RESOLVED, that upon execution and delivery of a release
in full to the City of Saint Paul, the proper City officers
are hereby authorized and directed to pay out of the Tort
Liability Fund 09070-511-000 to David J. Schendan the sum of
$500 in full settlement of his claim for damages sustained
Ma.y 27, June 16 and June 25, 1978, as more particularly set out
in a communication to the City Council on July 24, 1979.

RE: Claim of David J. Schendan
David J. Schendan sued his landlord, Omar Tveten, for water
damage that occurred in the leased premises on three different
days in 1978 . A contributing factor to the flooding was the
fact that the City diverted water from its alley into a catch
basin in the backyard of the building. Liability was very doubt-
ful in this case, bu the defendant brought in the City as a
third party defendant. Recently, an opportunity arose to settle
all issues for $500. Since the expense of preparing and trying
this case would have been greater than $500, we accepted the
offer. This office recommends this settlement.
