An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes §462.357 and §64.210
of the Legislative Code, the Housing and Redevelopment Authority of
the City of Saint Paul duly petitioned to rezone Lot 9 and part of
Lot 8, Auditor' s Subdivision No. 4, vacated Ellis,. and Lot 19,
Block 79, St. Anthony Park Addition, located on Territorial Road,
from RM-2 to B-2 for the purpose of constructing office and retail
development of the former Baker School building, the petition having
been certified by the Department of Finance and Management Services
on March 17, 1981 as having been consented to by at least 67� of the
owners of the area of the property to be rezoned, and further having
been consented to by at least two-thirds of the owners of the property
situated within 100 feet of the total contiguous deseriptions of real
estate held. �y the same owner or any party purchasing any such contig-
uous property ���ithin one year preceding the date of the petition; and
WHEREAS, The current Planning Committee on April 2, 1981 con-
ducted a public hearing for the purpose of considering the rezoning
petition, and pursuant to Section 107.03 of the Administrative Code,
submitted its recommendation to the Planning Commission that the
petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its �neeting held on April 10, 1981 and recomznended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

WHEREAS, A public hearing before the City Council, having been
conducted on April 21, 1981 where a11 interested persons were heard,
and the Council having considered all �he facts and recommendations
concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT FAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 9,
as incorporated by reference in Section 60.401 of the Saint Paul
Legislative Code, as amended, is hereby further aznended as follows:
That property located on Territorial Road, being
more particularly described as Lot 9 and part of Lot 8,
Auditor' s Subdivision Na. 4, vacated Ellis, and Lot 19,
Block 79, St. Anthony Park Addition, be and is hereby
rezoned from RM-2 to B-2 .
Section 2 .
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Sir:
This letter is written in response to the petition of the Housing and
Redevelopment Authority to rezone property at the northwest corner of
Raymond and Territorial Road from RM-2 (Multiple Family Residential )
to B-2 (Community Business) in order to rehabilitate the existing
Baker School structure for use as office and retail space.
On April 2, 1981 , the Zoning Committee of the Planning Commission
conducted a public hearing on this case. There was no opposition to
the rezoning, and the Committee recommended approval of the rezoning
to 6-2 on a vote of 7 to 0.
The Planning Commission considered the Zoning Committee's recommendation
on April 10, 1981 , and approved the rezoning on a vote of 16 to 0.
This matter is scheduled to be heard by the City Council on April 21 ,
1981 .

6. STAFF INVESTIGATION & REPORT: DATE 3/26/81 BY Al1an L. Torstenson
A. SUFFICIENCY: The application was filed on a consent petition subscribed and sworn to
e ore a notary public on February 27, 1981 , and declared sufficient by the Finance
Department on March 17, 1981 . Eighty parcels were eligible, and 53 parcels were needed.
The purpose of the rezoning from RM-2 Multiple Family Residential to B-2 Community
Business was stated on the petition as : totally rehabilitating the existing Baker
School structure for use as office and retail rental space, along with adequate off-
street parking and open space.
B. FRONTAGE & AREA: This corner site has a 370 ' frontage on Raymond, a 323.82' frontage
on Territorial , and an area of sq. ft.
C. SITE/AREA CONDITIONS: The site contai�s the old Baker School . Ellis Avenue, where
it goes through the site, is in the process of being vacated. The South St. Anthony
Playground is west of the site, across Hunt Place. A 15-unit townhouse project is
planned for the area between the site and Hunt. Across Raymond is a senior's high
rise. There are single family homes north of the site, and business and industrial
uses south of the site, across Territorial Road.
D. FINDINGS:
1 . The District 12 Plan, adopted by the Planning Commission on November 9, 1979, and
by the City Council on January 10, 1980, and part of the City's Comprehensive Plan ,
addresses the Baker School Site specifically. It states : The following
recommendation summarizes the controls that have been adopted by the District
Council and the City. The overriding objective is to maintain the building as a
significant community landmark. . . .the Baker School building should be developed
for housing, retail , or office use, either in combination with the site immediately
to the west or separately.
The proposed rezoning to allow retail and office use is in conformance with the
City's Comprehensive Plan.
2. The proposed rezoning to B-2 would be beneficial to the surrounding community,
since it would help maintain a significant community landmark.
E. STAFF RECOMMENDATION: Based on findings 1 and 2 above, staff reconimends approval o�
the rezoning.

A. SUFFICIENCY The application was filed on a consent petition subscribed and sworn to
e ore a notary public on February 27, 1981 , and declared sufficient by the Finance
Department on March 17, 1981 . Eighty parcels were eligible, and 53 parcels were needed.
The purpose of the rezoning from RM-2 Multiple Family Residential to B-2 Community
Business was stated on the petition as : totally rehabilitating the existing Baker
School structure for use as office and retail rental space, along with adequate off-
street parking and open space.
6. FRONTAGE & AREA: This corner site has a 370 ' frontage on Raymond, a 323.82' frontage
on Territorial , and an area of sq. ft.
C. SITE/AREA CONDITIONS: The site contai�ls the old Baker School . Ellis Avenue, where
it goes t r�ough the site, is in the process of being vacated. The South St. Anthony
Playground is west of the site, across Hunt Place. A 15-unit townhouse project is
planned for the area between the site and Hunt. Across Raymond is a senior's high
rise. There are single family homes north of the site, and business and industrial
uses south of the site, across Territorial Road.
D. FINDINGS:
1 . The District 12 Plan, adopted by the Planning Commission on November 9, 1979, and
by the City Council on January 10, 1980, and part of the City's Comprehensive Plan,
addresses the Baker School Site specifically. It states : The following
recommendation summarizes the controls that have been adopted by the District
Council and the City. The overriding objective is to maintain the building as a
significant community landmark. . . .the Baker School building should be developed
for housing, retail , or office use, either in c�mbination with the site immediately
to the west or separately.
The proposed rezoning to allow retail and office use is in conformance with the
City's Comprehensive Plan.
2. The proposed rezoning to B-2 would be beneficial to the surrounding community,
since it would help maintain a significant community landmark.
E. STAFF RECOMMENDATION: Based on findings 1 and 2 above, staff recommends approval of
the rezoning.
