An Ordinance amending C1�apter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, �462 .357 and �64.210
of the Legislative Code, the Housing and Redevelopment Authority of
the City of Saint Paul duly petitioned to rezone the vacated street
accruing, and Lot 2 except the easterly quadrangle part measuring
98 .8 feet on the North line, and Lot 3 except the easterly quad-
rangle part measuring 94 feet, Block 35, West St. Paul Proper,
located on the north side of Concord Street and south of Delos,
from RM-1 to P-1 for the purpase of constructing a parking lot for
a restaurant, the petition having been certified by the Department
of Finance and Management Services on January 12, 1981 as having
been consented to by at least 67� of the owners of the area of the.
property to be rezoned, and further having been consented to by at
least two-thirds of the owners of the property situated within 100
feet of the total contiguous descriptions of real estate held by
the same owner or any party purchasing any such contiguous property
within one year preceding the date of the petition; and
WHEREAS, The current Planning Committee on February 19, 1981
conducted a public hearing for the purpose of considering the re-
zoning petition, and pursuant to Section 107 .03 of the Administra-
tive Code, subinitted its recommendation to the Planning Commission
that the petition be granted; and
WHEREAS, The Planning Commission considered. the rezoning
petition at its meeting held on February 27, 1981 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

WHEREAS, A public hearing before -the City Council, having been
conducted on April 9, 1981 where all interested persons were heard,
and the Council having considered all the facts and recommendations
concerning the petition; now, therefore,
THE . COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 19,
as incorporated by reference in Section 60.40T of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on the southwest corner of Avon
and Summit, being more particularly described as the
North 190 feet of Lats l, 2 and 3, Block l8, Summit
Park Addition, be and is hereby rezoned from R-2 to
RT-l.
Section 2 .
This ordinance shall take effect and be in farce thirty (30)
days from and after its passage, approval and publication.

Dear Sir:
This letter is written in response to the petition of the Housing and Redevelopment
Authority to rezone property on the east side of vacated Starkey Street between Delos
and Isabel from RM-1 (low density, low rise multi-family residential ) to P-1 (parking)
to allow construction of a parking lot for Boca Chica Restaurant.
On February 19, 1981 , the Zoning Committee conducted a public hearing on the case.
The only correspondence received on this case was a letter from the West Side Citizens
Organization in support of the rezoning. The Zoning Committee recommended approval
of the rezoning petition on a vote of 6-0.
The Planning Commission considered the Zoning Committee`s recommendation bn February 27,
1981 , and approved the rezoning on a vote of 14-0.
The matter of the requested rezoning is scheduled to be heard by the City Council on
April 9, 1981 . Please notify me at least by April 8, 1981 , if any member of the City
Council wishes to have slides presented at the City Council public hearing.

HOUSING & REDEVELOPMENT AUTHORITY (#8811 ) : A request to rezone from R��-1 to
P-1 to provide parking space for Boca Chica Restaurant at 11 Concord Street.
Joe Gomez, representing the Housing & Redevelopment Authority, was present.
There was no opposition present at the hearing.
Ms. Daykin showed slides of the site and reviewed her staff report with a
recommendation for approval . A letter was received from the !Jest Side
Citizens Organization in support of the rezoning.

Dear 1�Zr. Gomez:
At the regular tVSCO Board meeting on Tt�esday, Jan. 6, 1981, an annu�.¢zce-
ment about a parking lot next to the Boca Chica was made. Althcugh WSGO
has received no formal notice of the rezoning yet, the Board decided
to go on record in it's support. Board members were aware of the parking
and traffic problems on tihe corner and agreed that Iand between the Fire
Station and the Restaur�it was a good place for off street parking.
Mr. Frias and the Restaurant add much more than local flavor to the West
Side. As a long time supporter and sponsor of 1Vest Side events it gives
us pleasure to be able to support Mr. Frias and hope for the continued
expansion and prosperity of one of St. Paul's finest Restaurants.

60.570 P-1 VEHICULAR PARKING DISTRICT:
60.511 INTENT:
The P-1 Vehicular Parking District is intended to permit the establishment of
off-street parking lots to be used solely for off-street parking of private
passenger vehicles as a use incidental to a principal use. The district will
serve a use district which has developed without adequate off-stre�t parking.
60.512 PRINCIPAL USES PERMITTED:
Premises in such di�stricts shall be used only for an off-street vehicular
parking lot and shall be developed and maintained subject to such c�dltion�
as are hereinafter required.
60.513 REQU�RED CONDITIONS:
a. The pdrking lot shall be accessory to, and for use in connection w1�
one or more businesses, industries, institutions, or multi-famlly
residences containing four (4) or more dwelling units, located in
�djoining districts. There may be a private drivewa�y or publlc street
or public alley between a P-1 district �nd the district to be served.
b. The parking lot shall not be used during hours when the principal uSe
is not in operation. During such periods the parking lot shall be
inaccessible for public use. When there is a written agreement between
two or more buildings or uses to share a parking lot in a P-1 dis tri�t
. in accordance with Sectlons 62.103(e) and 62.1U3(f), then the parking
lot may remain open for all the hours of operations of the buildings
or uses.
c. The parking 1!ot shall be used solely for parking of private passenger
vehicles, and shall not be used as an off-street loading area.
d. No cormiercial repair work or service of any kind, or sale or displ�y
_ th�reof, shall be conducted in such parking lot.
e. No signs of any kind, other than signs designating entrances, exits
and conditions of use, shall be maintained on such parking lot.
. f. No building other than that for the shelter of attendants shall be
erected upan the premises and it shall not exceed ten (10) feet in
height.
g. Applications for P-1 District rezoning shall be made by submitting a
dimensiona) la�yout of the area requested showing the intended parking
plan.

A. SUFFICIENCY: The application was filed on a consent petition declared sufficient by the
inance Department on January 12, 1981 , and received in the Planning Office on January 23,
1981 . Six parcels were eligible .to sign, 4 were needed, and 5 parcels were obtained.
B. PURPOSE: The purpose of the rezoning is to provide parking space for Boca Chica
ek�staurant at 11 Concord Street.
C. SITE & AREA CONDITIONS: The parcel is 12,609 square feet in area. It slopes down from
street grade. Surrounding land uses include Boca Chica Restaurant to the north, Fire
Station #6 to the south, various commercial uses on Wabasha and Concord, and Torre de San
Miguel apartments north of Delos Street.
D. HISTORY: The site was zoned corrunercial under the 1922 Zoning Ordinance and was designated
Ri�1-� under the 1975 Ordinance.
E. FINDINGS:
l . Boca Chica Restaurant currently provides no off-street parking. It is an existing
building which was recently expanded and is therefore only required to provide
parking for the expansion.
2. The site plan indicates 18 parking spaces will be provided, which more than meets
the requirements of the Zoning Ordinance.
3. The District 3 Plan states that the availability of off-street parking for residential ,
business and institutional uses in the district is inadequate.
4. The St. Paul Land Use Plan classifies this area as part of a mixed use strip.
Rezoning the parcel to P-1 for use as parking is an appropriate land use under the
plan.
F. STAFF RECOM�1ENDATION: Based on findings 3 and 4 above, staff recorr�nends approval of the
rezoning to P-1 .
