is vacated
in the future, a condition to be imposed therein would be that an
easement be retained for the catch basin, if needed; no suxvey required.
NOW THEREFORE BE IT RESOLVED That the Council of the City of
Saint Paul by this resolution hereby amends Council Resolutions
C.F. 276266, adopted January 27, 1981, and C.F. 276384, adopted
February 17, 1981 as specifically requested above.

� That part of Lot 3, Block 12, Desnoyer Pa.rk which lies Southeaster]y
� of a line running pa.rallel with and distant 30 feet Southeasterly of
the follvHring described line; Beginning at a point on the east line
of Block 1, Glendale Addition, distant 592.8 feet north of the South-
easterly corner thereof; thence running Northwesterly at an angle
of 91° 5�+' with the ea.st line of Block 1 mea.sured f�om south to west
for 5�+9.96 feet; thence deflect to the left at an angle of 9° 35' ,
for 900 feet and there terminating; ,,

under the follawing terms and conditions: �i
1. That a 10 foot perm�..nent easement must be r.eta.ined centered on II
the existing catch basin lead across said Lot 3.

Restrictions within the easement area are as follcx,rs:
a) That no building, structures, or trees are permitted
within the easement area, or ar�y temporary structures,
material storage, fixture or other objects that will
prohibit normal access to sewer facilities for m�inte-
nance purposes. _
b) That no change from the existing grade is permitted with-
out written permission from the Sewer Engineer
�) That no change in surfacing within the easement area is
permitted without written permission from the Sewer
Engineer.

location of the street right-of-way to be retained and the
