276715 WHITE - CITY CLERK ��jC��rq PINK - FINANCE / QANAR�- DEPARTMENT G I T Y O F S A I N T PA U L COUtIC1I � V BLUE� - MAYOR File N O. ��ty Attny/JTH uncil Resolution Presented By Referred To Committee: Date Out of Committee By Date RESOLUTION APPROVING COOPERATION AGREEMENT IN AID OF A REDEVELOPMENT PROJLCT UNDERTAKING AND APPROVING CONVEYANCE OF CITY OWNED LAND IN THE PROJECT AREA FOR REDEVELOPMENT PURPOSES WHEREAS, the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota (HRA) , with approval of the Council of the City of Saint Paul, Minnesota (City) , has undertaken a redevelopment project pursuant to the Municipal Housing and Redevelopment Act, Minnesota Statutes Sections 462 .411 through 462 .711 (the Act) , identified as the Central Core Neighborhood Development Program Area, Project Minn. A-1-5; and WHEREAS, the City owns in fee certaa,n land within the Central Core Project Area identified as the Farmers Market acquired for and devoted to public market use under provision of Chapter 292, General Laws For 1899, which land is minimally improved and presently used for vehicular parking and limited public market use, but is potentially useful and valuable for redevelopment more significantly contributing to the general welfare of the community; and WHEREAS, pursuant to Minn. Stat. Section 462 .445 Subdivision 3, HRA is authorized with approval of the City Council to acquire property in a redevelopment project area needed or convenient for such project which was acquired by condemnation for and presently devoted to another public use and, pursuant to Section 13.05 of the Saint Paul City Charter and Chapter 228 of the Saint Paul Legislative Code, the City Council has on April 21, 1981, conducted a public hearing upon the vacation of the public market use of the property and approval of the acquisition of the vacated market site by HRA; and COUNCILMEIV Requestgd by Department of: Yeas Nays Hunt Levine In Favor Maddox McMahon B snowaiter - __ Against Y — Tedesco wlson Form Approved by City Attorney Adopted hy Council: Date _ Certified Passed by Council Secretary BY By Approved by 1+layor. Council Resolution Presented By Referred To Committee: Date Out of Committee By Date -2- WHEREAS, pursuant to Charter Section 13.05, Chapter 228 of the Legislative Code and Minn. Stat. Section 462 .581, for the purpose of aiding and cooperating in the undertaking of HRA projects, the City Council is authorized to vacate public usage and convey City owned property upon such terms or conditions as set forth in said Charter, Code and Statutory provisions and as it may determine, and the City Council having considered a proposed Cooperation Agreement between the eity and HRA containing terms and conditions for HRA acquisition of the vacated public market site and for its redevelopment, Now Therefore BE IT RESOLVED, that the acquisition by the HRA of the vacated public market site and its conveyance by the City to HRA for redevelopment purposes are hereby approved; and BE IT FURTHER RESOLVED that the document entitled Cooper- ation Agreement between the City and HRA is hereby approved; and BE IT FURTHER RESOLVED that the proper City officers are hereby authorized to execute on behalf of the City, in form approved by the City Attorney, said Cooperation Agreement, Deed of conveyance and such other instruments as may be necessary or desirable to carry out the purposes of this Resolution.
