That in consideration of the sum of One Dollar ($1.00) , the City grants to Association the use of the West one-third of Facility for bocci ball courts. 2. That association agrees to construct ten (10) full-size bocci ball courts and erect temporary lighting all at no cost,to City. " 3. That Association agrees to bear all costs in use and maintenance of the Facility. 4. That during the mor.ths between May 1 and October 31 of each year, Association shall have exclusive use of Facility on Monday, Tuesday, and iVednesday nights from; 6:00 p.m. to 10:00 p.m. 5. That Association will not permit the use ot' intoxicatin� liquor, in�oxicating malt liquor, non-intexicating malt liquor or alcoholic beverages on site unless proper licenses are obtained. 6. That Association is responsible for all clean-up of site after each r.ight of play. 7. That Association members and players must not park in front of residential horaes on Burr and Fred Streets, and should use school site for such purposes. 8. That Association will conduct no more than four (4) tourriaments per year and must request in writing the use of site for said tournamen�s one month nrior to the tournament date. ' � � ������ 9. . That Association agrees that other than the dates and times of league play and tournaments, the use of the courts and site will be for r.eighbor- hood residents. 10. That any alterations, other than above, to the portions of the Fac- ility granted to Association hereunder, shall only be done with the prior appro- val of the City's Superintendent of Parks and Recreation and performed under his direction and control. 11. That Associatior� will save and hold harmless the City from any and all claims of whatever kind that may arise out of it and its membership and invitees' use of the FAcility. In order to give this indemnification of the City by Association full force and effect, Association agrees to provide and keep in force during this Agreement, at its own expense, general public liability insurance in the amount of Three Hundred Thousand Dollars ($300,000.00) per individual injury or death. Such insurance as referenced herein shall name the City as a co-insured and shall be approved by the City Attorney. 12. That this Agreement may be terminated without cause upon thirty (30) days written notice of one party to the other. 13. That Association, during any period of construction, is an independent contractor, and not a regular employee of the City and Accordingly, is not entitled to any of the benefits of regular employees of the City.
