276462 WHITE - CITY CLERK PINK .�- FINANCE COUI1C11 �d��� � CAN/[RY - DEPARTM6NT G�I T Y O F S A I N T PA U L BLUE - MAYOR File N O. � Ci yy Attny/SDP�I • ci Resolution , Presented By Referred o Committee: Date Out of Committee By Date RE50LUTION CREATING MINNESOTA STATUTES SECTION 472A.11 ADVISORY BOARD FOR THE PROPOSED BLOCK 40 DEVELOPMENT DISTRICT AND APPOINTING MEMBERS THERETO WHEREAS, a) Minnesota Statutes Chapter 472A (the "Act") allows cities to create Development Districts and develop � programs for their improvement pursuant to the Act; and b) Section 472A.11 of the Act requires cities of the first class to create an Advisory Board for each such proposed Development District and to consult with the Advisory Board prior to the creation of the Development District; and c) The City of Saint Paul has been presented with a proposed program contemplating the creation of the Block 40 Development District, a Development District which is not substantially residential as that term is defined by the Act. NOW THEREFORE BE IT RESOLVED by the Council of the City of Saint Paul as follows: 1. An Advisory Board consisting of five members for the proposed Block 40 Development District is hereby created, three of the members shall be owners or occupants of real property located within the proposed district and two others. '_" /``� n :��'b r � �F�.� ���� -2- advise the City and the District Administrator (the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota) on the planning, construction and implementation of the development program, and maintenance and operation of the district after the program has been completed. 2 . The term of office for each member of the Advisory Board shall be two years. 3. The Advisory Board shall prepare its own By-laws and Rules, not inconsistent with this resolution, which it feels are required for its operation. 4 . The staff of the Department of Planning and Economic Development shall make recommendations to and assist the Advisory Board and the District Administrator as required. 5. Within thirty (30) days following its creation, the Advisory Board shall meet not less than twice to review and prepare recommendations regarding the Development Program. These recommendations shall be forwarded to the District Administrator and the City Council for review prior to the City Council 's adoption of the Development Program. 6 . Subsequent to the adoption of the Development Program, the Advisory Board shall hold a meeting on the third Wednesday of each month to review the progress of the implementation of the Development Program until all of the projects proposed in the Development Program have been a. contractually committed for implementation, or b. formally terminated by the District Administrator if contractual commitments have not been received for that part of the redevelopment actively within 180 days from the adoption of the Development Pro- gram. 7. Subsequent to the contractual commitments for all viable projects or the expiration of the 180-day period from the adoption of the Development Program, whichever is first, the Advisory Board shall meet on the first Wednesday of each quarter until all of the construction activities undertaken in accordance with the Development Program have been completed ("Construction Phase") to monitor the construction activities . After the completion of the Construction Phase, the Advisory Board shall meet annually on the first Wednesday in June to monitor and advise the District Administrator of the ongoing operations of the district. 9 . In the event of a conflict between the Advisory Board, the District Administrato� and/or the Planning Commission, the parties shall submit their recommendations in writing to the City Council at its next regularly scheduled meeting and the City Council shall render its decision regarding the conflicting recommendations within thirty (30) days and the decision of the City Council shall be binding upon all parties. 10 .
