An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes �462 .357 and �64.210
of the Legislative Code, Richard Varberg duly petitioned to rezone
Lot 1, Block 2, Lake Park Addition, located on the southwest corner
of Arona and Como from B-3 to RM-2 for the purpose of using an
existing structure as an apartment building, the petition having
been certified by the Department of Finance and Management Services
on November 14, 1980 as having been consented to by at least 67� of
the owners of the area of the property to be rezoned, and further
having been consented to by at least two-thirds of the owners of
the property situated within 100 feet of the total contiguous
descriptions of real estate held by the same owner or any party
purchasing any such contiguous property within one year preceding
the date of the petition; and
WHEREAS, The current Planning Committee on December 18, 1980
conducted a public hearing for the purpose of considering the re-
zoning petition, and pursuant to Section 107 .03 of the Administra-
tive Code, submitted its recommendation to the Planning Commission
that the petition be granted; and
WHEREAS, TYie Planning Co�nznission considered the rezoning
petition at its meeting held on December 19, 1980 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

WHEREAS, A public hearing before the City Council, having been
conducted on April 23, 1981 where all interested persons were heard,
and the Council having considered all the facts and reeommendations
concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the zoning map of the City of Saint Paul, Sheet No. 2,
as incorporated by reference in Section 60 .401 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on the southwest corner of
Arona and Como, being more particularly described
as Lot l, Block 2, Lake Park Addition, be and is
hereby rezoned from B-3 to RM-2 .
Section 2 .
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Madam:
This letter is written in response to the petition of Richard Varberg to
rezone property at 1195 Arona Street from B-3 (General Business District)
to RP1-3 (_High-Density, High-Rise Multiple Family Residential District) in
order to allow the owner to continue to use it as an apartment building.
On December 18, 1980, the Current Planning and Zoning Committee conducted
a public hearing on this case, at which time the applicant requested an Rh1-3
zoning but also indicated that an RM-2 (Medium Density, Low Rise f�lultiple-
Family Residential District) zoning would be acceptable. Two letters were
received; one in support of the RM-3 zoning and one from Como Community
Council in opposition to the RM-3 zoning but in support of RM-2 zoning for
this property. The Committee recommended denial of the requested RM-3
rezoning but approval of the RM-2 rezoning on a vote of 4 to 0.
The Planning Commission considered the Current Planning and Zoning Committee's
recommendation on December 19, 1980, and denied the RP1-3 rezoning petition
but recommended an RP�1-2 rezoning for 1195 Arona Street on a vote of 19 to 0.
The matter of the requested rezoning is scheduled to be heard by the
City Council on April 23, 1981 . Please notify me at least by April 22, 1981 ,
if any member of the City Council wishes to have slides of the site presented
at the City Council public hearing.

letter was received from the District 10 Como Co►�nunity Cauncil supporting
the variances irr comt�ina�ion with an Rt�-2 re�or°�ing. In addition, the
Zoning Com�nittee and Planning Con�nission supported the RM-2 rezoning
appiicatian.
Paui Varberg, 1466 Como, representing the appellant, stated that he has
been managiny the propert;y for the last 2 y�ars. �!e said they have
applied for an RM-2 rezoniny to allow for the 6 unit apartment building
and are now request�rig � density and area variance.
Hearing no further testimony, Ms. P1orton closed the p�blic h�aring portit�n
of the meeting. ,
Mr. Grais made a motion to approve the �ariances req�ested based on ' , •

On December 18, 1980, the Zoning Committee of the Planning Corrgnission considered
your petition to rezone 1195 Arona Street from B-3 {General Business District)
to R�1-3 (FEigh Density, High-Rise Mu7tip7e-�Fan�ily Resider�tial Dis�rict) in ord�r
to ailow you to continue to use the property as a six-unit apartment building.
The Como Corrununity District 10 Council supports the rezoning of this property
to RM-2, but not RM-3 due to their desire to avoid the possibility of a high ris�
on this site which would be allowed with an RM-3 re�on;ng. The Zoning Committee
agreed with this position and rationale and voted to deny the RM-3 rezoning but to
approve an RM-2 r�zoning for this property.
On December 19, 1980, the Planning Canmissivn considered the Zoning Corr�nittee's
recommendation and denied the RM-3 rezoning petition but recornmended an RM-2
re2oning for ]195 Arona Street on a vote of 19-0. �
The City Council will schedule another public hearing on this matter and you wi11
be notified of the hearing date.

letter changing their original ,position on this matter. They stated that they
were against the RM-3 but would support an RP�i-�2 rezoninr.

A. SUFFICIENCY: The application was filed on a consent petition subscribed and sworn to
before a notary public on October 17, 1980; declared sufficient by the Finance D�part-
ment on November 14, 1980; and received in the Planning Office on November 24, 1980.
Eight parcels were eligible, five parcels were needed, and seven were obtained. The
purpose of the rezoning from B-3 (General Business District) to RP�1-3 (High Densityg
High-Rise Multiple-Family Residential District) was stated on the petition as:
allowing us to continue to use it as an apar�ment building.
B. FRONTAGE & AREA: This corner site is rectangular in shape with a 120 foot frontage on
Arona Street and a 54.9 foot frontage on Como Avenue, for a total area of 6,588 sq. ft.
C. SITE/AREA CONDITIONS: The site is occupied by a 2-story white stucco building set at-
grade on the north and east property lines. The part of the site not occi�pied by the
building is level and contains a parking lot in the rear of the structure surrounded
b,y a chain link fence. Tc the west is a parking lot for the Midtown Raquetball G1uk�
located across the street. Further toward the west are t�ro houses and a community
business district which also extends across Como just north of the site. To the e�st
and south are single farnily and duplex housing units. Ther,e are RM-2 Muliiple Family
Districts a blocic south of the site, a hal�-block to the east of the site and three
blocks north of the site. I� is lacated adjacent to a Community Business District with
a grocery stor� only 1? block away and on two bus lines.
D. ZONING NISTORY: On February 29, 1980 Dale Uarberg, brother of the applicant, filed a
consent petition seeking a rezoning to RM-2 for this properi:y. On May 6, 1980,
Daniel Varberg, son of the applicant, filed for a density variance for this property.
On h1ay 15, 1980, the Current Planning and Zoning Committ�� laid over the rezoning
request until June 5, 1980 at the request of Dale Varberg and his att�rney. At th��t. t�r�rt�
there was some question whether density variances of this type could in fact be legally
c�ranted by the Board of Zoring Appeals. �n May 27, 19�s0, the Board of Zoning Ap�euls
laid over the requested variance until September 23, 1980 at the request of
Daniel Varberg based on the understanding that Varberg would seek the variance
following the needed rezoning. On J!�ne 5, 1980, the CurrE>nt Planning and Zoning
Committee laid over the rezoning request until Septemb:er 18, 19�0 at the request of

4. In 1975 the site, along with both sides of Como between Snelling and Arona,
was rezoned B-3 (General Business District) as part of the citywide zoning
change. The site was not considered for RP�-2 zoning in 1975 in part because
a dentist office still functioned at 1195 Arona.
5. The building is eligible for legal nonconforming status for four apartments
since the nonconforming use of the building was in existence when the 1975
Zoning Ordinance went into effect.
6. The Building Department, after an inspection requested b,y Richard Varberg in
August 1978, issued a Certificate of Occupancy for four units. Dal� Varberg
indicated that Richard Varberg acquired the property immediately following
this inspection. Dale Varberg also claimed that the current zaning situation
was not explained or clarified for the new owner at this time.
7. The Building Department, based on an inspection in September 1979, found two
additional units had been added over the previous year. Since four units ir�
this structure were deemed legal nonconforming, the two additional units
were found to be in violation of the Zoning Ordinance. In addition, no
permits were taken out in either 1978 or 1979 for the installation of two
additional units in this structure.
8. According to Dale Varberg, the changing economic conditions and a high demand
for small rental units prompted him to alter the structure through dividxng
up the unoccupied first floor commercial space into two one-bedroom apartments.
9. The District 10 Como Community Council supports the requested rezoning to R��-3
for this property but would have preferred an RP1-2 rezoning in order to avoid
any possibility of a high rise on this site in the future.
10. The Oistrict 10 Plan calls for maintaining the low and medium density of the
residential community as svell as incorporating energy considerations into
housing in the at�ea. A rezoning to RM-2 would help this existing medium density
residential structure to blend better into the residential character of the
area and allow its residents to reap the benefits of its compactness as an
energy saver. A rezoning to RP9-3 could introduce the possibility of very high
density development in a generally low, to medium density area, and would be
in conflict with the District 10 Plan.
11 . With several RM-Z Multiple Family Districts in the immediate vicinity, a
rezoning to RM-2 wauld help to preserve the residential character of the
immediate neighborhood and is generally in keeping with the housing policy
and energy gvals of the city. Uses permitted under an RM-2 rezoning are not
substantially different from the nature of the prevailing uses in the surrounding
area and would not result in disharmony. Uses permitted under an RM-3 rezoning
are in f'act substantially different from the nature of the prevailing uses and
might result in disharmony. -
12. The applicant originally applied for a rezoning to RM-2 and based on the advice
that a density variance could only be granted for an RM-3 rezoning, the applicant

On March 26, 1980, a petition to rezone pr�p�rty at 1195 Arona Street from
B-3 to RM-2 was received b,� the Ci�y. On April 16, 1980, the petition a�as
deemed suffic;ent by the Department of Finance and Management. On May 15,
1980, the Curren� Planning and Zon�ng Committee first heard the case. At
that time, the applicant's request for a density variance from the Board of
Zoning Appeals was in doubt as to its legality and it was continued to -
June 5, 1980. At the June 5y 1980 Current Planning and Zoning Committee
hearing, the attorney for Mr. Uarberg request�d and received a con�cinuance
on the r�zQr.ing matter until September 18, 198Q.
On Friday, September 12, 1980, Paul Varberg, the nephew of Dale Uarberg, the
rezoning a�plicant, cr�ntacted me and I revievaed the situation with him. He
indicated tnat he and his brother, Daniel Varberg, are leaning toward seeking
a rezoning t� RN�-3 instead of ti�e previously requested RM-2 zone to allow the
13 rooms in the illegally converted apartmeni� structur�, but th,at they have
not fully decided what ta do. I mentioned to him that seeking a RM-3
rezoning wi11 require a new petition, another notice ofi` sufficiency, and a
withdrawal of their previously applied for rezonirig to RM-�2 from B-3.
Today, Paul Varberg contacted me and informed me that they will be attempting
to rent out the bottom space fr�r office use ar business uses acceptablc in a
B-3 zone. ihey interid to advertise for abaut 10 days , until approximateiy
October 1 . If they ar� unable to rent it auf; for busir�ess purposes, then
they will reapply for an RM-3 (High Density High-Rise Multi-Family District)
zone. In any case, he will be submitting a letter withdrawing their original
request for a rezoning to RN!-2. A copy af his letter �hould be available at
the September 18, 1980 Current Planning and Zoning Corrmittee hearing.
