An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for th� City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, �462 .357 and �64.210
of the Legislative Code, Harry Jensen duly petitioned to rezone
Lot 20 and the South 81.08 feet of Lot 21, Snelling Outlots, located
on the east side of Davern Street north of W. Seventh Street from
RM-2 to B-2 for the purpose of constructing a parking lot and drive
up lanes for a new bank, the petition having been certified by the
Department of Finance and Management Services on October 22, 1980
as having been consented to by at least 67$ of the owners of the
area of the property ta be rezoned, and further having been consented
to by at least two-thirds of the owners of the property situated
within 100 feet of the total contiguous descriptions of real estate
held by the same owner or any party purchasing any such contiguous
property within one year preceding the date of the petition; and
WHEREAS, The current planning committee on December 4, 1980
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107 .03 of the Admini-
strative Code, submitted its recommendation to the Planning Com-
mission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on December 19, 1980 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official
newspaper of the City on March 21, 1981 and notices were duly

This letter is written in response to the petition of Harry Jensen to
rezone property on the east side of Davern Avenue between W. 7th Street
and St. Paul Avenue from RM-2 (medium density, multiple-family residential
district, height limit of 5 stories) to B-2 (community business) to allow
construction of a parking lot and drive-up lanes for a new bank to be
constructed on W. 7th Street. (The parcel where the bank will be located
is already zoned B-2. )
On December 4, 1980, the Zoning Committee conducted a public hearing .on
this case. The only corresponclence received on this case was a letter
from the Southwest Area District Council in strong support of the rezoning.
The Zoning Committee recommended approval of the rezoning petition on a
vote of 5 to 0.
The Planning Commission considered the Zoning Committee's recommendation
on December 19, 1980, and approved the rezoning on a vote of 17 to 0.
The matter of the requested rezoriing is scheduled to be heard by the
City Council on April 2, 1981 . Please notify me at least by April 1 , 1981 ,
if any member of the City Council wishes to have slides o� the site pre-
sented at the City Council public hearing.

HARRY JEPJSEN (#8766) : A request for rezoning of two vacant parcels to allow
construction of a parking lot and drive up lanes for a new bank to be
constructed on W. lth Street.
The applicant was present. There was no opposition present at the hearing.
Ms. Daykin showed slides of the site and reviewed her staff report with a
recommendation for approval . She added that the Southwest Area District
Council strongly supports the rezoning.
Harry Je►�sen, 2475 W. 7th Street, commentea that it has taken a long time to
coordinate the land for the proposed use.
Hearing no further testimony, Mr. Bryan closed the public hearing portion of
the meeting.
P�r. Levy made a motion to recommend approval of the rezoning. Ms . Summers
seconded the motion. The motion passed on a roll call vote of 5 to 0.

A. PURPOSE: The applicant is requesting a rezoning of two vacant parcels from RM-2 to B-2
to allow construction of a parking lot and drive up lanes for a new bank to be constructed
on lJ. 7th Street. (The parcel where the bank ��vill be located is already zoned B-2. )
B. SUFFICIENCY: The application was filed on a consent petition declared sufficient by the
Finance Department on October 22, 1980. Twenty-three parcels were eligible to sign;
,16 were needed, and 16 parcels were obtained.
C. FRONTAGE & AREA: The site has a 191 foot frontage on Dav�rn Avenue and a total area of
about 23,429 squa.re feet. .
7. SITE � AREA COidDITIONS: The site is irregularly shaped. It is about 10 feet above street
grade at its highest point and about 5 feet above grade at other points. Surrounding land
uses include Sibley Plaza Shopping Center to the east, the Q Superette Gas Station to the
south, single family homes to the west, and single family bomes , duplexes , and apartment
buildings to the north. .. �

E. FINDINGS:
1 . Prior to 1975, the site was zoned "A" Residence and was designated RP�-2 in 1975. The
site was previously occupied by a nonconforming warehouse which has been removed.
2. The rezoning is in conformance w�th the St. Paul Land Use Plan. The Land Use
Plan states that "Intensifying existing retail uses, encouraqing new business
� uses, and providing opportunities for housing can help to provide a healthy
image for all of St. Paul 's commercial strips." This area is designated as
a mixed use (commercial ) strip by the Land Use Plan.
3. The rezoning appears to be compatible with surrounding land uses. The adjacent
Sibley Plaza is zoned B-2 and the commercial uses on t-J. 7�h Street west of �avern are
zoned B-3. �
�4. The Southwest Area District Council strongly supports rezoning the property to ,allow
construction of the bank.
