An Ordinance Amending Chapter 9 of the
Charter of the City of Saint Paul Per-
taining to the Appointment of Fire Chief. .
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
Pursuant to Minnesota Statutes, �410.12, sub. 7, and upon the
recommendation of the Charter Commission of the City of Saint Paul,
the Charter of the City of Saint Paul as approved by the voters on �
November 3, 1970 is hereby amended in Section 9. 02 thereof so that
the same shall read:
Sec. 9 . 02 . Terms of Officers in Unclassified Service.

eer�et�r�e�t-�a�tk-�ka�-s�-��e-Mape�.- The term of the
present Fire Chief shall expire on M_a_� 3 , 9 5.
, Thereafter the term of the Fire Chi� shall be for
six�ears, the beginning of which shall be June 1,
1985. Other officers in the unclassified service
shall serve f or indefinite terms .
Section 2 .
This ordinance shall become effective ninety (90) days after
its passage, approval and publication, unless the effective date
is delayed by the filing of a petition pursuant to law.

Dear Council Members:
I am writing to you to propose a change in the City Charter
regarding the term of the Fire Chief.
At present, the City Charter provides that "The Fire Chief
shall serve for a term of two years concurrent with that of
the Mayor. Other officers in the unelassified service shall
serve for indefinite terms. " (Section 9.02) . The Police Chief,
as you know, serves a fixed term of six years after appointment.
I have never been comfortable with the Charter provision re-
garding the tenure of the Fire Chief and have never understood
why that position is singled out for special treatment in the
Charter.
My reasons for requesting that the term of the Fire Chief be
changed from two to six years are the following:
1. The term of the Fire Chief should be consistent with the
precedents which are set elsewhere in the Charter. Specifically,
the Police Chief, whose primary function is also in the area
of public safety, has a fixed term of six years. On the
other hand, I know no reason why the Fire Chief ' s term should
expire when no other City position has a similar constraint
imposed upon it.
2. Because of the way in which the Charter provides for the
appointment of the Fire Chief, there is an undue amount of
politicking surraunding the appointment. While such a
phenomenon may be inevitable, especially over the appoint-
ment of such an important position, it is inappropriate for
the Charter to build in the opportunity for that phenomenon
to occur. In addition, it is a disservice to a mayoral
candidate to be pressured to make a commitment to a candidate
for Fire Chief when the mayoral candidate has no experience

in the Mayor' s position. The Charter eliminates this
possibility in its provisions for the appointment of a
Police Chief. I believe the same protection should exist
for the appointment of the Fire Chief.
3. A fixed term of office for the Fire Chief will give the
Chief the security necessary to properly discharge the
management responsibilities of the Fire Chief' s position.
Again, the Fire Chief' s position is the only City position
with a fixed termination date . No other department or
office director is faced with that constraint. The manage-
ment of the Fire Department should be dictated by good manage-
ment practices, not the threat of losing the appointment as
Fire Chief.
I have attached a Council resolution which requests that the
Charter Commission review this proposal and submit its findings
to you. As you know, changes to the Charter must be reviewed
and approved by the Charter Commission �and then unaniriously
passed by the City Council.
