RESOLVED, that upon execution and delivery of a release
in full to the City of Saint Paul, the proper City officials
are hereby authorized and directed to pay out of the Tort
Liability Fund, 09070-511-328, to Frank B. Martin and Nancy
J. Ma.rtin, husband and wife, and T. J. Salmen, their attorney,
the sum of Eight Thousand Five Hundred Dollars ($8,500.00) in
full settlement of their claim for dama.ges sustained on
February 15, 1978, at the Commodore Hotel, as more particularly
set out in the communication to the City Council of April 4, 1978.

RE: Claim of Frank B. Ma.rtin
Frank B. Ma.rtin was injured in the Commodore Hotel explosion on
February 15, 1978. He had just arrived in the north parking lot
in anticipation of a squash match when he observed that a fire
was taking place in the northeast corner of the building. While
standing outside of his car, the second and much more severe
explosion occurred injuring Mr. Martin.
Mr. Martin sustained second and third degree burns to his face
and hands, numerous cuts, debris imbedded in his body, loss of
muscle tissue and disfigurement of the right leg, and loss of
function to his leg estima.ted at between 10 and 20 percent.
Mr. Martin was employed as a professor of statistics at the
University of Minnesota and sustained some loss of income from
a consulting business which he also operated. The trial court
had previously concluded tha.t Mr. Martin was in no way responsible
for his injuries. The court found in the earlier trial that
Northern States Power Company was 80% responsible, Grudem Brothers
was 10% responsible, and the City of Saint Paul was 10% responsible.
The claim of Mr. Martin has been resolved in the amount of $108,500.
Of that figure, $100,000 is being paid by Northern States Po�r
Company and Grudem Brothers, while the City of Saint Paul is con-
tributing $8,500.
The City Attorney' s Office suggests that this settlement be approved.
